(6) The Chairman at any meeting of the Committee may exercise a deliberative vote, and, in the case of an equality of votes, a casting vote.
(7) If any member of the Committee is unable to attend any meeting of the Committee, he may, by writing under his hand or by telegram or by notification by telephone to the Secretary of the Committee, appoint any person to attend that meeting in his stead, and that person shall for all the purposes of that meeting have the same rights and privileges as his appointor would have been capable of exercising and enjoying had he been personally present thereat.
SEAL
- (1) The seal of the Committee shall be kept in the custody of the Chairman, or of such member or officer of the Committee as it may appoint for the purpose.
(2) The seal of the Committee shall not be affixed to any document except by the authority of a resolution of the Committee and in the presence of two members of the Committee and the Secretary, all of whom shall attest the sealing of the document.
OFFICERS
- (1) The Committee may from time to time appoint some fit and proper person to be the Secretary of the Committee, and may at any time remove any person so appointed.
(2) The Secretary of the Committee shall be deemed to be the servant of the Committee, and may receive such salary or other remuneration and allowances as the Committee shall determine.
(3) The position of Secretary may be held conjointly with any other position either as a servant of the Committee or otherwise.
(4) The Secretary shall keep all the necessary records and books of account, and shall have such powers and other duties as the Committee shall determine, and he shall at all times conform to the directions of the Committee.
(5) The Committee may from time to time appoint such other officers and workmen as are necessary and expedient for the proper carrying out of its business, and may pay them such salaries, wages, or other remuneration and allowances as the Committee may determine.
POWERS OF COMMITTEE WITH REGARD TO FIRE
- For the purpose of carrying out its obligations under the Act to promote and carry out measures for the prevention, detection, control, and suppression of fires in the district the Committee may, without limitation to the generality of the powers conferred on it by the Act as the Fire Authority for the district, from time to time—
(a) Establish, maintain, equip, and staff observation posts and look-outs:
(b) Enter into arrangements, whether temporary or for some prescribed period and on such terms as to costs, expenses, and otherwise as it shall think proper, with forest owners, sawmillers, or other persons in respect of all or any of the matters mentioned in subclause (a) hereof, or for the supply or use of fire-fighting equipment and apparatus, vehicles, and labour:
(c) Enter into arrangements, whether temporary or for some prescribed period and on such terms as to costs, expenses, and otherwise as it shall think proper, with any Department of State or with owners or proprietors of aircraft for the establishment and maintenance of aerial reconnaissance and patrol:
(d) Provide and maintain telephones, broadcasting apparatus, signalling apparatus, and other means of communication:
(e) Provide and maintain first-aid posts and equipment:
(f) Generally, take all such other measures as the Committee may consider necessary for the prevention, detection, control, and suppression of fires, or for diminishing the danger to life and property arising from fire.
ACCOUNTS
- (1) Proper books of account and other books shall be kept by the Committee, in which shall be entered correct records of all moneys received and paid by it.
(2) All such accounts shall be subject to audit by an auditor duly appointed by the Committee for the purpose. At the close of each year ending on the 30th day of June the Committee shall cause to be prepared a statement showing the total receipts and expenditure of the Committee during that year, together with a balance-sheet showing its assets and liabilities, which shall be audited and certified by the auditor as to the correctness thereof.
(3) Within thirty days after the close of each such year the Committee shall transmit, or cause to be transmitted, two copies of the aforesaid audited statement of receipts and expenditure and balance-sheet, together with a report of the activities of the Committee for the period covered under the seal of the Committee to the Minister.
(4) The Committee shall cause a copy of its estimate prepared under section 33 of the Act to be furnished to the Minister.
ADMINISTRATION OF FUNDS
- (1) All moneys received by the Committee shall be paid into such bank as the Committee may direct to the credit of an account to be called the “Oraka Rural Fire Committee Account.”
(2) No moneys shall be paid out of such account except by cheque signed by any two of the following persons:—
(a) The Chairman of the Committee:
(b) The Secretary of the Committee:
(c) One other member of the Committee to be appointed for the purpose by the Committee.
(3) All reasonable expenses properly incurred by the Committee may be paid out of moneys in the said account.

TRAVELLING-ALLOWANCES
- It shall be lawful for the Committee, if it thinks fit, to pay to any member thereof the amount reasonably and actually expended by him by way of travelling expenses in attending the meetings of the Committee or in the performance of his duties as a member thereof.
FIRST SCHEDULE
AUCKLAND LAND DISTRICT.—ROTORUA CONSERVANCY
Oraka Rural Fire District
ALL that area in the Auckland Land District, Matamata County, containing approximately 16,500 acres, situated in Blocks VII, VIII, XI, XII, XV, and XVI, Patetere North Survey District, and bounded generally as follows: Towards the north-east by the northern side of Leslie's Road to the western boundary of Patetere North-east Survey District; towards the east by that survey district boundary to the Auckland-Rotorua Railway Reserve; towards the south by the northern side of the aforesaid railway reserve, by Whaiti-Kuranui No. 1B Y 2c 5 Block, and the Oraka Stream to the Te Whetu Road, and by the southern sides of the Te Whetu Road and the Ngatira Road; towards the south-west by the south-western side of the Waitoa-Taupo Main Highway to the south-western corner of Section 32, Block XI, Patetere North Survey District; and towards the north-west by the north-western sides of a public road forming the south-eastern boundary of Section 32 aforesaid to Harris Road, and by Sections 141, 142 116, and 112, Block VII, Patetere North Survey District. As the same is more particularly delineated on plan No. 37/9, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red.

ORDER IN COUNCIL
At the Government House at Wellington, this 17th day of November, 1948.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Forest and Rural Fires Act, 1947, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area described in the First Schedule hereto to be a rural fire district, to be known as the “Tokoroa Rural Fire District”; and doth hereby specify the trees and other plants situated on the lands described in the Second Schedule hereto as the property for the protection of which the district is constituted; and doth hereby further specify the period between the first day of October in any one year and the thirtieth day of April in the following year (both days inclusive) as a closed fire season in the said district; and doth hereby declare that this Order in Council shall come into force on the day following publication thereof in the Gazette; and doth hereby prescribe that the said district shall be administered for the purposes of the said Act by a rural fire committee, which shall be known as the “Tokoroa Rural Fire Committee,” and, with respect to the said Rural Fire Committee, doth hereby make the following regulations.
REGULATIONS
- In these regulations, unless inconsistent with the context,—
“Act” means the Forest and Rural Fires Act, 1947;
“Committee” means the Tokoroa Rural Fire Committee constituted by these regulations;
“District” means the Tokoroa Rural Fire District;
“Farmer” means the occupier of land within the district, the whole or substantially the whole of which is used by him for farming purposes;
“Minister” means the Commissioner of State Forests;
Words importing persons include companies and other incorporated bodies;
Words importing the singular number include the plural, and vice versa.
