THE NEW ZEALAND GAZETTE
2. This Order shall come into force on the day following the
day of publication thereof in the Gazette.
3. Clause two of the principal Order is hereby amended by
omitting the words "parts of Clutha and Bruce Counties", and
substituting the words "part of the County of Bruce".
4. The principal Order is hereby further amended by revoking
clauses four and five, and substituting the following clauses:-
"4. The Bruce County Council shall be entitled to have one
representative on the Milk Committee of the Balclutha Borough
Council, and from time to time shall be entitled to nominate a person
for that purpose.
5. The Balclutha Borough Council shall from time to time
appoint to the Milk Committee of the Borough Council the person
nominated by the Bruce County Council pursuant to clause four
hereof."
5. The principal Order is hereby amended by revoking the
Schedule thereto, and substituting the following Schedule :-
"SCHEDULE
"BALCLUTHA MILK DISTRICT
"ALL that area being the Borough of Balclutha and part of
the County of Bruce, and being parts of Clutha, North Molyneux,
and Hillend Survey Districts, bounded as follows : Commencing
at the southernmost corner of Section 18, Block XVII, Town of
Balclutha; thence north-easterly and south-easterly by a public
road to its junction with the Main South Road; thence north-
easterly and easterly along that road and Benhar Road to the
south-eastern corner of Section 8, Block I, Hillend Survey District;
thence north-easterly along the south-eastern boundary of the said
Section 8 for a distance of 2500 links ; thence south-easterly by a
straight line at a right angle to the said south-eastern boundary to
the Railway Reserve; thence south-westerly along that reserve to
the north-eastern boundary of Block XII, North Molyneux Survey
District; thence south-easterly along that boundary to the northern
corner of Section 5, Block XII; thence south-westerly along the
north-western boundary of the said Section 5 and its production to
the Matau Branch of the Clutha River; thence generally northerly
along the northern bank of the Matau Branch to a point in line with
the northern boundary of Section 7, Block XIII, North Molyneux
Survey District; thence north-westerly along that boundary and
its production to the bank of the aforesaid Matau Branch; thence
north-westerly along the north-eastern bank of that river to the
boundary of the Borough of Balclutha ; thence generally westerly,
northerly, and easterly by the southern, western, and northern
boundaries of the Borough of Balclutha, as defined by New Zealand
Gazette of 5th August, 1948, page 984, to and across Cormack Street
to the point of commencement. As the same is delineated on the
plan marked M.D. 52, deposited in the office of the Marketing
Department at Wellington, and thereon edged red."

    ORDER IN COUNCIL
    At the Government Buildings at Wellington, this 30th day of
    March, 1949
    Present :
    THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
    IN pursuance and exercise of the powers conferred on him by
    the Milk Act, 1944, His Excellency the Governor-General,
    acting by and with the advice and consent of the Executive
    Council, doth hereby order and declare as follows :-
  1. This Order may be cited as the Mosgiel Milk District
    Constitution Order 1949.
  2. Those parts of New Zealand consisting of the Borough of
    Mosgiel and part of Taieri County, described in the Schedule
    hereto, are hereby constituted and declared a milk district under
    the Milk Act, 1944, as from the eighteenth day of April,
    one thousand nine hundred and forty-nine, with the name of the
    "Mosgiel Milk District".
  3. The Milk Authority of the said district shall be the Mosgiel
    Borough Council.
  4. The Taieri County Council shall be entitled to have one
    representative on the Milk Committee of the Mosgiel Borough
    Council, and from time to time shall be entitled to nominate a
    person for that purpose.
  5. The Mosgiel Borough Council shall from time to time appoint
    to the Milk Committee of the Borough Council the person nominated
    by the Taieri County Council pursuant to clause four hereof.
    SCHEDULE
    MOSGIEL MILK DISTRICT
    ALL that area comprising the Borough of Mosgiel and part of the
    Taieri County, bounded as follows : Commencing at the north-
    western corner of Section 7, Block VIII, East Taieri SurveyDistrict ;
    thence north-easterly along Dukes Road to the north-easterly
    boundary of Section 3, Block X; thence north-westerly along that
    boundary to the south-eastern boundary of Section 3s, Crosshill
    Settlement; thence north-easterly along the south-eastern bound-
    aries of Section 3s, Part 2 of 5s, and Section 7s, Crosshill Settlement,
    to and across Wingatui Road; thence generally easterly along the
    south-western boundary of Section 6s, Crosshill Settlement, the
    north-western and north-eastern boundaries of Sections 13 and
    14, Block IX, to Dukes Road; thence north-easterly along Dukes
    Road to the north-eastern boundary of Block V; thence south-
    easterly along the north-eastern boundary of Block V; thence
    north-easterly along the north-western boundaries of Sections 45
    and 46, Irregular Block; thence southerly along the eastern
    boundary of Irregular Block to the eastern corner of Section 42,
    Irregular Block; thence south-westerly, south-easterly, and south-
    westerly along the south-eastern, north-eastern, and south-eastern
    boundaries, respectively, of Irregular Block to the southernmost
    corner of Section 28, Irregular Block, East Taieri Survey District;
    thence south-easterly by a straight line to the north-eastern corner
    of Section 39, Block VII, Dunedin and East Taieri Survey District;
    thence south-westerly by a straight line to the southernmost corner
    of Section 32, Block VIII, Dunedin and East Taieri Survey
    District; thence north-westerly by a straight line to the north-
    western corner of Section 8, Block VIII, Dunedin and East Taieri
    Survey District; thence northerly by a straight line to the north-
    western corner of Section 7, Block VIII, East Taieri Survey
    District, the point of commencement. As the same is delineated
    on the plan marked M.D. 51, deposited in the office of the
    Marketing Department at Wellington, and thereon edged green.

