Constitution of Rural Fire District

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 22nd day of November, 1950
Present:
THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
Pursuant to the Forest and Rural Fires Act, 1947, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area described in the Schedule hereto to be a rural fire district, to be known as the “Western Waiheke Rural Fire District”; and doth hereby specify the trees and other plants in the said area as the property for the protection of which the district is constituted; and doth hereby specify the period between the lst day of October in any one year and the 30th day of April in the following year (both days inclusive) as a closed fire season in the said district; and doth hereby constitute the Western Waiheke Road Board as the rural fire committee of the Western Waiheke Rural Fire District; and doth hereby declare that this Order in Council shall come into force and that the Western Waiheke Rural Fire District shall become a rural fire district on the day following publication of this Order in Council in the New Zealand Gazette; and doth hereby prescribe that the said district shall be administered for the purposes of the said Act by the Rural Fire Committee hereby constituted.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT—AUCKLAND CONSERVANCY
Western Waiheke Rural Fire District
ALL that area in the North Auckland Land District, containing approximately 6,600 acres, situated in Blocks XII and XIII, Rangitoto Survey District, and Blocks I, II, III, V, VI, and VII, Waiheke Survey District, and being that portion of Waiheke Island described generally as follows: Commencing at a point on the line of mean high water on the eastern shores of Onetangi Bay, Block III, Waiheke Survey District, being the north-western corner of Lot 22, as shown on the plan numbered 11657, deposited in the office of the District Land Registrar at Auckland, being part of Allotment 41, Parish of Waiheke, and running in an easterly direction along the northern boundary of the said Lot 22, and in a southerly direction along the western boundary of Lot 1, as shown on the plan numbered 28342, deposited as aforesaid, being part of Allotment 97, Parish of Waiheke, to and along the western side of a public road, to and along the eastern boundary of Lot 23, as shown on the said plan numbered 11657, being parts of Allotments 41 and 70, Parish of Waiheke, to and along the northern and western boundaries of the northern portion of Allotment 64, Parish of Waiheke, to and along the northern boundary of Allotment 71, Parish of Waiheke, and a right line being that boundary produced across a public road, to and along the western side of that road, to and along the western boundary of the southern portion of Allotment 64, aforesaid, to the northern boundary of Lot 4, as shown on the plan numbered 24387, deposited as aforesaid, being part of Awa Awa Roa Block; thence in a westerly direction generally along the northern boundary of the said Lot 4 and the eastern and north-western boundaries of part of Whakanewha Block, to and along the north-eastern boundary of Rangihoua No. 1 Block, as shown on the plan numbered 1721, deposited as aforesaid, to the line of mean high water on the shores of Putiki Bay; thence generally westerly, northerly, and easterly along the line of mean high water of the southern, western, and northern shores of Waiheke Island, aforesaid, to the point of commencement. As the same is more particularly delineated on plan No. 17A/1, deposited in the Head Office of the New Zealand Forest Service at Wellington, and thereon bordered red.

Officers Authorized to Take and Receive Statutory Declarations

Pursuant to the authority conferred upon me by section 301 of the Justices of the Peace Act, 1927, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under section 301 of the Justices of the Peace Act, 1927.

Notice of Intention to Issue an Order in Council Revoking the Reservation for Recreation Purposes Over a Reserve in Borough of Ashburton, Canterbury Land District

WHEREAS by subsection (1) (b) of section 7 of the Public Reserves, Domains, and National Parks Act, 1928 (hereinafter referred to as the said Act), it is provided that the Governor-General may, from time to time, by Order in Council, revoke the reservation over any public reserve or part thereof, and thereupon the land comprised therein shall, if vested in the Crown or in any local authority or trustees deriving title from the Crown, become Crown land available for disposal under the Land Act, 1948:
And whereas the land described in the Schedule hereto is a reserve duly set apart for recreation purposes but is not required for that purpose, and it is expedient to revoke the reservation over the said land:
Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby give notice, pursuant to subsection (2) of section 7 of the said Act, that it is my intention to issue an Order in Council under the provisions of subsection (1) (b) of section 7 of the said Act declaring that the reservation for recreation purposes over the land described in the Schedule hereto shall be revoked.

RESERVE 4409, Borough of Ashburton : Area, 1 acre and 4·6 perches, more or less.

Land Reserved in the Wellington Land District for a Roadman's Cottage and Paddock

WHEREAS by section 167 of the Land Act, 1948, it is enacted that the Governor-General may from time to time set apart as a reserve, notwithstanding that the same may be then held under pastoral lease or pastoral occupation licence, any Crown land for any purpose which, in his opinion, is desirable in the public interest and notice thereof shall be published in the New Zealand Gazette:
Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby reserve the land in the Wellington Land District, described in the Schedule hereunder written for a roadman's cottage and paddock.

Wellington Land District
ALL those areas situated in Block VIII, Wainuioru Survey District, containing by admeasurement a total of 18 acres and 39·5 perches, more or less, being Lots 1 and 2 on a plan deposited in the Land Registry Office at Wellington under No. 14778, being parts Section 269, Pahaua Block. As the same are more particularly delineated on the plan marked L. and S. 22/4055, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
As witness the hand of His Excellency the Governor-General, this 25th day of November, 1950.
