At the Government Buildings at Wellington, this 10th day of April, 1951

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
WHEREAS by section 30 of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General may, by Order in Council, on petition in that behalf signed by a majority of the persons qualified to be enrolled on the ratepayers’ list for any proposed district, constitute and declare any area of land of not less than one thousand acres a rabbit district under and for the purposes of Part II of the said Act :
And whereas, in pursuance of the provisions of the said section 30 of the said Act, a petition has been received praying that the area of land described in the Schedule hereto be constituted and declared a rabbit district under and for the purposes of Part II of the said Act :
And whereas the said petition is signed by a majority of the persons in the said area of land qualified to be enrolled on the ratepayers’ list for the said proposed district, and it is deemed expedient to give effect to the prayers of the petitioners accordingly :
Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute by the specific name of the “Ohau Rabbit District” and declare that area of land defined in the Schedule hereto to be a rabbit district under and for the purposes of Part II of the said Act ; and doth hereby further declare that the basis on which the Board to be established for the said district shall first levy its general rate shall be on the basis of the acreage of the rateable property in the said district.

SCHEDULE
BOUNDARIES OF THE OHAU RABBIT DISTRICT
ALL that area of land in the Marlborough Land District containing approximately 90,900 acres and bounded as follows : Commencing at the junction of the south bank of the Clarence River and the east bank of Jam Stream in Block I, Puhipuhi Survey District ; thence generally southerly by the east bank of the said Jam Stream and the western boundary of Small Grazing Run 108 to the triangulation station marked R in Block VIII, Puhipuhi Survey District, and by the western boundaries of Small Grazing Runs 105B, 105A, 104, 103, and part 102c to the Clinton Stream, and by the eastern bank of the said stream to its junction with other branch of the said Clinton Stream and across the said stream, and by the south bank of the aforesaid branch of the said Clinton Stream to a point in line with the north-western boundary of Section 2, Block XV, Kaitarau Survey District, and by a right line across a public road to the northern corner of the aforesaid Section 2, and by the north-western boundaries of the said Section 2 and Sections 2 and 3, Block II, Mount Fyffe Survey District, to the westernmost corner of the said Section 3, Block II, Mount Fyffe Survey District ; thence generally south-easterly by the south-western boundary of the said Section 3 to the southern corner of the said Section 3, and by a right line to the western corner of Section 13, Block II aforesaid, and by the south-western and south-eastern boundaries of the said Section 13 and the south-western boundary of Section 12, Block II aforesaid, to the southern corner of the said Section 12 ; thence north-easterly by the south-eastern boundaries of the said Section 12 and Section 4, Block III, Mount Fyffe Survey District, to the northern corner of Section 9A 2, Mangamaunu Maori Block in Block III, Mount Fyffe Survey District ; thence south-easterly by the north-eastern boundary of the said Section 9A 2 to a public road and by the prolongation of that boundary across the aforesaid public road to the sea-coast ; thence north-easterly by the sea-coast to the southern bank of the Clarence River ; thence northerly and westerly by the western and southern banks of the said Clarence River to the point of commencement.

ORDER IN COUNCIL

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to the Rabbit Nuisance Act, 1928, and to section 29 of the Rabbit Nuisance Amendment Act, 1947, His Excellency the Governor-General, at the request of the Minister of Agriculture, made on the recommendation of the Rabbit Destruction Council, and acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area of land, the boundaries of which are described in the Schedule hereto, being an area to which subsection (1) of section 30 of the Rabbit Nuisance Act, 1928, applies, a rabbit district, and doth appoint that the name of the said rabbit district shall be the Waitemata Rabbit District, and doth order that the basis on which the Rabbit Board to be established for the said district shall first levy its general rate shall be the acreage of land occupied by the ratepayer.
SCHEDULE
DESCRIPTION OF BOUNDARIES OF THE WAITEMATA RABBIT DISTRICT
ALL that area in the Waitemata County, containing approximately 101,000 acres, bounded by a line commencing at the mouth of the Waiwera River ; thence in a southerly direction along the coast to the mouth of the Orewa River ; thence in a south-westerly direction along the north-western side of the Main North Road to the south-eastern side of Black Bridge Road, and along the said south-eastern side of that road to the north-east corner of Allotment E. 275, Pukeatua Parish ; thence along the road forming the northern and north-western boundaries of Allotments E. 275 aforesaid and W. 275 of the said parish to the boundary of the State forest as set apart and described in the New Zealand Gazettes of 1926, page 1193, 1929, page 2415, 1930, pages 737 and 3748, and 1933, page 394 ; thence along the eastern and southern boundaries of the said State forest to the eastern boundary of Allotment 50, Paremoremo Parish ; thence along the eastern boundary of the said Allotment 50 to the Kumeu River, and down that river to the south-western boundary of Lot 1 on D.P. 13290, being part of Waikoukou No. 2 Block ; thence along the western boundary of the said Lot 1, to and across the North Auckland Main Trunk Railway Reserve to the Auckland-Helensville Main Highway, and north-westerly along the north-eastern side of the said highway to the Waipatukahu Stream ; thence down that stream, to and across the Kaipara River, along its eastern side, along the southern, eastern, and northern boundaries of the Helensville Town District as described in the New Zealand Gazette 1883, page 1527, and again along the eastern side of Kaipara River aforesaid, the Kaipara Harbour, and the Ngapuke Creek to a point, being the production westwards of the northern boundary of Allotment 128A, Kaukapakapa Parish ; thence easterly generally along a right line across a road, along the northern boundary of the said 128A, the northern boundaries of Allotments 126, 125, N. 115, 113, W. 112, E. 112, 105, 92, 91, 90, 89, 88, Kaukapakapa Parish, to and across the North Auckland Main Trunk Railway Reserve, and along its south-eastern boundary to the Waitemata County boundary as described in the New Zealand Gazette 1930, page 2888 ; thence along the said county boundary to the mouth of the Waiwera River, the point of commencement.

Authorizing the Laying-off of Streets off Kaikorai Valley Road, in the City of Dunedin, of Widths Less Than 66 Feet, Subject to a Condition as to the Building-line

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Dunedin City Council to permit the laying-off of the proposed streets described in the Schedule hereto at a width for the whole of their lengths of less than 66 feet but not less than 40 and 42 feet (as shown on the plan referred to in the said Schedule) subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said proposed streets within a distance of 48 feet from the centre-line of the said streets.

Those proposed streets in the Otago Land District, City of Dunedin, containing by admeasurement 3 acres 1 rood 26 perches, more or less, being parts Sections 17, 18, 19, 20, 21, 22, 23, 24, 25, 676R, Block V, Lower Kaikorai Survey District.
As the same are more particularly delineated on the plan marked P.W.D. 133834, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
