Authorizing the Acquisition of Timber Cutting Rights Over Land Notwithstanding the Provisions as to Limitation of Area

At the Government Buildings at Wellington, this 20th day of December, 1950

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL
PURSUANT to section 246 of the Maori Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby authorize the disposition to and acquisition by Clifton Lands, Limited, of Auckland, of all timber cutting rights over the land described in the Schedule hereto, notwithstanding the provisions of Part XII of the said Act.
SCHEDULE
FIRST, all that parcel of land containing 569 acres, more or less, being the block of land situated in the Pakaumanu Survey District called Rangitoto A No. 67B No. 1A, and being the whole of the land comprised and described in Certificates of Title, Volume 210, folio 87, and Volume 490, folio 225, of the Auckland Registry.
Secondly, all that parcel of land containing 999 acres 1 rood 8·5 perches, more or less, situated in Block III of the Pakaumanu Survey District, being portion of the Rangitoto A No. 48B Section 2A No. 2 Block, and being the whole of the land comprised and described in Certificate of Title, Volume 725, folio 159, of the Auckland Registry.

PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the One Tree Hill Borough Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 feet, but not less than 40 feet, subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan referred to in the said Schedule within a distance of 48 feet from the centre-line of the said street.
SCHEDULE
THAT proposed street in the North Auckland Land District, Borough of One Tree Hill, containing by admeasurement 37 perches, more or less, being part of Allotment 14, Section 11, Suburbs of Auckland. PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Palmerston North City Council to permit the laying-off of the proposed streets described in the Schedule hereto at a width for part of their lengths of less than 66 feet, but not less than 50 feet, subject to the condition that no building or part of a building shall at any time be erected on Lots 20 to 64 inclusive, of a subdivision of the land fronting the said streets (as shown on the plan marked P.W.D. 130677 referred to in the Schedule hereto) within a distance of 48 feet from the centre-lines of the said streets or on Lots 2, 3, 6, and 7, of the said subdivision within a distance of 33 feet from the centre-lines of the said streets.
SCHEDULE
THAT proposed street in the Wellington Land District, City of Palmerston North, to be known as Milton Street, containing by admeasurement 1 acre 1 rood 14·63 perches, more or less, being part of the balance of Lot 5, Deposited Plan 693, and being part of Section 420 on the plan of the Town of Palmerston North.

PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Tauranga Borough Council to permit the laying-off of the proposed street first described in the Schedule hereto at a width for part of its length of less than 66 feet, but not less than 50 feet, subject to the condition that no building or part of a building shall at any time be erected on Lot 49 of a subdivision of the land edged green on the plan marked P.W.D. 132877, referred to in the said Schedule and fronting the proposed street, within a distance of 40 feet from the centre-line of the said street, or on Lots 15, 16, 17, 37, 48, and 118 to 125 inclusive of a subdivision of the said land as shown on the said plan marked P.W.D. 132877, fronting the proposed street, within a distance of 48 feet from the centre-line of the said street; and of the proposed street secondly described in the Schedule hereto at a width for part of its length of less than 66 feet, but not less than 50 feet, subject to the condition that no building or part of a building shall at any time be erected on Lots 84 to 87 inclusive and Lots 98, 99, and 100 of a subdivision of the said land as shown on the said plan marked P.W.D. 132877, fronting the proposed street, within a distance of 48 feet from the centre-line of the said street, or on Lots 91 to 97 inclusive of a subdivision of the said land as shown on the said plan marked P.W.D. 132877, fronting the proposed street, within a distance of 33 feet from the centre-line of the said street.
