Cancelling the Vesting of Portions of a Reserve in the Westport Borough Council

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 22nd day of November, 1950

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

WHEREAS the lands described in the Schedule hereto are parts of a reserve for municipal purposes, and are vested, in trust, in the Westport Borough Council:

And whereas it is expedient that the vesting of the said lands as hereinbefore referred to should be cancelled, and the Westport Borough Council has duly consented to such cancellation:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by subsection one of section ten of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby cancel the vesting in the Westport Borough Council of the lands described in the Schedule hereto.

SCHEDULE

NELSON LAND DISTRICT

ALL those areas in the Nelson Land District, Borough of Westport, being parts of Section 1001, Municipal Reserve, Town of Westport, containing by admeasurement 29 acres 3 roods 37·3 perches, more or less, and described as follows:—

All that area containing by admeasurement 8 acres and 10·6 perches, more or less, being Lots 2, 3, and 5 to 18 (both inclusive) on plan No. 313, and Lots 61, 66, and 68 on plan No. 47, both plans deposited in the office of the District Land Registrar at Nelson.

Also all that area containing by admeasurement 4 acres 3 roods 23·6 perches, more or less, being Lots 1 to 4 (both inclusive) on plan No. 380, Lots 47 and 49 on plan No. 47, both plans deposited in the office of the District Land Registrar at Nelson.

Also all that area containing by admeasurement 2 acres 3 roods 27·3 perches, more or less, being Lot 5 and part of Lots 1, 2, 3, and 4 on plan No. 392, Lot 51, and part of Lot 53 on plan No. 47, both plans deposited in the office of the District Land Registrar at Nelson, and described as follows: Commencing at the north-eastern corner of Lot 5 aforesaid, being the intersection of Wakefield and Haselden Streets; thence toward the east by Haselden Street to its intersection with Rintoul Street; thence toward the south by Rintoul Street to the south-eastern corner of part of Lot 53, deposited plan 1038; thence toward the west by the said part Lot 53, and another part of Lot 53, to the south boundary of Lot 52, deposited plan 47; thence toward the north by Lot 52 aforesaid, again toward the west by the said Lot 52, distance 145·5 links; thence again toward the north by other parts of Lots 1, 2, 3, and 4 aforesaid, again toward the west by the said part of Lot 4 to Wakefield Street; thence again toward the north by Wakefield Street to the point of commencement.

Also all that area containing by admeasurement 7 acres 1 rood 23·8 perches, more or less, being Lots 54, 56, 57, and part of Lot 55 on plan No. 47, deposited in the office of the District Land Registrar at Nelson, and described as follows: Commencing at the north-eastern corner of Lot 54 aforesaid, being the intersection of Rintoul and Domett Streets; thence on the east by Domett Street, distance 600·07 links, to the north boundary of other part of Lot 55 aforesaid; thence toward the south and east by the said part of Lot 55, distances 250·88 links and 100 links respectively to Fonblanque Street; thence toward the south by Fonblanque Street to the south-eastern corner of Section 1148, Town of Westport; thence toward the west by the said section 1148 to Rintoul Street; thence towards the north by Rintoul Street to the point of commencement.

Also all that area containing by admeasurement 5 acres 2 roods 7·4 perches, more or less, being Lots 62, 64, and part of Lot 65 on plan No. 47, deposited in the office of the District Land Registrar at Nelson, and described as follows: Commencing at the north-eastern corner of Lot 62 aforesaid, being the intersection of Fonblanque and Domett Street; thence toward the east by Domett Street to the north-eastern corner of Lot 63, deposited plan 47; thence toward the south and east by the said Lot 63 to Mill Street, again toward the south by Mill Street, distance 273 links; thence toward the west, north, and east, distances 250 links, 85 links, and 250 links respectively by other part of Lot 65 aforesaid to Mill Street; thence again toward the south by Mill Street to its intersection with Haselden Street; thence toward the west by Haselden Street to its intersection with Fonblanque Street; thence toward the north by Fonblanque Street to the point of commencement.

Also all that area containing by admeasurement 1 acre and 24·6 perches, more or less, being part of Lot 69 on plan No. 47, deposited in the office of the District Land Registrar at Nelson, and described as follows: Commencing at the north-western corner of Lot 67, deposited plan 47, thence toward the east by the said Lot 67 to Mill Street; thence toward the south by Mill Street to other part of Lot 69, deposited plan 3479; thence toward the west and north by the aforesaid part of Lot 69 to Derby Street; thence toward the west by Derby Street to the south-western corner of Lot 68, deposited plan 47; thence toward the north by the said Lot 68, to the point of commencement.

As the same are more particularly delineated on the plans marked L. and S. 6/2/6 and 6/2/6A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged sepia and red respectively. (Nelson S.O. Plans 9556, 9407.)

Revoking the Reservation over Portions of a Reserve in Borough of Westport, Nelson Land District

At the Government Buildings at Wellington, this 22nd day of November, 1950

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for municipal purposes over the lands described in the Schedule hereto; and doth hereby declare that the said lands, being vested in the Crown, are Crown lands available for disposal under the Land Act, 1949.

Also all that area containing by admeasurement 1 acre and 24·6 perches, more or less, being part of Lot 69 on plan No. 47, deposited in the office of the District Land Registrar at Nelson, and described as follows: Commencing at the north-western corner of Lot 67, deposited plan 47, thence toward the east by the said Lot 67 to Mill Street; thence toward the south by Mill Street to other part of Lot 69, deposited plan 3479; thence toward the west and north by the aforesaid part of Lot 69 to Derby Street; thence toward the west by Derby Street to the south-western corner of Lot 68, deposited plan 47; thence toward the north by the said Lot 68, to the point of commencement.
