Varying the Determinations in respect of the Manukau County
Council's Loan of £18,500

At the Government House at Wellington, this 4th day of
February, 1948
Present:
His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the twenty-second day
of October, one thousand nine hundred and forty-seven
(hereinafter called the said Order in Council), and subject to the
determinations as to borrowing and repayment therein set out,
consent was given to the raising in New Zealand by the Manukau
County Council (hereinafter called the said local authority) of a loan
of eighteen thousand five hundred pounds (£18,500), to be known
as "Papatoetoe Water-supply Extension Loan No. 4, 1946" (hereinafter called the said loan):
And whereas the authority conferred by the said Order in
Council has not yet been exercised, and it is expedient to vary
certain of the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred on
him by section eleven of the Local Government Loans Board Act,
1926, as set out in section twenty-nine of the Finance Act, 1932
(No. 2), and of all other powers and authorities enabling him in
this behalf, doth hereby vary certain of the determinations aforesaid
in respect of the said loan by prescribing that in lieu of making
provision for the repayment of the said loan by establishing a sinking
fund in respect thereof, as specified in clause three of the said Order
in Council, the said local authority shall raise the said loan or any
portion thereof upon terms of making the same, together with
interest thereon, repayable by equal aggregate annual or half-yearly
instalments extending over the term of thirty (30) years, as specified in clause one of the said Order in Council.

WHEREAS by Order in Council made on the fifteenth day of
October, one thousand nine hundred and forty-seven, and
subject to the determinations as to borrowing and repayment therein
set out, consent was given to the raising in New Zealand by the
Morrinsville Borough Council (hereinafter called the said local
authority) of a loan of three thousand five hundred pounds (£3,500),
to be known as "Recreation-ground Improvements Loan, 1947" (hereinafter called the said loan):
And whereas the authority conferred by the said Order in
Council has not yet been exercised, and it is expedient to vary
certain of the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred on
him by section eleven of the Local Government Loans Board Act,
1926, as set out in section twenty-nine of the Finance Act, 1932
(No. 2), and of all other powers and authorities enabling him in this
behalf, doth hereby vary the determinations aforesaid in respect
of the said loan by prescribing that in lieu of a term of twenty-five
(25) years, as specified in clause one of the said Order in Council,
the term for which the said loan or any part thereof may be raised
shall not exceed twenty (20) years.

Council's Loan of £8,800

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the eleventh day of
December, one thousand nine hundred and forty-six (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Otahuhu Borough Council (hereinafter called the said local authority) of a loan of eight thousand eight hundred pounds (£8,800), to be known as "Middlemore Water Loan, 1946" (hereinafter called the said loan):
And whereas the authority conferred by the said Order in
Council has not yet been exercised, and it is expedient to vary certain
of the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred on
him by section eleven of the Local Government Loans Board Act,
1926, as set out in section twenty-nine of the Finance Act, 1932
(No. 2), and of all other powers and authorities enabling him in
this behalf, doth hereby vary certain of the determinations aforesaid
in respect of the said loan by prescribing that in lieu of provision
being made for the repayment of the said loan by the establishment
of a sinking fund in respect thereof, as specified in clause three of

Loan of £10,000

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the thirtieth day of
October, one thousand nine hundred and forty-six (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Franklin County Council (hereinafter called the said local authority) of a loan of ten thousand pounds (£10,000), to be known as "Workers' Dwellings Loan, 1946" (hereinafter called the said loan):
And whereas the authority conferred by the said Order in
Council has not yet been exercised, and it is expedient to vary
certain of the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred on
him by section eleven of the Local Government Loans Board Act,
1926, as set out in section twenty-nine of the Finance Act, 1932
(No. 2), and of all other powers and authorities enabling him in
this behalf, doth hereby vary certain of the determinations aforesaid
in respect of the said loan by prescribing as follows:
(1) In lieu of a term of twenty (20) years, as specified in clause
one of the said Order in Council, the term for which the said loan
or any part thereof may be raised shall not exceed twenty-five (25)
years.
(2) In lieu of provision being made for the repayment of the
said loan by the establishment of a sinking fund in respect thereof,
as specified in clause three of the said Order in Council, the said
loan, together with interest thereon, shall be repaid by half-yearly
instalments in the half-years set out in the first column of the
Schedule hereunder of the amounts set opposite each such half-year
in the second column of the said Schedule. Each such half-yearly
instalment includes a repayment of principal amounting to two
hundred pounds (£200), and a half-year's interest on the amount
of principal outstanding immediately prior to the date of payment
of such instalment.
