Varying the Determinations in Respect of the Waimea County
Council’s Loan of £33,000

ORDER IN COUNCIL

At the Government House at Wellington, this 23rd day of
February, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the fourteenth day of
January, one thousand nine hundred and forty-eight
(hereinafter called the said Order in Council), and subject to the
determinations as to borrowing and repayment therein set out,
consent was given to the raising in New Zealand by the Waimea
County Council (hereinafter called the said local authority) of a loan
of thirty-three thousand pounds (£33,000), to be known as “ Road-
scaling Loan, 1947 ” (hereinafter called the said loan) :

And whereas the authority conferred by the said Order in
Council has not yet been exercised, and it is expedient to vary
certain of the determinations aforesaid in respect of the said loan :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in pursuance and
exercise of the powers and authorities conferred on him by section
eleven of the Local Government Loans Board Act, 1926, as set out
in section twenty-nine of the Finance Act, 1932 (No. 2), and of all
other powers and authorities enabling him in this behalf, doth
hereby vary certain of the determinations aforesaid in respect of
the said loan by prescribing that in lieu of making provision for the
repayment of the said loan by establishing a sinking fund in respect
thereof, as specified in clause three of the said Order in Council, the
said local authority shall raise the said loan or any portion thereof
upon terms of making the same, together with interest thereon,
repayable by equal aggregate annual or half-yearly instalments
extending over the term of ten (10) years, as specified in clause one
of the said Order in Council.

One Tree Hill Borough Council Loan of £83,000 by Extending
the Term Within Which the Said Sum May be Borrowed

At the Government House at Wellington, this 23rd day of
February, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the twelfth day of
March, one thousand nine hundred and forty-seven
(hereinafter called the said Order in Council), and subject to the
determinations as to borrowing and repayment therein set out,
consent was given to the raising in New Zealand by the One Tree
Hill Borough Council (hereinafter called the said local authority)
of a loan of eighty-three thousand pounds (£83,000), to be known
as “ Streets Construction and Improvement Loan, 1946 ” (herein-
after called the said loan) :

And whereas the authority conferred by the said Order in
Council has not been exercised to the extent of sixty-six thousand
four hundred pounds (£66,400) (hereinafter called the said sum),
and it is expedient to extend the term, as specified in clause six
of the said Order in Council, within which the said sum or any portion
thereof may be raised :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred on
him by section eleven of the Local Government Loans Board Act,
1926, as set out in section twenty-nine of the Finance Act, 1932
(No. 2), and of all other powers and authorities enabling him in this
behalf, doth hereby vary the determinations aforesaid in respect of
the said sum by prescribing that no moneys shall be borrowed under
the consent given by the said Order in Council after the expiration
of four (4) years from the date thereof.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council of the
said Dominion, doth hereby consent to the land described in the
Schedule hereto being taken for library purposes.

SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken :
25·84 perches.

Being part of Lots 8 and 10, D.P. 349, being part of Section 787,
Town of Wellington.

Situated in Block VII, Port Nicholson Survey District (City
of Wellington.) (S.O. 21672.)

In the Wellington Land District ; as the same is more parti-
cularly delineated on the plan marked P.W.D. 128460, deposited in
the office of the Minister of Works at Wellington, and thereon
coloured sepia.

the Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby consent to the land described
in the Schedule hereto being taken for street.

APPROXIMATE area of the piece of land permitted to be taken :
3 perches.

Being part of Lots 8 and 10, D.P. 349, being part of Section 787,
Town of Wellington.
