The Government Railways (Staff) Amending Regulations 1949

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to the Government Railways Act, 1926, and to section twenty-three of the Government Railways Amendment Act, 1944, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS

  1. THESE regulations may be cited as the Government Railways (Staff) Amending Regulations 1949, and shall be read together with and form part of the regulations made under the Government Railways Act, 1908, on the 12th day of June, 1922, and published in the Gazette on the 15th day of the same month at page 1583, as the same are enuring under the Government Railways Act, 1926 (hereinafter called the principal regulations).

  2. Regulation 16 of the principal regulations, as replaced by Regulation 2 of the Government Railways (Staff) Amending Regulations 1947 (No. 2),* is amended—

(a) By omitting from the first, second, and third columns respectively of the table comprising part of clause (1), the line reading

“Candidates for any other adult occupation .. 21 39”,

and substituting the following line:—

“Candidates for any other adult occupation in
the Second Division .. .. .. 21 45”.

(b) By inserting in the first, second, and third columns respectively of the said table, next following the line reading

“Tradesman .. .. .. .. 20 45”,

the following line:—

“Clerk .. .. .. .. 20 50†”.

  1. Clause (2) of Regulation 22 of the principal regulations, as enacted by Regulation 4 of the Government Railways (Staff) Amending Regulations 1947§, is amended by omitting the letter “(a)” in parentheses, which imports a reference to paragraph (a) of clause (1) of the said Regulation 22, to the intent that no such reference shall hereafter be imported by the said clause (2).

  2. (1) Regulation 64 of the principal regulations, as enacted by the regulations made on the 7th day of October, 1936, and published in the Gazette on the 8th day of the same month at page 1840, and as amended by the regulations made on the 7th day of December, 1939, and published in the Gazette on the 14th day of the same month at page 3494, and by Regulation 5 of the Government Railways (Staff) Amending Regulations 1947§, is hereby further amended by revoking subparagraphs (i) to (iii) inclusive of paragraph (a) (but not the proviso to the said paragraph (a)), and substituting the following subparagraphs next before the proviso aforesaid:—

“(i) An employee whose salary exceeds £765 per annum but does not exceed £1,075 per annum (other than the Comptroller of Stores): 25s. per day.

“(ii) The Assistant Chief Mechanical Engineer, the Assistant Chief Civil Engineer, the Staff Superintendent, and the Comptroller of Stores: 27s. 6d. per day.

“(iii) The Assistant General Manager, the Chief Mechanical Engineer, the Chief Civil Engineer, the Chief Accountant, the Chief Signal and Electrical Engineer, and the Transportation Superintendent: 30s. per day.

“(iv) The General Manager: Such rate as may from time to time be determined by the Minister.”

(2) This regulation shall be deemed to have come into force on the 7th day of December, 1947.

  1. (1) The principal regulations are amended by adding, next after Regulation 79, the following regulation:—

“79A. The General Manager or any officer authorized by him may grant to any administrative officer who is transferred at the Department’s expense and who is as a consequence obliged to move his household from his existing residential quarters to new residential quarters, in addition to any other expenses and allowances in respect of his transfer to which he is entitled under these regulations, at the option of the administrative officer, either—

“(a) On production of supporting receipts an allowance not exceeding £25 to cover expenses (not otherwise recoverable but incurred by the administrative officer as the direct result of the transfer) in adjusting soft furnishings and floor coverings to the new residential quarters; or

“(b) An allowance of £15 without the production of supporting receipts.”

(2) This regulation shall be deemed to have come into force on the 6th day of December, 1947.

  1. (1) Regulation 101 of the principal regulations, as enacted by the regulations made on the 7th day of December, 1939, and published in the Gazette on the 14th day of the same month at page 3494, is amended by revoking clause (2) and clause (3) thereof, and substituting the following clause:—

“(2) (a) Notwithstanding the provisions of the last preceding clause, payment to an administrative officer classified in Grade Special E or Grade Special F of Class 3 of Subdivision I of the First Division who is required to be on duty on a Sunday shall be at the rate of 8s. 6d. per hour, with a minimum payment as for four hours at such rate.

“(b) Any administrative officer classified in Grade Special E or Grade Special F of Subdivision I of the First Division who is required to be on duty on New Year’s Day, Good Friday, Easter Monday, Anzac Day, Sovereign’s Birthday, Labour Day, Christmas Day, or Boxing Day may elect to be paid at the rate of 8s. 6d. per hour, with a minimum payment as for four hours at such rate, in lieu of being granted additional leave under the provisions of Regulation 125 of the principal regulations.

“(c) Any payments made pursuant to the last two preceding paragraphs of this clause shall be in addition to the salary of the administrative officer concerned.

“(d) For the purpose of computing the period of time for payment purposes under this clause any fractions of an hour on duty shall be reckoned to the nearest quarter of an hour.”

(2) This regulation shall be deemed to have come into force on the 1st day of October, 1947.

  1. Regulation 143 of the principal regulations, as replaced by the regulations made on the 9th day of September, 1929, and published in the Gazette on the 12th day of the same month at page 2447, and as amended by the regulations made on the 25th day of November, 1931, and published in the Gazette on the 8th day of January, 1932, at page 39, and on the 16th day of November, 1932, and published in the Gazette on the 24th day of the same month at page 2458, and on the 12th day of April, 1938, and published in the Gazette on the 28th day of the same month at page 1020, and by Regulation 6 of the Government Railways (Staff) Amending Regulations 1947§, is hereby further amended by revoking the words “seven years’ service” in the proviso to subclause (c) of clause (2), and substituting the words “six years’ service.”

  2. Regulation 155 of the principal regulations, as replaced by Regulation 9 of the Government Railways (Staff) Amending Regulations 1947§, is hereby amended by inserting the following clause immediately after clause (12):—

“(12A) A privilege-ticket order authorizing the purchase of two or more privilege tickets for use by any one person shall, for the purposes of computing the number of orders issued to such person pursuant to this regulation, be counted as if separate orders had been issued for the purchase of each of such privilege tickets.”

  1. The regulations specified in the table subjoined to this regulation are hereby revoked as superseded:—
