Price Order No. 1163 (Amendment No. 1 of Price Order No. 1116) (Australian Wheat)

PURSUANT to the Control of Prices Act, 1947, the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, hereby makes the following amending Price Order:—

  1. This Order may be cited as Price Order No. 1163, and shall be read together with and deemed part of Price Order No. 1116* (hereinafter referred to as the principal Order).

  2. This Order shall come into force on the 15th day of June, 1950.

  3. The principal Order is hereby amended as follows:—

(a) By omitting the provisos and the table to clause 10 and substituting the following provisos and table:—

“Provided that where a distributor sells any wheat to which this Order applies on the basis of sacks included, the amount fixed in each of subparagraphs (i), (ii), or (iii) of paragraph (e) hereof may be increased by 7d. per bushel, where the wheat is packed in sacks of a size 41 in. by 23 in., or by 8d. per bushel where the wheat is packed in sacks of a size 46 in. by 23 in.

“Provided, further, that with respect to wheat sold in lots of one sack or more the maximum price shall not exceed:—

“(i) For sales made on the basis of sacks extra: the appropriate price set out hereunder reduced by 7d. per bushel; or

“(ii) For sales made on the basis of sacks included: the appropriate price set out hereunder where the wheat is packed in sacks of a size 41 in. by 23 in., or the appropriate price set out hereunder increased by a 1d. per bushel where the wheat is packed in sacks of a size 46 in. by 23 in.

Price Order No. 1164 (Cocoa)

PURSUANT to the Control of Prices Act, 1947, the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, hereby makes the following Price Order:—

  1. This Order may be cited as Price Order No. 1164, and shall come into force on the 15th day of June, 1950.

  2. (1) Price Orders Nos. 905* and No. 1101† are hereby revoked.

(2) The revocation of the said Orders shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.

APPLICATION OF THIS ORDER

  1. This Order applies with respect to all cocoa sold in New Zealand.

FIXING MAXIMUM PRICES OF COCOA TO WHICH THIS ORDER APPLIES

Wholesalers’ Prices

  1. (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any wholesaler (which term in this order shall be deemed to include a manufacturer selling to a retailer) for any cocoa to which this Order applies shall be the appropriate price set out in the Schedule hereto.

(2) The prices fixed by the foregoing provisions of this clause are fixed subject to the continuance of the practice in the cocoa trade with respect to cash and other discounts and with respect to freight arrangements existing immediately prior to the coming into force of this Order.

Retailers’ Prices

  1. (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any retailer for any cocoa to which this Order applies shall be the appropriate price set out in the Schedule hereto.

(2) If in respect of any lot of cocoa sold by a retailer the maximum price calculated in accordance with the foregoing provisions of this clause is not an exact number of pence or halfpence, the maximum price of the lot shall be calculated to the next upward halfpenny.

PROVISION FOR SPECIAL PRICES

  1. Notwithstanding anything in the foregoing provisions of this Order, and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any wholesaler or retailer, may authorize special maximum wholesale or retail prices in respect of any cocoa to which this Order applies where special circumstances exist, or for any reason extraordinary charges (freight or otherwise) are incurred by the wholesaler or retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of cocoa or may relate generally to all cocoa to which this Order applies sold by the wholesaler or retailer while the approval remains in force.
