Consenting to the Raising of a Loan of £400 by the Wyndham Town Board, and Prescribing the Conditions Thereof

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Wyndham Town Board (hereinafter called the said local authority) proposes, pursuant to the provisions of section three of the Main Highways Amendment Act, 1928, to borrow the sum of four hundred pounds (£400) by a loan to be known as “Main Highways Loan, 1948” (hereinafter called the said loan), for the purpose of providing the Council's share of the cost of sealing portions of the Edendale-Wyndham-Mokoreta and Mataura-Wyndham-Letterbox Main Highways:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan for the said purpose up to the amount of four hundred pounds (£400), and in giving such consent doth hereby determine as follows:-

(1) The term for which the said loan or any part thereof may be raised shall be five (5) years.

(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.

(3) The said loan or any part thereof, together with interest thereon shall, be repaid by equal aggregate annual instalments extending over the term as determined in (1) above.

(4) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Varying the Determinations in Respect of Portion (£16,300) of the Taihape Borough Council's Loan of £24,000 by Extending the Term Within Which the Said Sum May be Borrowed

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the fifteenth day of January, one thousand nine hundred and forty-seven (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Taihape Borough Council (hereinafter called the said local authority) of a loan of twenty-four thousand pounds (£24,000), to be known as “Street Improvements Loan, 1946” (hereinafter called the said loan):

And whereas the authority conferred by the said Order in Council has not been exercised to the extent of sixteen thousand three hundred pounds (£16,300) (hereinafter called the said sum), and it is expedient to extend the term, as specified in clause six of the said Order in Council, within which the said sum or any portion thereof may be raised:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that no moneys shall be borrowed under the consent given by the said Order in Council after the expiration of four (4) years from the date thereof.

Constitution of Rural Fire District

ORDER IN COUNCIL

At the Government House at Wellington, this 15th day of December, 1948

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Forest and Rural Fires Act, 1947, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area described in the Schedule hereto to be a rural fire district, to be known as the “Tairua Rural Fire District”; and doth hereby specify the trees and other plants on the State forests in the said area as the property for the protection of which the district is constituted; and doth hereby specify the period between the first day of October in any one year and the thirtieth day of April in the following year (both days inclusive) as a closed fire season in the said district; and doth hereby prescribe that the said Tairua Rural Fire District shall be administered by the Commissioner of State Forests for the purposes of the said Act; and doth hereby further declare that this Order in Council shall come into force on the day following publication thereof in the Gazette.

SCHEDULE

AUCKLAND LAND DISTRICT.—AUCKLAND CONSERVANCY

Tairua Rural Fire District

ALL that area in the Auckland Land District, Thames County, containing approximately 63,800 acres, situated in Blocks XIII, XIV, Whitianga Survey District, Blocks II, III, IV, VI, VII, VIII, X, XI, XII, XIV, XV, and XVI, Tairua Survey District, and Blocks II and III, Ohinemuri Survey District, and bounded generally as follows: Towards the east by the Pacific Ocean; towards the south-west, south-east, and north-west by the shores of Wharekawa Harbour; again towards the east by the Pacific Ocean; towards the south-west, south-east, and east by the shores of Whangamata Harbour; towards the south-east by the Moana-Anuanu River and the Wentworth River; towards the west by Lot l of Section 3, Block II, Ohinemuri Survey District; towards the south-west, west, and north-west by the Tairua River, and again towards the north-west by the shore of Tairua Harbour. As the same is more particularly delineated on plan No. 23/60, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red.

MARLBOROUGH LAND DISTRICT.—CANTERBURY CONSERVANCY

Mount Fyffe Rural Fire District

ALL that area in the Marlborough Land District, Kaikoura County, containing approximately 13,000 acres, situated in Blocks I, IV, XII, and XIII, Mount Fyffe Survey District, and bounded generally as follows: Commencing at peg XIV on the eastern boundary of Run 128; thence towards the north-east by a right line to the westernmost corner of S.G.R. 101; thence by a line bearing 96° for 3500 links to Long Creek, by that creek and Section 10, Block II, Mount Fyffe Survey District; towards the south-east by the south-eastern side of Grange Road; again towards the north-east by the north-eastern side of a public road; again towards the public road; and towards the south-west and north-west by the Kowhai River and by Run 128. As the same is more particularly delineated on plan No. 124/2, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red.
