Foreshore Licence—Wharves in Lake Wanaka—Vesting in Lake County Council

ORDER IN COUNCIL
At the Government House at Wellington, this 13th day of July, 1949
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vest in the Lake County Council (hereinafter called the Council, which term shall include its successors or assigns, unless the context requires a different construction), the management of the wharves at Minarets and Wanaka in Lake Wanaka, as shown on approved plans marked M.D. 8904 and 8155, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon the said wharves as shown on the said plan, such vesting to be held and enjoyed by the said Council upon and subject to the terms and conditions set forth in the First Schedule hereto, and doth hereby prescribe that the dues and rates set forth in the Second Schedule hereto shall be charged and taken by the Council for the use of the said wharves.
FIRST SCHEDULE
CONDITIONS

THIS licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

The annual sum payable by the Council to the Minister shall be one shilling (1s.), payable on demand.

The term of the licence shall be fourteen (14) years from the 1st day of July, 1949.
SECOND SCHEDULE
DUES AND RATES
EVERY master or owner of a vessel using the said wharves shall pay to the Council annually for the use of the said wharves the sum of five pounds (£5) per annum.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by an Order in Council dated the third day of April, one thousand nine hundred and forty-six, and published in the Gazette of the eleventh day of that month, the control of the land described in the Schedule to that document, being a reserve for a site for a library, was vested in certain persons therein named, who were by the said Order in Council constituted a special Board, by the name of the Waiheke West Public Hall and Library Board, in pursuance of section seventeen of the Public Reserves, Domains, and National Parks Act, 1928 :
And whereas it is desirable that Robert Burgess, George Dyson, and Edward William Welson, all of Waiheke, should be appointed members of the said Board in place of George Angus Wynne, Ronald Harry Logan, and James Thornton Smith, who have resigned :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers conferred on him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby appoint the said
Robert Burgess,
George Dyson, and
Edward William Welson
to be members of the Waiheke West Public Hall and Library Board constituted by the Order in Council dated the third day of April, one thousand nine hundred and forty-six, hereinbefore referred to, in place of the said George Angus Wynne, Ronald Harry Logan, and James Thornton Smith who have resigned.

Authorizing the Exchange of a Reserve in Block III, Otahuhu Survey District, North Auckland Land District, for other Land

ORDER IN COUNCIL
At the Government House at Wellington, this 20th day of July, 1949

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the land described in the First Schedule hereto is a reserve duly set apart for plantation purposes: And whereas it is expedient that the said land should be exchanged for the land described in the Second Schedule hereto, which the Governor-General deems of equal value and more suitable for the purposes of the reserve :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section eight of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the land described in the First Schedule hereto may be exchanged for the land described in the Second Schedule hereto.
FIRST SCHEDULE
DESCRIPTION OF RESERVE AUTHORIZED TO BE EXCHANGED
North Auckland Land District
ALL that area in the Manukau County situated in Block III, Otahuhu Survey District, containing by admeasurement 22·4 perches, more or less, being Lot 1 as shown on the plan numbered 22538, deposited in the Office of the District Land Registrar at Auckland, being part of Allotment 28 of Section 10, Small Lots near Howick. As the same is more particularly delineated on the plan marked L. and S. 6/1/450B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
SECOND SCHEDULE
DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR
North Auckland Land District
ALL that area in the Manukau County situated in Block III, Otahuhu Survey District, containing by admeasurement 21 perches, more or less, being Lot 1 as shown on the plan numbered 36259, deposited in the Office of the District Land Registrar at Auckland, being part of Allotment 27 of Section 10, Small Lots near Howick. As the same is more particularly delineated on the plan marked L. and S. 6/1/450B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged green.

Vesting a Reserve in the Petone Borough Council

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the land described in the Schedule hereto has been duly set apart for municipal purposes: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Mayor, Councillors, and Burgesses of the Borough of Petone :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Mayor, Councillors, and Burgesses of the Borough of Petone, in trust, for municipal purposes.
