to a point in line with the eastern boundary of Section 30, Block IV,
Taylor Pass Survey District; thence southerly across that road
and by the eastern boundary of Section 30, Wither Settlement,
to the northern boundary of Section 8, Wither Settlement; thence
easterly along the northern boundary of Section 8, Wither Settlement,
to the public road known as Redwood Street, and across that road;
thence northerly along the eastern side of Redwood Street to the
Wither Road; thence easterly along the south side of Wither
Road to a point in line with the western boundary of the northern
portion of Section 9, Wither Settlement; thence northerly across
Wither Road and along the western boundary of Section 9 aforesaid
to Hospital Road; thence easterly along the southern side of Hospital
Road to the western boundary of Section 42, Opawa, Block IV
aforesaid, and by a right line to a point on a public road approximately 6 chains north of the south-east corner of Section 34, Opawa,
in Block IV aforesaid, and again by a right line to the intersection
of the south Island Main Trunk Railway-line with the boundary
of Section 2 of Block II, Omaka, in Block IV aforesaid, and along
the said railway-line to the Pictou-Bluff State Highway; thence
generally in a westerly direction by the State highway to the south-
western corner of Section 33, Opawa, in Block XVII, Cloudy Bay
Survey District; thence in a northerly direction by the western
boundary of the said Section 33 aforesaid to the southern bank of the
Opawa River; thence generally in an easterly direction by the
southern banks of the Opawa and Wairau Rivers to the north-
eastern corner of part Section 8, Opawa, Block I, Clifford Bay
Survey District; thence southerly by the eastern boundaries of
Sections 8, 7, and 9, Opawa, Block I aforesaid, to Morgan's Creek;
thence westerly by that creek to Section 22, Opawa, Block I afore-
said; thence southerly by the eastern boundaries of Sections 22
and 21, Opawa, Block I aforesaid, and Section 20, Opawa, Block II,
Clifford Bay Survey District, to Section 18, Opawa, Block II afore-
said; thence generally in an easterly direction by the northern
boundary of Section 18 aforesaid to Chandler's Lagoon, and by the
shores of that lagoon and the northern boundaries of Sections 13,
Opawa, Block II aforesaid, 7 of Block I, Wakefield Downs, 9 of
Block II, Omaka, 8 of Block I, Wakefield Downs, and 10 of Block II,
Omaka, all in Block III, Clifford Bay Survey District, to the sea;
thence in a southerly direction along the sea-coast to the Awatere
River, and in a south-westerly direction along the northern bank
of the Awatere River to the point of commencement.

Constitution of Rural Fire District

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 30th day of
March, 1949

Present:

THE RIGHT Hon. P. FRASER PRESIDING IN COUNCIL

PURSUANT to the Forest and Rural Fires Act, 1947, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, doth hereby constitute
and declare the areas described in the Schedule hereto to be a rural
fire district, to be known as the "Tuwharetoa Rural Fire District";
and doth hereby specify the trees and other plants situated on the
lands in the said areas as the property for the protection of which
the district is constituted; and doth hereby further specify the
period between the first day of October in any one year and the
thirtieth day of April in the following year (both days inclusive) as a
closed fire season in the said district; and doth hereby further
declare that this Order in Council shall come into force, and that
the Tuwharetoa Rural Fire District shall become a rural fire district,
on the day following publication of this Order in Council in the
Gazette; and doth hereby prescribe that the said district shall be
administered for the purposes of the said Act by a rural fire com-
mittee which shall be known as the Tuwharetoa Rural Fire Com-
mittee, and with respect to the said Rural Fire Committee doth
hereby make the following regulations.

REGULATIONS

  1. In these regulations, unless the context otherwise requires,--

"Act" means the Forest and Rural Fires Act, 1947:
"Committee" means the Tuwharetoa Rural Fire Committee
constituted by these regulations:
"District" means the Tuwharetoa Rural Fire District:
"Minister" means the Commissioner of State Forests.

  1. The Rural Fire Committee Regulations 1949, shall, so far
    as they are applicable, and with the necessary modifications, apply
    to the Tuwharetoa Rural Fire Committee constituted by these
    regulations, and these regulations shall be deemed to be special
    regulations for the purposes of those regulations.

