Notifying the Proposed Exchange of State Forest in the Auckland Conservancy for Other Land

WHEREAS by section four of the Forests Amendment Act, 1925, it is enacted that it shall be lawful for the Governor-General, whenever he deems it expedient in the public interest, to grant in fee-simple any area of land comprised in a State forest which is subject to the provisions of the Forests Act, 1921–22, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive any sum by way of equality of exchange:

And whereas, in the opinion of the Governor-General, it is expedient to exchange the area of State forest described in the First Schedule hereto for the land of equal value described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare it is his intention to grant in fee-simple the area of State forest described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule.

FIRST SCHEDULE

DESCRIPTION OF LAND AUTHORIZED TO BE EXCHANGED

All that area in the Auckland Land District, Piako County, containing by admeasurement 35 acres 3 roods 13 perches, more or less, situated in Blocks III, IV, and VIII, Hapuakohe Survey District, being part of a permanent State forest (Gazette, 1939, page 2044), and being part of Hoe-o-Tainui North No. 6B 2J 1 Block, and bounded generally as follows: Towards the north by part of Section 3, Tainui Settlement, 3240·9 links; towards the north-east by Section 4, Tainui Settlement 1730·1 links; towards the east by a public road, 431·9 links; towards the south and south-west by permanent State forest aforesaid, by lines bearing 271° 08' 10" for 1708·7 links, 293° 24' for 2110·4 links, 291° 18' for 836·7 links, and 302° 29' 30" for 432·5 links: be all the aforesaid linkages more or less. As the same is more particularly delineated on plan No. 25/29, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red.

SECOND SCHEDULE

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR

All that area in the Auckland Land District, Piako County, containing by admeasurement 69 acres, more or less, situated in Block III, Hapuakohe Survey District, being part of Section 3, Tainui Settlement, and bounded generally as follows: Towards the north-east by part of Section 3, Tainui Settlement, by lines bearing 85° 37' 30" for 385·4 links, 132° 47' 30" for 634·6 links, 111° 08' for 751·1 links, 86° 22' for 258·4 links, 114° 30' 30" for 602·7 links, 130° 49' for 454·6 links, 186° 12' 30" for 332·6 links, 204° 12' for 305·5 links, 112° 37' for 652·7 links, 106° 04' 30" for 829·9 links, and 216° 57' for 147·5 links; towards the south by permanent State forest (Gazette, 1939, page 2044), being part of Hoe-o-Tainui North No. 6B 2J 1 Block, 5483·3 links; and towards the north-west by Allotments 487 and 484, Taupiri Parish: be all the aforesaid linkages more or less. As the same is more particularly delineated on plan No. 25/29, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered blue. (Auckland plan S.O. 33672.)

Lieutenant H. L. Jones to be temp. Captain. Dated 1st December, 1948.

Major F. R. Bartley, from the Reserve of Officers, Supplementary List, to be temp. Captain (on prob.). Dated 11th February, 1949.

With reference to the notice published in the N.Z. Gazette No. 4, dated 27th January, 1949, relative to the appointment of Frederick Betton Bath as temp. Lieutenant (on prob.), for "Dated 15th January, 1949," substitute "Dated 17th January, 1949."
