Varying the Determinations in Respect of the Southland Hospital Board's Loan of £15,000 by Extending the Term Within Which the Said Loan may be Raised

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
WHEREAS by Order in Council made on the nineteenth day of March, one thousand nine hundred and forty-seven (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising, in New Zealand, by the Southland Hospital Board (hereinafter called the said local authority) of a loan of fifteen thousand pounds (£15,000), to be known as “Southland Hospital Boiler Installation Loan, 1946” (hereinafter called the said loan):
And whereas the said loan has not yet been raised, and it is expedient to extend the term as specified in clause seven of the said Order in Council within which the said loan or any portion thereof may be raised:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that no moneys shall be borrowed under the consent given by the said Order in Council after the expiration of four (4) years from the date thereof.

WHEREAS by Order in Council made on the twenty-third day of February, one thousand nine hundred and forty-nine, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Kaponga Town Board (hereinafter called the said local authority), of a loan of two thousand seven hundred pounds (£2,700), to be known as “Housing Loan, 1948” (hereinafter called the said loan):
And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that in lieu of a term (30) years, as specified in clause one of the said Order in Council, the term for which the said loan or any part thereof may be raised shall not exceed twenty-five (25) years.

Constituting the Pukaki Rabbit District.—(Notice No. Ag. 4635)

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to the Rabbit Nuisance Act, 1928, and to section twenty-nine of the Rabbit Nuisance Amendment Act, 1947, His Excellency the Governor-General, at the request of the Minister of Agriculture, made on the recommendation of the Rabbit Destruction Council, and acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area of land the boundaries of which are described in the Schedule hereto, being an area to which subsection one of section thirty of the Rabbit Nuisance Act, 1928, applies, a rabbit district, and doth appoint that the name of the said rabbit district shall be the Pukaki Rabbit District, and doth order that the basis on which the Rabbit Board to be established for the said district shall first levy its general rate shall be the acreage of land occupied by the ratepayer.
SCHEDULE
DESCRIPTION OF BOUNDARIES OF THE PUKAKI RABBIT DISTRICT
ALL that area in the Waitaki County of the Otago Land District and the Mackenzie County of the Canterbury Land District, containing 409,000 acres, more or less (84,790 acres Otago, 324,210 acres Canterbury), bounded by a line commencing at a point being the junction of the Waitaki River and Ohau River; thence proceeding up the middle of the Ohau River, to and along the eastern shore of Lake Ohau, to and along the left bank of the Hopkins River, to and along the Temple Stream to its source near Mount Maitland; thence to Mount Maitland and northerly along the Barrier Range to Mount Strauchan on the Main Divide; thence in a north-easterly direction along the Main Divide to and along Ben Ohau Range to Mount Sealy; thence to and along the east side of Metelille Glacier and the east and south sides of Mueller Glacier, to and along the Hooker River, to and along the right bank of the Tasman River in a southerly direction, to and along the west shore of Lake Pukaki, to and along the right bank of the River Pukaki, to and along the right bank of the River Waitaki to the junction of that river with Ohau River, the point of commencement.

Constitution of Rural Fire District

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 23rd day of March 1949
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to the Forest and Rural Fires Act, 1947, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area described in the First Schedule hereto to be a rural fire district, to be known as the “Manuwao Rural Fire District”; and doth hereby specify the trees and other plants situated on the lands described in the Second Schedule hereto as the property for the protection of which the district is constituted; and doth hereby further specify the period between the first day of October in any one year and the thirtieth day of April in the following year (both days inclusive) as a closed fire season in the said district; and doth hereby declare that this Order in Council shall come into force, and that the Manuwao Rural Fire District shall become a rural fire district, on the day following publication of this Order in Council in the Gazette; and doth hereby prescribe that the said district shall be administered for the purposes of the said Act by a rural fire committee which shall be known as the 'Manuwao Rural Fire Committee,' and, with respect to the said Rural Fire Committee, doth hereby make the following regulations.
REGULATIONS

  1. In these regulations, unless the context otherwise requires,—
    “Act” means the Forest and Rural Fires Act, 1947:
    “Committee” means the Manuwao Rural Fire Committee constituted by these regulations:
    “District” means the Manuwao Rural Fire District:
    “Minister” means the Commissioner of State Forests.
  2. The Rural Fire Committee Regulations 1949, shall, so far as they are applicable, and with the necessary modifications, apply to the Manuwao Rural Fire Committee constituted by these regulations and these regulations shall be deemed to be special regulations for the purposes of those regulations.
    MEMBERS
  3. The Committee shall consist of three members, who shall be appointed in the following manner:—
    (a) Two members (herein referred to as the forest owners' representatives) shall be appointed either by a resolution passed by a majority of those present at a meeting of owners of forests on lands described in the Second Schedule hereto, or by a majority vote by ballot of those present at such a meeting, as those so present by resolution determine:
    (b) One member (herein referred to as the occupiers' representative) who shall be appointed either by a resolution passed by a majority of those present at a meeting of the owners or occupiers of land (other than forest owners) affected by the constitution of the Manuwao Rural Fire District, or by a majority vote by ballot of those present at such a meeting as those so present by resolution determine.
  4. Reginald Henry Greville, East Coast Road, Browns Bay, shall be the Returning Officer for the first appointment of forest owners' representatives and the occupiers' representative, and shall convene such meetings and conduct such ballots as may be required for the first appointments, and shall also convene the first meeting of the Committee. Thereafter the Secretary of the Committee shall be the returning officer.