MEMBERS

  1. The Committee shall consist of nine members, who shall be
    appointed in the following manner :--
    (a) Three members (herein referred to as the Government
    representatives), who may be the holders of specified
    offices in the Public Service, shall be appointed by the
    Minister as representatives of the New Zealand Govern-
    ment. One of the Government representatives shall be
    an officer of the State Forest Service; one shall be an
    officer of the Department of Maori Affairs; and one
    shall be an officer of the Department of Lands and Survey.
    They shall represent the forest, land development, and
    other interests of the Crown in the said district, and for
    the purposes of the said Act the Government repre-
    sentatives shall be deemed to represent the Crown as
    owner of land on which is situated property for the
    protection of which the Tuwharetoa Rural Fire District
    is constituted :
    (b) Four members (herein referred to as the Maori representa-
    tives) shall be appointed by a resolution at a meeting
    of Maori forest owners, which shall be summoned and
    shall follow the procedure prescribed for a meeting of
    assembled owners in Part XVIII of the Maori Land Act,
    1931 :
    (c) One member (herein referred to as the sawmillers' repre-
    sentative) shall be appointed either by a resolution
    passed by a majority of those present at a meeting of
    sawmill or logging proprietors affected by the constitution
    of the Tuwharetoa Rural Fire District, or by a majority
    vote by ballot of those present at such a meeting, as
    those so present by resolution determine:
    (d) One member (herein referred to as the occupiers' repre-
    sentative) who shall be appointed either by a resolution
    passed by a majority of those present at a meeting of the
    owners or occupiers of land affected by the constitution
    of the Tuwharetoa Rural Fire District, or by a majority
    vote by ballot of those present at such a meeting as those
    so present by resolution determine.

  2. The Registrar of the Aotea District Maori Land Board shall
    be the Returning Officer for the first appointments of the Maori
    representatives, the occupiers' representative, and the sawmillers'
    representative, and shall convene such meetings and conduct such
    ballots as may be required for the first appointments, and shall
    also convene the first meeting of the Committee. Thereafter the
    Secretary of the Committee shall be the returning officer.

SCHEDULE

AUCKLAND AND WELLINGTON LAND DISTRICTS.--AUCKLAND,
ROTORUA, AND WELLINGTON CONSERVANCIES

Tuwharetoa Rural Fire District

ALL those areas in the Auckland and Wellington Land Districts,
Taumarunui and Taupo Counties, containing approximately 235,000
acres, and described as follows :--

All that area containing approximately 178,000 acres, situated
in Puketapu, Karangahape, Pukawa, Maungaku, Puketi, Pihanga,
Waimanu, and Tongariro Survey Districts, and bounded generally as
follows: Towards the north by a permanent State forest (Gazette, 1935,
page 581), part of Waihaha No. 3 Block, and the Oruapuraho River;
towards the east by Lake Taupo and the Tokaanu River to a point
due west of Trig. Station E (Manganamu); towards the north by a
right line bearing due east to the eastern side of the Tongariro
Bridge - Waihi Pa Main Highway; towards the north-east by the
north-eastern side of the said highway to the National Park - Taupo
Main Highway, and by the crossing of the latter highway; towards
the east by the eastern side of the last-mentioned highway
and the Poutu Stream; towards the south by the Poutu Stream
and the southern shore of Lake Roto Aira; towards the east by
the Te One Stream; towards the south-west by the south-western
side of the National Park - Taupo Main Highway and the Roto
Aira Road; towards the south-east by the south-eastern side of the
said road; towards the south-west by the Otamangakau Stream;
towards the south by the said stream and the Wanganui River;
towards the west by the Wanganui River, the Waipari Stream, and
a right line bearing due north to the south-eastern corner of Hau-
hungaroa No. 11 Block (permanent State forest--Gazette, 1943,
page 319); towards the south by Hauhungaroa No. 1c Block;
and towards the west by Hauhungaroa No. 8 Block; and all that
area containing approximately 57,000 acres, situated in Blocks XIII
and XIV, Tauhara Survey District, Blocks II, IV, V, and IX,
Tokaanu Survey District, Blocks I, II, III, V, VI, VII, VIII, IX,
X, XI, XII, XIII, and XIV, Waitahanui Survey District, and
Block V, Maruanui Survey District, and bounded generally as
follows: Towards the north-east by Tauhara South A Block;
towards the south-east generally by Wharetoto Nos. 8 and B Blocks,
Patehe Block, Kaimanawa Nos. 1c and 1E 2A Blocks, Section 1,
Block XII, Waitahanui Survey District, Kaimanawa No. 1E 2C
Block, Section 1, Block XI, Waitahanui Survey District, and Kai-
manawa Nos. 1E 2E, 1E 2F, 1F 1 Blocks, and Tauranga Taupo 3B
1A Block; towards the north-east by Tauranga Taupo Nos. 3A
and 2A Blocks; towards the north-west by Tauranga Taupo No.
2A Block; towards the north-east by part of Tauranga Taupo
No. 2B 1 Block and the Waitekoko Stream; towards the north-
west by Lake Taupo; and towards the north by the Hinemaiai
Stream and the northern side of the National Park - Taupo State
Highway. As the same are more particularly delineated on plans
Nos. 53/3 and 54/14, deposited in the Head Office of the State Forest
Service at Wellington, and thereon bordered red.
