Vesting the Control of a Reserve in the Oparure Public Hall Board

ORDER IN COUNCIL

At the Government House at Wellington, this 16th day of February, 1948

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the land described in the Schedule hereto was by Warrant dated the eleventh day of March, one thousand nine hundred and thirty-eight, and published in Gazette of the seventeenth day of that month, permanently reserved for a site for a public hall: And whereas it is expedient that the control of the said reserve should be vested in a special Board as hereinafter provided:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the reserve, described in the Schedule hereto, for the period of five years from the date hereof (unless previously amended or revoked under the said Act), in the undermentioned persons, namely,—

Harry Ezekiel Thorby,
Lars Klausen Lemberg,
James Maxwell Somerville,
Noel Keith Boddie, and
Margaret Dorothy Bonington Bruce,

who are hereby constituted for that purpose a special Board by the name of the Oparure Public Hall Board (hereinafter referred to as the Board), with the powers and subject to the conditions hereinafter contained, that is to say:—

  1. The first meeting of the Board shall be held on Tuesday, the first day of March, one thousand nine hundred and forty-nine, at eight o'clock p.m., at the Oparure Public Hall, and thereafter the Board shall meet for the transaction of business at the said hall on the first Tuesday in the months of December, March, June, and September, or at such other time or place as may from time to time be fixed by the Board.

  2. The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days' notice of any such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

  6. If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  7. All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

  8. The Board shall have prepared and submitted at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  9. The Board shall control the said reserve and the building erected thereon for the purposes of a public hall, and shall also afford settlers and residents of Oparure and the surrounding district such facilities for meeting within the said hall as may from time to time be determined by the Board; provided that the Board shall have power to fix reasonable charges for the use of the said hall.

AUCKLAND LAND DISTRICT

ALL that area containing by admeasurement 20 perches, more or less, being part Kinohaku East No. 1r No. 16 Block, and being all of the land on plan 26911, deposited in the office of the District Land Registrar at Auckland. As the same is more particularly delineated on the plan marked L. and S. 6/6/660a, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Vesting Land in the Selwyn Plantation Board

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers and authorities conferred upon him by subsection eight of section one hundred and seventy-one of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1924, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that, from and after the day of the date hereof, the land described in the Schedule hereto shall be vested in the Selwyn Plantation Board, in trust, for plantation purposes.

CANTERBURY LAND DISTRICT

ALL that area in the Selwyn County, containing by admeasurement 8 acres 2 roods 8 perches, more or less, being Reserve 4547 (formerly Lot 1 on Deposited Plan 13100, being part of Rural Section 33877), situated in Blocks X and XIV, Hororata Survey District. As the same is more particularly delineated on the plan marked L. and S. 49135q, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Revoking the Reservation for Recreation Purposes Over Reserves in the Borough of Papatoetoe, North Auckland Land District

At the Government House at Wellington, this 16th day of February, 1949

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS a notice of intention to issue an Order in Council declaring that the reservation for recreation purposes over the lands described in the Schedule hereto shall be revoked was published in the Gazette of the ninth day of December, one thousand nine hundred and forty-eight:

And whereas such notice of intention was duly laid before both Houses of Parliament in accordance with the provisions of subsection two of section seven of the Public Reserves, Domains, and National Parks Act, 1928:

And whereas the Legislative Council and the House of Representatives, by resolutions dated respectively the first and the second days of December, one thousand nine hundred and forty-eight, approved the proposed revocation as aforesaid:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for recreation purposes over the lands described in the Schedule hereto, and doth hereby declare that the said lands, being vested in the body corporate called the Mayor, Councillors, and Burgesses of the Borough of Papatoetoe, may be disposed of by the said body corporate by way of sale by public auction or private contract at such price and on such terms and conditions as the said body corporate shall determine, but so that the proceeds of any such sale shall be used and applied in or towards the purchase of other land for recreation purposes.

ALL those areas in the Borough of Papatoetoe situated in Block X, Otahuhu Survey District, containing by admeasurement a total of 2 acres and 37·6 perches, more or less, being Lot 53, as shown on the plan numbered 20068, deposited in the office of the District Land Registrar at Auckland, being part Allotment 36, Manurewa Parish; Lot 33, as shown on the plan numbered 20144 deposited as aforesaid, being part of Fairburn's Grant; Lot 5 as shown on the plan 20359 deposited as aforesaid, being part Allotment 44, Manurewa Parish, aforesaid; and Lot 6 as shown on the plan numbered 22677, deposited as aforesaid, being part Allotment 43, Manurewa Parish, aforesaid. As the same are more particularly delineated on the plans marked L. and S. 1/1112, 1/1112a, 1/1112b, 1/1112c, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
