ORDER IN COUNCIL

At the Government House at Wellington, this 9th day of February, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Roose Shipping Company, Limited, of Mercer (hereinafter called the company, which term shall include its successors and assigns, unless the context requires a different construction), to use and occupy a part of the foreshore and land below the low-water mark at Ngaruawahia, on the Waikato River, as shown on approved plan marked M.D. 5277, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining a wharf and shed thereon as shown on the said plan, such licence to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

CONDITIONS

  1. THIS licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply thereto.

  2. The term of the licence shall be fourteen years from the 1st day of February, 1949.

  3. The premium payable by the company shall be one pound (£1), and the annual sum so payable by the company shall be five pounds (£5).

  4. The master of every vessel discharging ballast at the said wharf shall have all such ballast taken away and deposited above high-water mark or at such place as may be approved by the Minister, or by any person appointed by the Minister for that purpose.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

SCHEDULE

APPROXIMATE areas of the portions of road declared to be Government road :—

A. R. P. Adjoining or passing through
1 3 23 Allotments 107, 108, 234, and 235, Komakorau Parish.
0 0 6 Allotment 107, Komakorau Parish.

In the Auckland Land District; as the same are more particularly delineated on the plan marked P.W.D. 125525, deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

Declaring Road in Block X, Heretaunga Survey District, to be Government Road

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

SCHEDULE

APPROXIMATE area of the portion of road declared to be Government road : 6·9 perches.

Adjoining part Lot 7, Deeds Plan 214, part Heretaunga Block.

Situated in Block X, Heretaunga Survey District (Hawkes Bay R.D.) (S.O. 2311.)

In the Hawkes Bay Land District; as the same is more particularly delineated on the plan marked P.W.D. 127770, deposited in the office of the Minister of Works at Wellington, and thereon coloured blue, edged blue.

PURSUANT to section one hundred and forty-nine of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Waitemata County Council stopping the portion of road described in the Schedule hereto.

SCHEDULE

APPROXIMATE area of the piece of road permitted to be stopped: 4 acres.

Adjoining or passing through Allotment 21 and part Allotment 20, Parish of Waikomiti.

Situated in Block VI, Titirangi Survey District (Auckland R.D.). (S.O. 35047.)
