Retailers’ Prices
- The maximum price that may be charged or received by any retailer for any oats to which this Order applies shall be the sum of the following amounts :—
(a) The cost of the oats to the retailer at the point at which he takes delivery but not more in any case than the cost that would have been incurred had the retailer purchased the oats in lots of half a ton or more :
(b) The amount of the transport charges incurred by the retailer in obtaining delivery of the oats into his store being not more in any case than the charges that would have been incurred had delivery been effected at common carrier rates :
(c) An amount computed at the rate per bushel as follows :—
(i) For oats sold in sack lots, 1s. per bushel ;
(ii) For oats sold in lots of half bushel but less than one sack, 1s. 9d. per bushel ;
(iii) For oats sold in lots of less than half bushel, 2s. 6d. per bushel.
DUTIES IMPOSED ON WHOLESALE DISTRIBUTORS AND MERCHANT DISTRIBUTORS
- (1) Every wholesale distributor who sells any oats to which this Order applies on the basis of sacks extra shall state separately on the appropriate invoice relating to such sale the price charged for the oats and the price charged for the sacks.
(2) Every merchant distributor who sells for purposes other than seed purposes any oats that have been machine dressed by him shall keep for a period of two years a detailed record of the charges incurred by him in machine dressing the oats and of the weight of oats lost in the process of machine dressing.
PROVISION FOR SPECIAL PRICES WHERE EXTRAORDINARY CHARGES INCURRED
- Notwithstanding anything in the foregoing provisions of this Order, and subject to such conditions, if any, as it thinks fit; the Tribunal, on application by any grower, wholesale distributor, merchant distributor, or retailer may authorize special maximum prices in respect of any white oats to which this Order applies where special circumstances exist or for any reason extraordinary charges (freight or otherwise) are incurred by the grower, wholesale distributor, merchant distributor, or retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of white oats or may relate generally to all white oats to which this Order applies sold by the grower, wholesale distributor, merchant distributor, or retailer while the approval remains in force.
