11. HEAT, COLD, AND CONFINED SPACES
.01 For the purposes of this clause “confined space” shall be deemed to mean a confined space which lacks adequate ventilation, or the dimensions of which necessitate working in a stooped or cramped position, or which is productive of unusual discomfort.
.02 A worker while required to work in a confined space shall be paid an allowance of 3d. an hour, provided that this allowance shall not be payable if the worker is entitled to any of the allowances prescribed in clause 9 hereof or subclauses .03, .04, or .05 below.
.03 A worker while required to work in a confined space where the temperature is below 40° F. shall be paid an allowance of 4d. an hour, and shall be allowed to leave the confined space at least once in every two hours for a period of ten minutes.
.04 A worker while required to work in a compartment or confined space where the temperature exceeds 110° F. shall be paid at ordinary time rate in addition to the rate appropriate to the time, and shall be allowed a five minute break in every hour.
.05 A worker while working in a confined space where welding or burning is being done shall be paid at half ordinary time rate in addition to the rate appropriate to the time.
.06 A worker while employed on hot-slab work, hot-plate flanging and dishing, and heavy angle-iron smithing shall be paid an allowance of 3d. an hour: Provided that this shall not apply to work done on anvils.
12. PROTECTIVE CLOTHING
.01 Gauntlet Gloves.—A worker while working at an oven or over a slab where the heat is excessive shall be supplied with gauntlet gloves.
.02 Goggles.—Workers are required to wear goggles while employed on chipping work where the job can easily be seen, and also while using grinding machines. Goggles shall be supplied by the Department.
.03 Gumboots.—A worker while working in water, oil, or mud, shall be supplied with gumboots. When gumboots are handed in by a worker who no longer requires them, the Department shall disinfect the boots before they are issued to another worker.
.04 Leather Jackets.—A welder while employed on overhead welding or burning shall be supplied with a leather jacket.
.05 Oilskins and Sou’westers.—An oilskin and sou’wester shall be supplied to a worker required to work in the rain on the following duties: A rigger berthing or docking a ship; a worker fuelling or defuelling a ship; a runabout driver. At the discretion of the officer in charge an oilskin and sou’wester may be supplied to a worker while employed on tail-end work in exceptionally wet weather where it is essential that the work should proceed.
.06 Rubber Aprons.—A worker while handling charged storage batteries shall be supplied with a rubber apron.
.07 Rubber Gloves.—A worker while working in an ablution chamber shall be supplied with rubber gloves.
.08 Oil and Tar Work.—A worker while cleaning oil tanks or tarring down rigging shall be supplied with adequate protective clothing.
13. PAYMENT OF WAGES
.01 Wages shall be paid weekly and within working hours.
.02 On dismissal a worker shall be paid all moneys due to him. When a worker leaves of his own accord, all moneys due to him shall be paid within two hours.
.03 All waiting time beyond the times prescribed in subclauses .01 and .02 above shall be paid for at ordinary time rate.
.04 A worker commencing work more than five minutes after the appropriate commencing time shall be deemed to have lost time as follows:—
If over five minutes but not more than fifteen minutes late, loses fifteen minutes’ time.
If over fifteen minutes but not more than thirty minutes late, loses thirty minutes’ time.
Further deductions on a similar basis at fifteen minute intervals, shall be made for later commencement of work.
.05 A worker ceasing work more than five minutes before the appropriate ceasing time shall be deemed to have lost time as follows:—
If over five minutes but not more than fifteen minutes early, loses fifteen minutes’ time.
If over fifteen minutes but not more than thirty minutes early, loses thirty minutes’ time.
Further deductions on a similar basis at fifteen minute intervals shall be made for earlier cessation of work.
