Declaring Additional Area to be Part of the North Canterbury Bobby Calf Marketing Pool Area

PURSUANT to the Bobby Calf Marketing Regulations 1947 the Minister of Marketing, being satisfied that a sufficient majority of producers in the area of land defined in the Schedule hereto are desirous that such area should be declared to be part of the North Canterbury Bobby Calf Marketing Pool Area defined by notice given under his hand on the 9th day of August, 1945, and published in the Gazette on the 17th day of August, 1945, at page 1035, doth hereby declare the additional area of land defined in the said Schedule to be part of the North Canterbury Bobby Calf Marketing Pool area accordingly, and doth further declare that this notice shall take effect on the 13th day of October, 1949.

SCHEDULE

NORTH CANTERBURY BOBBY CALF MARKETING POOL AREA.—ADDITIONAL AREA

ALL that area lying within the Kowhai County and bounded by a line commencing on the sea-coast at the mouth of the Ashley River; thence in a northerly direction along the sea-coast to the northern boundary of Block XVII, Teviotdale Survey District; thence in a westerly direction along the northern boundaries of Blocks XVII, Teviotdale Survey District, and IV, Rangiora Survey District, to the Main Trunk Railway; thence following the said railway in a southerly direction to the point where it crosses Mt. Grey Road; thence in a straight line across country in a south-westerly direction to Trig. A. 1, located on the northern boundary of Block VI, Rangiora Survey District; thence in a straight line across country in a southerly direction to the point where the Cones Road Traffic-bridge spans the Ashley River; thence following the northern bank of the said river down-stream to the sea-coast, being the original point of commencement.

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice Declaring Lands Taken for the Settlement of Discharged Servicemen

WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Lands Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 28 on the 12th day of May, 1949, at page 1013:

And whereas an objection was made by the owners of the said lands in the manner prescribed by the said Act, objecting to the taking of the said lands:

And whereas the Minister of Lands did not revoke his notice of intention to take the said lands:

And whereas the owners withdrew such objection:

And whereas the Land Valuation Committee did on the 11th day of August, 1949, make an order determining that the said lands are farm lands suitable or adaptable for the settlement of two or more discharged servicemen:

And whereas no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court:

And whereas the said lands are not the lands of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 28th day of February, 1950, as the date on which the said lands shall be deemed to be vested in His Majesty the King.


SCHEDULE

GISBORNE LAND DISTRICT

ALL that area situated in Blocks XI, XII, XV, and XVI, Waimata Survey District, containing by admeasurement one thousand two hundred and thirty-five (1,235) acres two (2) roods, more or less, being portion of Lot 1 on Deposited Plan 677, being part of Waimata South Block, and being the whole of the land described in certificate of title, Vol. 85, folio 5 (Gisborne Registry).

Also, all that area situated in Block XII, Waimata Survey District, containing by admeasurement one thousand and eighty (1,080) acres, more or less, being Lot 3 on Deposited Plan 1772, being part of Waimata South Block, and being the whole of the land described in certificate of title, Vol. 85, folio 6 (Gisborne Registry).

Also all that area situated in Block XIV, Waimata Survey District, containing by admeasurement two hundred and seventy-five (275) acres two (2) roods one (1) perch, more or less, being Lots 44, 45, 46, and 47 on Deposited Plan 1309, being part of Whataupoko No. 1 Block, and Lot 2 on Deposited Plan 2277, being part of Whataupoko No. 8 Block, and being the whole of the land described in certificate of title, Vol. 85, folio 7 (Gisborne Registry).

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice Declaring Land and an Interest in Land Taken for the Settlement of a Discharged Servicemen

WHEREAS an application has been made for the consent of the Land Valuation Court to a transaction which relates to the lands described in the First and Second Schedules hereto, and to which Part III of the Servicemen’s Settlement and Land Sales Act, 1943, as extended by the provisions of section 4 of the Servicemen’s Settlement and Land Sales Amendment Act, 1948, applies:

And whereas the Land Valuation Committee to which the said application has been referred is of opinion that the lands to which the said application relates are farm lands suitable or adaptable for the settlement of a discharged serviceman:

And whereas the said Committee, not being satisfied that the Crown had decided not to acquire or arrange for the acquisition of the land described in the said First Schedule and the interest of the lessee or licensee in the land described in the said Second Schedule, and being satisfied that the proposed transferee or assignee under the said transaction is not a child of the transferor who intends to reside personally on the land and to farm the same exclusively for his own use and benefit, did, on the 31st day of August, 1949, make an order determining the basic value of the land described in the said First Schedule and determining the value of the interest of the lessee or licensee in the land described in the said Second Schedule and no appeal from the said order was made within the time prescribed by the said Act, or within any further time allowed by the Court:

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 51 of the said Act, doth hereby declare that the land described in the said First Schedule and the interest of the lessee or licensee in the land described in the said Second Schedule are hereby taken for the settlement of a discharged serviceman, and hereby specifies the 18th day of October, 1949, as the date on which the land described in the First Schedule and the interest of the lessee or licensee in the land described in the said Second Schedule shall be deemed to be vested in His Majesty the King.


FIRST SCHEDULE

WESTLAND LAND DISTRICT

ALL that area situated in Block I, Whitcombe Survey District, containing by admeasurement four hundred and eighteen (418) acres, more or less, being Section 933, and being the whole of the land described in certificate of title, Vol. 43, folio 66 (Westland Registry).


SECOND SCHEDULE

WESTLAND LAND DISTRICT

ALL that area situated in Block I, Whitcombe Survey District, containing by admeasurement ninety-seven (97) acres, more or less, being Lot 1 on Deposited Plan 469, and being the whole of the land described in lease in perpetuity No. 647, registered Vol. 24, folio 217 (Westland Registry).
