The Balclutha Milk Delivery Notice 1945, Amendment No. 1
PURSUANT to the Milk Delivery Emergency Regulations 1945* the Minister of Marketing doth hereby give notice as follows :—

This notice may be cited as the Balclutha Milk Delivery Notice 1945, Amendment No. 1, and shall be read together with and deemed part of the Balclutha Milk Delivery Notice 1945† (hereinafter referred to as the principal notice).

Clause (2) of the principal notice is hereby amended by revoking the words “Lewis Eason Aitken, Balclutha,” and substituting the words “Balclutha Borough Council.”

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice Declaring Lands Taken for the Settlement of Discharged Servicemen
WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the First and Second Schedules hereto, and copies of the notices were published in the New Zealand Gazette No. 37 on the 24th day of June, 1948, at page 792 :
And whereas objections were made by the owners and occupiers of the said lands in the manner prescribed by the said Act, objecting to the taking of the said lands :
And whereas the owners did claim the right to retain parts of the said lands :
And whereas the Minister of Lands did not revoke his notices of intention to take the said lands and did agree to the retention by the owners of the areas claimed in the said objections :
And whereas the owners and occupiers did withdraw their objections to the taking of the lands described in the Third Schedule hereto.
And whereas the Land Sales Committee did on the 3rd December, 1948, make an order determining that the lands described in the said Third Schedule are farm lands suitable for the settlement of a discharged serviceman or of two or more discharged servicemen.
And whereas no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court :
And whereas the lands described in the said Third Schedule are not the lands of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :
Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Third Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 13th day of June, 1949, as the date on which the said lands shall be deemed to be vested in His Majesty the King.
FIRST SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
ALL that parcel of land situated in Block XII, Hapuakohe Survey District, containing by admeasurement two hundred and six (206) acres one (1) rood seven (7) perches, more or less, being Hoe-o-Tainui North 6B 2A Block, and being all of the land described in certificate of title, Vol. 229, folio 260 (Auckland Registry).
Also all that parcel of land situated in Block XII, Hapuakohe Survey District, containing by admeasurement forty-seven (47) acres two (2) roods thirty-four (34) perches, more or less, being part of Hoe-o-Tainui North 4A 2B Block, and being the balance of the land described in certificate of title, Vol. 284, folio 277 (Auckland Registry).
Also all that parcel of land situated in Block XII, Hapuakohe Survey District, containing by admeasurement thirty-two (32) acres three (3) roods three (3) perches, more or less, being part of Hoe-o-Tainui North 4B 2 Block, and being the balance of the land described in certificate of title, Vol. 235, folio 30 (Auckland Registry).
Also all that parcel of land containing by admeasurement twenty-nine (29) acres, more or less, being Section 2, Block XII, Hapuakohe Survey District, and being all of the land described in certificate of title, Vol. 242, folio 168 (Auckland Registry).
SECOND SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
ALL that parcel of land situated in Block XII, Hapuakohe Survey District, containing by admeasurement two (2) roods eighteen (18) perches, more or less, being part of Lot 1 on Deposited Plan 9653, being part of Hoe-o-Tainui North 6B 2B Block, and being all of the land described in certificate of title, Vol. 673, folio 88 (Auckland Registry).
THIRD SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
ALL that parcel of land situated in Block XII, Hapuakohe Survey District, containing by admeasurement thirty-one (31) perches, more or less, being part of Lot 1, Deposited Plan 9653, being part Hoe-o-Tainui North 6B 2B Block, and being part of the land described in certificate of title, Vol. 673, folio 88 (Auckland Registry).
