Consenting to the Raising of £982 by the Bay of Islands County Council
and Prescribing the Conditions Thereof

ORDER IN COUNCIL
At the Government House at Wellington, this 27th day of October, 1948
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the twenty-seventh day of March, one thousand nine hundred and forty-six (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Bay of Islands County Council (hereinafter called the said local authority) of a loan of nine hundred and eighty-two pounds (£982), to be known as "Main Highways Loan, 1946" (hereinafter called the said loan):
And whereas the authority conferred by the said Order in Council has not been exercised:
And whereas the authority has lapsed in accordance with the provisions of clause four of the said Order in Council, and it is not now lawful or competent for the said local authority to raise the said loan or any portion thereof except in accordance with the provisions of a further Order in Council that may be issued pursuant to section eleven of the Local Government Loans Board Act, 1926 (hereinafter called the said Act):
And whereas the said local authority is now desirous of raising the said loan, and it is expedient to authorize the said local authority to raise the said loan on the conditions hereinafter set out:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan up to the amount of nine hundred and eighty-two pounds (£982) for the purpose for which the said loan was authorized, and in giving such consent doth hereby determine as follows:-
(1) The term for which the said loan or any part thereof may be raised shall be ten (10) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.
(3) The said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual instalments extending over the term as determined in (1) above.
(4) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Consenting to Land Being Taken for an Automatic-telephone Exchange in the Borough of Ellerslie

His Excellency THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for an automatic-telephone exchange.
SCHEDULE
APPROXIMATE area of the piece of land permitted to be taken : 34·1 perches.
Being part Lot 5, D.P. 31250, being part Allotment 17, Section 12, Suburbs of Auckland.
Situated in Block I, Otahuhu Survey District (Borough of Ellerslie) (Auckland R.D.). (S.O. 35225.)
In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 127899, deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.

Declaring Portion of Road in Block IX, Mount Robinson Survey District, to be Government Road

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

SCHEDULE
APPROXIMATE area of the portion of road declared to be Government road : 3 acres 1 rood 6·4 perches.
Adjoining or passing through part Oturoa No. 2 Block.
Situated in Block IX, Mount Robinson Survey District. (S.O. 21717.)
In the Wellington Land District; as the same is more particularly delineated on the plan marked P.W.D. 127712, deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

Declaring Sandy Creek Farm Settlement Road, in the Hawke's Bay County, to be a County Road

His Excellency THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section one hundred and twelve of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

SCHEDULE
ALL that portion of road in the Hawke's Bay Land District, Hawke's Bay County, known as the Sandy Creek Farm Settlement Road, commencing at its junction with the Napier-Wairoa Road adjoining the left bank of the Papakiri Stream on the south-western boundary of Section 15, Block VIII, Maungaharuru Survey District, and proceeding thence in a north-westerly direction generally adjoining or passing through the said Section 15 and Section 16, Block VIII, Maungaharuru Survey District, and terminating at a point on the south-eastern boundary of the East Coast Main Trunk Railway at the boundary between the said Sections 15 and 16, Block VIII, Maungaharuru Survey District, being a distance of 48 chains, more or less.
Also all that portion of the said road commencing at a point on the north-western boundary of the East Coast Main Trunk Railway at the boundary between Sections 15 and 16, Block VIII, Maungaharuru Survey District, and proceeding thence in a north-westerly direction forming the boundary between the said Sections 15 and 16 and terminating at a point on the said boundary between Sections 15 and 16, Block VIII, Maungaharuru Survey District, being a distance of 8 chains, more or less.
As the same are more particularly delineated on the plan marked P.W.D. 127871, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

SCHEDULE
ALL that portion of road in the Hawke's Bay Land District, Hawke's Bay County, known as Onehunga Road, commencing at its junction with the Gisborne-Napier via Hangaroa Main Highway at a point opposite Fannin Street, situated in Block XVI, Puketapu Survey District; thence proceeding generally westerly and north-westerly for a distance of 132 decimal 58 chains, more or less, measured along the middle-line of the road to its termination on the boundary of Section 1, Ahuriri Lagoon, situated in Block XII, Puketapu Survey District. As the same is more particularly delineated on the plan marked P.W.D. 127870, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
