O'LEARY ORDER IN COUNCIL At the Government House at Wellington, this 15th day of December, 1948 Present : HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to section two hundred and forty-six of the Maori Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby authorize the disposition to and acquisition by Thomas Borthwick and Sons (Australasia), Limited, of the land described in the Schedule hereto, notwithstanding the provisions of Part XII of the said Act.
SCHEDULE ALL that parcel of land containing 2 acres 1 rood 5 perches, more or less, situate in Block IVA, Tokomaru Bay Survey District, being Lot 1 on Deposited Plan No. 2533, being also part of the Tawhiti la 2 Block, and being the whole of the land comprised and described in Certificate of Title, Volume 62, folio 7 (Gisborne Registry). FREYBERG, Governor-General ORDER IN COUNCIL At the Government House at Wellington, this 22nd day of December, 1948 Present : HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL WHEREAS a petition was presented to the Governor-General praying that a certain area be excluded from the County of Otorohanga and included in the Town District of Otorohanga : And whereas, in pursuance of section twenty-four of the Local Government Commission Act, 1946, the said petition was referred to the Local Government Commission : And whereas, in pursuance of the provisions of the said Act, the Local Government Commission has made inquiry into the proposal and has approved as final a scheme bearing date the twenty-seventh day of April, one thousand nine hundred and forty-eight, providing for the exclusion of the area described in the Schedule to the said scheme from the County of Otorohanga and the inclusion of such area in the Town District of Otorohanga : And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing: Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act, 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-nine, the area described in the Schedule hereto shall be excluded from the County of Otorohanga and included in the Town District of Otorohanga, and, with the like advice and consent, doth hereby declare that the provisions of section one hundred and fifty-one of the Municipal Corporations Act, 1933, shall, with the necessary modifications, apply to the said alteration of boundaries in all respects as if the Town District of Otorohanga was a borough.
SCHEDULE AREA EXCLUDED FROM THE COUNTY OF OTOROHANGA AND INCLUDED IN THE TOWN DISTRICT OF OTOROHANGA ALL that area of approximately 280 acres in Block IV, Orahiri Survey District, bounded by a line commencing at a point on the right bank of the Waipa River at its junction with the south-eastern boundary of Otorohanga E 3c Block, and running easterly generally along the south-eastern and eastern boundaries of the said block, to and along the south-eastern side of the private road intersecting Otorohanga E 4B Block, and shown on the Maori Land plan numbered 7821 lodged in the office of the Chief Surveyor at Auckland, to the western side of a public road; thence along the western side of that road to the southern boundary of Otorohanga F 2A 2 Block, and along a right line across the said road to and along the southern and eastern boundaries of another part of the said F 2A 2 Block and the eastern boundary of Otorohanga F 2B 2 Block, to and along the southern boundary of Otorohanga N 2B 2 Block, to and along the western and southern boundary of Otorohanga C 2B 2A to the western side of the North Island Main Trunk Railway; thence south-westerly along the western side of the said railway to a point in line with the southern boundary of Lot 1 as shown on the plan numbered 29570, deposited in the office of the District Land Registrar at Auckland, being parts of Otorohanga B 2 Nos. 3A and 3B Blocks; thence again easterly generally along a right line across the said railway, to and along the said southern boundary and along another right line, to and along the southern boundary of Lot 4 shown on the said plan numbered 29570, being parts of the said Nos. 3A and
3B Blocks, to and along the northern side of the No. 8 (Auckland- Wellington) State Highway to a point in line with the western boundary of Lot 1 shown on the plan numbered 31964, deposited as aforesaid, being part of Otorohanga No. 1F 4B Block; thence southerly generally along a right line across the said highway, to and along the said western boundary, and along another right line being that boundary produced across the Rangiatea Road to its south-western side; thence westerly generally along that south- western side to and along the western boundary of the Gravel Reserve shown on the plan numbered 20077, lodged as aforesaid, to and down the right bank of the Waipa River to the northern end of Puha Terrace; thence along the eastern side of the North Island Main Trunk Railway to and along the northern side of Pine Street, and along a right line to and along the northern side of Kanawa Street to the southernmost corner of Allotment 1 of Block X, Otorohanga Native Township; thence northerly generally along the eastern boundary of the Town District of Otorohanga, as described in New Zealand Gazette No. 6 of the 31st day of January, 1935, page 122, to and down the right bank of the Waipa River to the point of commencement. FREYBERG, Governor-General ORDER IN COUNCIL At the Government House at Wellington, this 22nd day of December, 1948 Present : HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL WHEREAS, in pursuance of section one hundred and thirty- six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area be excluded from the Borough of Port Chalmers and included in the County of Waikouaiti : And whereas, in pursuance of section twenty-four of the Local Government Commission Act, 1946, the said petition was referred to the Local Government Commission : And whereas, in pursuance of the provisions of the said Act, the Local Government Commission has approved as final a scheme bearing date the thirty-first day of August, one thousand nine hundred and forty-eight, providing for the exclusion of the area referred to in the said petition from the Borough of Port Chalmers and the inclusion of such area in the County of Waikouaiti : And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing : Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act, 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-nine, the area described in the Schedule hereto shall be excluded from the Borough of Port Chalmers and included in the County of Waikouaiti, and, with the like advice and consent, doth hereby declare that the alteration of boundaries of the said borough and the said county hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act, 1933.
SCHEDULE AREA EXCLUDED FROM THE BOROUGH OF PORT CHALMERS AND INCLUDED IN THE COUNTY OF WAIKOUAITI ALL that area in the Borough of Port Chalmers, containing 136 acres and 2 roods, more or less, being part of Block VI, North Harbour and Blueskin Survey District, and part of Blocks I and II, Lower Harbour West Survey District, bounded as follows : Commencing at the north-western corner of Section 40, Block VI, North Harbour and Blueskin Survey District; thence along the north-western boundaries of Sections 40 and 41, Block VI aforesaid, to and across a public road ; thence along the north-eastern side of that road to Maclean Street ; thence along the southern side of Maclean Street and its production to the high-water mark of Otago Harbour; thence generally southerly along the aforesaid high-water mark to a point in line with the north-east boundary of Section 2, Block I, Lower Harbour West Survey District; thence to and along that boundary to the south-eastern boundary of the main Southern Trunk Railway; thence along the south-eastern boundary of that railway and its production to the north-eastern end of Ocean Terrace; thence along the north-eastern end and south-eastern side of Ocean Terrace to Slant Street; thence across Slant Street, to and along the south- eastern side of Woodland Terrace and its production to the north- eastern boundary of Section 4, Block II, Lower Harbour West Survey District; thence along the north-eastern boundary of Section 4 aforesaid to its northern corner; thence along the north- west boundary of Section 5, Block II, Lower Harbour West Survey District, to and across the Port Chalmers-Waitati Highway; thence along the north-eastern side of that highway to the north- western boundary of Section 19, Block VI, North Harbour and Blueskin Survey District; thence along the north-western boundary of Section 19 aforesaid, across a closed road, and along the north- western boundaries of Sections 35 and 39, Block VI, North Harbour and Blueskin Survey District, to the point of commencement.