    Validating Elections of Members to Represent the North-west Ward
    and the Greymouth Urban Area on the Canterbury Education Board

    ORDER IN COUNCIL
    At the Government Buildings at Wellington, this 30th day of
    March, 1949
    Present :
    THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
    WHEREAS the population of Greymouth according to the one
    thousand nine hundred and forty-five census exceeded eight
    thousand, and Greymouth thereupon became an urban area in the
    Canterbury Education District pursuant to section two of the
    Education Act, 1914 (hereinafter referred to as the said Act): And
    whereas the Greymouth Urban Area is entitled to be represented by two
    members on the Canterbury Education Board, but no election was held
    for the Greymouth Urban Area at either of the biennial elections in
    July, one thousand nine hundred and forty-six and one thousand
    nine hundred and forty-eight: And whereas Greymouth has hitherto
    been in the North-west Ward of the said district: And whereas at
    the election in July, one thousand nine hundred and forty-six,
    Frederick Lovell Turley was nominated pursuant to clause five,
    subclause three, of the Second Schedule to the said Act by two
    electors of the North-west Ward other than Greymouth and declared
    elected unopposed: And whereas pursuant to Regulation 3 of the
    Regulations for the Election of Members of Education Boards,*
    made under the said Act by Order in Council of the seventh day of
    May, one thousand nine hundred and eighteen, the said Frederick
    Lovell Turley recently elected to continue to represent the North-
    west Ward: And whereas at the election in July, one thousand
    nine hundred and forty-eight, James Frederick McDougall was
    nominated by one elector of the North-west Ward other than Grey-
    mouth and one elector of Greymouth and declared elected un-
    opposed: And whereas the said James Frederick McDougall
    recently elected to continue to represent the North-west Ward:
    And whereas Claude Eric James and Ronald William Sansom were
    recently nominated to represent the Greymouth Urban Area on the
    Canterbury Education Board, and as the number of nominations did
    not exceed the number of vacancies the said Claude Eric James and
    Ronald William Sansom were declared elected as notified by the
    Returning Officer in the Gazette of the thirteenth day of January, one
    thousand nine hundred and forty-nine, at page 31: And whereas,
    notwithstanding the irregularities, it is expedient to validate the
    elections of and by the said Frederick Lovell Turley and the said
    James Frederick McDougall and the election of the said Claude
    Eric James and the said Ronald William Sansom:
    Now, therefore, His Excellency the Governor-General of the
    Dominion of New Zealand, in pursuance of clause eighteen of the
    Second Schedule to the said Act and of section seventy-one of the
    Local Elections and Polls Act, 1925, acting by and with the advice
    and consent of the Executive Council, doth hereby order and
    declare:-
  6. That the election in one thousand nine hundred and forty-six
    of the said Frederick Lovell Turley and the election in one thousand
    nine hundred and forty-eight of the said James Frederick McDougall
    to represent the North-west Ward on the Canterbury Education
    Board shall be valid to all intents and purposes as though con-
    current elections had been held for the Greymouth Urban Area on
    both occasions and as though the said James Frederick McDougall
    had been duly nominated by two electors of the North-west Ward
    other than Greymouth, and that the proceedings in connection with
    such elections shall not be called in question by reason only of such
    irregularities.
  7. That the recited elections by the said Frederick Lovell
    Turley and the said James Frederick McDougall to continue to
    represent the North-west Ward on the said Board shall be valid
    to all intents and purposes and shall not be called in question by
    reason only of such irregularities or of the time at which such
    elections were made.
