Authorizing the North Canterbury Electric-power Board to Erect and Use Electric Lines in the Cheviot County and Parts of the Amuri County

At the Government House at Wellington, this 28th day of September, 1949
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act, 1928, and the Electric-power Boards Act, 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby authorize the North Canterbury Electric-power Board (hereinafter with its successors and assigns referred to as the licensee), subject to the conditions set forth in the First Schedule hereto, to lay, construct, put up, place, and use the electric lines described in the Second Schedule hereto; and, further, for the purposes of section seventy-six of the Electric-power Boards Act, 1925, subject to the said conditions, doth hereby authorize the licensee to construct and maintain the said electric works.

FIRST SCHEDULE

  1. IMPLIED CONDITIONS
    THE conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1935, shall be incorporated herein and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
  2. LICENCE SUBJECT TO REGULATIONS
    The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with any regulations made or to be made in amendment or amplification thereof or in substitution therefor.
  3. SYSTEM OF SUPPLY
    Bulk supply at a nominal pressure of 11,000 volts between phases shall be received from the State Hydro-electric Department's substations near Waipara and Culverden, or from such other additional point or points of supply as may be mutually arranged between the Minister in Charge of the State Hydro-electric Department and the licensee.
    The system of supply shall be as described in paragraphs (a) and (f) of clause 21-01 of the Electrical Supply Regulations 1935.
    The primary distribution voltage shall be 11,000 volts between phases.
  4. DURATION OF LICENCE
    This licence shall, unless sooner lawfully determined, continue in force until the 22nd day of May, 1970.

SECOND SCHEDULE
LINES adapted for the supply of electrical energy by the system of supply hereinbefore described within:-
(a) The County of Cheviot as at present constituted, the electric lines at present proposed to be erected and used being shown by means of red lines on the plan marked S.H.D. 91, deposited in the office of the Minister in Charge of the State Hydro-electric Department.
(b) Those parts of the County of Amuri described in the Proclamations dated the 25th day of December, 1937, and published in the Gazette on the 13th day of January, 1938, at page 8, and dated the 11th day of February, 1938, and published in the Gazette on the 17th day of the same month at page 272, the electric lines at present proposed to be erected and used being shown by means of red lines on the plan marked S.H.D. 92, deposited in the office of the Minister in Charge of the State Hydro-electric Department.

Authorizing the Auckland Electric-power Board to Lay, Erect, and Use Electric Lines in the Hauraki Gulf and Electric Lines and Works on Pakihi Island

His Excellency THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act, 1928, and the Auckland Electric-power Board Act, 1921-22, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth, subject to the conditions set forth in the First Schedule hereto, hereby authorize the Auckland Electric-power Board (hereinafter with its successors and assigns referred to as the licensee), to lay, construct, put up, place, and use the electric lines described in the Second Schedule hereto; and, further, for the purposes of section fifty-one of the Auckland Electric-power Board Act, 1921-22, subject to the said conditions, doth hereby authorize the licensee to construct the said electric works.

  3. SYSTEM OF SUPPLY
    The system of supply shall be as described in paragraphs (a) and (f) of clause 21-01 of the Electrical Supply Regulations 1935.
    The primary distribution voltage shall be 11,000 volts.
  4. DURATION OF LICENCE
    Unless sooner determined, this licence shall continue in force until the 14th day of July, 1966.
  5. CHARGES ON SALE
    The licensee shall not, in respect of electricity supplied by means of the electric lines described in the Second Schedule hereto, make any charge in excess of the corresponding charge which it is from time to time authorized to make within the Auckland Electric-power District as at present constituted: Provided that the licensee may, subject to the consent of the Price Tribunal, make an additional charge not exceeding ten per centum:
  6. TIME FOR COMPLETION OF WORKS
    The period for the substantial completion of the works hereby authorized shall be three years from the date hereof.
  7. SEPARATION FROM PRIVATE TELEPHONE CABLE
    Seaward from high-water mark at ordinary spring tide, the minimum horizontal distance separating the submarine cable described in the Second Schedule hereto from the existing private submarine telephone cable of Messrs McCallum Brothers shall be 200 ft.

SECOND SCHEDULE

  1. SUBMARINE cable adapted for the supply of electrical energy by the system of supply hereinbefore described, leading from the shores of the Hauraki Gulf at a point being the northernmost extremity of part Waitawa Block, Block V, Wairoa Survey District, in the Land District of North Auckland, and proceeding thence in a right line across part of the said gulf to a point in Block XV, Wairoa Survey District, being the southernmost extremity of Pakihi Island, the said cable being more particularly delineated by means of a broken red line on the plan marked S.H.D. 55, deposited in the office of the Minister in Charge of the State Hydro-electric Department.
  2. Lines adapted for the supply of electrical energy by the system of supply hereinbefore described, on and about Pakihi Island, situated in Blocks XV and XVI, Wairoa Survey District, in the Hauraki Gulf.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby consent to the assignment to Thomas Lee Stewart Dredge, of Murchison, Farmer, by Nelson Wakefield Gibbs, of Murchison, Farmer, of his rights, powers, and privileges under an Order in Council, dated the twenty-eighth day of October, one thousand nine hundred and thirty-six, and published in the Gazette on the twenty-ninth day of the same month, at page 1941, authorizing him to use water for the purpose of generating electricity.
