ORDER IN COUNCIL

At the Government House at Wellington, this 13th day of September, 1950

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 5 of the Maori Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Maori freehold land described in the Schedule hereto as a Maori reservation for the common use of the Aitanga-a-Mahaki as a marae and meeting place.

PURSUANT to the Agricultural and Pastoral Societies Act, 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby incorporate the members of the Mount Benger Agricultural and Pastoral Society and such persons as shall hereafter be admitted members of the said Society agreeably to the rules of the said Society and the provisions of the said Act, into a body corporate under the style and title of “The Mount Benger Agricultural and Pastoral Society.”

Exempting Land in the Southland Land District From the Operation of Part III of the Coal-mines Act, 1925

IN pursuance and exercise of the powers and authorities conferred upon me by subsection (2) of section 171 of the Coal-mines Act, 1925, and of all other powers and authorities enabling me in this behalf, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby declare that the land described in the Schedule hereto shall be exempt from the operation of Part III of the Coal-mines Act, 1925, and do hereby further declare that this notice shall take effect as from the date of the publication hereof in the New Zealand Gazette.

SCHEDULE

ALL that area of land in the Southland Land District containing by admeasurement 1 acre 2 roods 12 perches, being part Lot 20, D.P. 1289, and being part Section 90, Block II, Wairio Survey District. As the same is more particularly delineated on S.O. Plan No. 5787, and thereon coloured sepia.

As witness the hand of His Excellency the Governor-General, this 21st day of September, 1950.

Notice of Intention to Issue an Order in Council Changing the Purpose of Part of a Reserve in Block VII, Christchurch Survey District, Canterbury Land District

WHEREAS by subsection (1) (a) of section 7 of the Public Reserves, Domains, and National Parks Act, 1928 (hereinafter referred to as the said Act), it is provided that the Governor-General may from time to time, by Order in Council, change the purpose of any public reserve or any part thereof, and thereafter such reserve or part, as the case may be, shall be held and administered for such changed purpose :

And whereas the land described in the Schedule hereto forms portion of a reserve duly set apart for recreation purposes, and it is expedient to change the purpose of the reservation over the said land to a reserve for an addition to a site for a public school :

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby give notice, pursuant to subsection (2) of section 7 of the said Act, that it is my intention to issue an Order in Council under the provisions of subsection (1) (a) of section 7 of the said Act, declaring that the said reservation over the land described in the Schedule hereto shall be changed to a reserve for an addition to a site for a public school.

SCHEDULE

CANTERBURY LAND DISTRICT

ALL that area situated in Block VII, Christchurch Survey District, containing by admeasurement 1 rood 17·9 perches, more or less, being part of Reserve 4383. As the same is more particularly delineated on the plan marked L. and S. 6/1/743, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

As witness the hand of His Excellency the Governor-General, this 22nd day of September, 1950.

Notice of Intention to Issue an Order in Council Revoking the Reservation for Recreation Purposes over a Reserve in Block VIII, Heretaunga Survey District, Hawke’s Bay Land District

WHEREAS by subsection (1) (b) of section 7 of the Public Reserves, Domains, and National Parks Act, 1928 (hereinafter referred to as the said Act), it is provided that the Governor-General may, from time to time, by Order in Council, revoke the reservation over any public reserve or part thereof, and thereupon the land comprised therein shall, if vested in the Crown or in any local authority, or trustees deriving title from the Crown, become Crown land available for disposal under the Land Act, 1948 :

And whereas the land described in the Schedule hereto is a reserve duly set apart for recreation purposes but is not required for that purpose, and it is expedient to revoke the reservation over the said land :

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby give notice, pursuant to subsection (2) of section 7 of the said Act, that it is my intention to issue an Order in Council under the provisions of subsection (1) (b) of section 7 of the said Act declaring that the reservation for recreation purposes over the land described in the Schedule hereto shall be revoked.

HAWKE’S BAY LAND DISTRICT

ALL that area containing by admeasurement 2 roods 14·8 perches, more or less, being Lot 10, D.P. 4212, being part Te Whare-O-Maraenui S.S. 39 and old bed of Tutaekuri River, situated in Block VIII, Heretaunga Survey District. As the same is more particularly delineated on the plan marked L. and S. 9/3561c, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

As witness the hand of His Excellency the Governor-General, this 22nd day of September, 1950.

Lieutenant-Colonel (temp. Colonel) J. I. Brooke, O.B.E., from the N.Z. Regiment to be Colonel. Dated 1st September, 1950.

THE ROYAL N.Z. ARTILLERY

Territorial Force—

Temp. Major T. R. C. Muir, from the Hauraki Regiment, to be Captain, with seniority from 27th October, 1944, retains the temporary rank of Major, with seniority from 24th June, 1948, is posted to the 1st Heavy Mortar Battery, R.N.Z.A., and retains the appointment of O.C., Tauranga College Cadets, in addition to his appointment of Troop Commander, A Troop, 1st Heavy Mortar Battery, R.N.Z.A. Dated 1st December, 1948.

Lieutenant R. S. Beveridge, 11th Coast Regiment, R.N.Z.A., to be Captain. Dated 22nd July, 1950.

Temp. Lieutenant H. Sharples, from the Reserve of Officers, Supplementary List, to be Lieutenant, with seniority from 14th October, 1948, and is posted to the 10th Coast Regiment, R.N.Z.A. Dated 3rd September, 1950.

John Lindsay Irvine, late Flying Officer, R.N.Z.A.F., to be Lieutenant, with seniority from 13th May, 1949, and is posted to the 1st Locating Battery, R.N.Z.A. Dated 1st September, 1949,
