The Southern Side of Portion of Vivian Street and the Northern Side
of Portion of Fulford Street, in the Borough of New Plymouth,
Exempted from the Provisions of Section 128 of the Public Works
Act, 1928, Subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 20th day of
October, 1948
Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion, doth
hereby approve of the following resolution passed by the New
Plymouth Borough Council on the twenty-first day of June, one
thousand nine hundred and forty-eight, viz.:
"The New Plymouth Borough Council, being the local
authority having control of the streets in the Borough of New
Plymouth, by resolution declares that the provisions of section
one hundred and twenty-eight, subsection one, of the Public
Works Act, 1928, shall not apply—
"(a) To the southern side of the portion of Vivian Street
adjoining part Sections 353 and 354, Town of New
Plymouth, Certificate of Title, Volume 97, folio 134
(Taranaki Registry); nor
"(b) To the northern side of the portion of Fulford Street
adjoining parts Sections 379 and 380, Town of New
Plymouth, Certificate of Title, Volume 97,
folio 134 (Taranaki Registry)";
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of the
portion of Vivian Street or the northern side of the portion of Fulford
Street (described in the Schedule hereto) within a distance of thirty-
three feet from the centre-lines of the said portions of streets.
SCHEDULE
THE southern side of all that portion of street situated in the
Taranaki Land District, Borough of New Plymouth, known as
Vivian Street, fronting part Section 353 and part Section 354, Town
of New Plymouth.
Also the northern side of all that portion of street in the said
land district and borough, known as Fulford Street, fronting part
Section 379 and part Section 380, Town of New Plymouth.
As the same are more particularly delineated on the plan marked
P.W.D. 127694, deposited in the office of the Minister of Works at
Wellington, and thereon coloured red.

Authorizing the Waitara Borough Council to erect, maintain, and
use certain Electric Lines, and amending an Existing Licence

ORDER IN COUNCIL
At the Government House at Wellington, this 13th day of
October, 1948
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act, 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby authorize the Waitara Borough
Council (hereinafter referred to as the licensee), subject to the
conditions set forth in the First Schedule hereto, to lay, construct,
put up, place, and use the electric lines described in the Second
Schedule hereto; and, further, doth hereby amend the Order in
Council dated the seventh day of January, one thousand nine hundred
and twenty-five, and published in the Gazette on the fifteenth day
of the same month authorizing the licensee to erect electric lines
by deleting clause two of the Schedule thereto and substituting the
clause set forth in the Third Schedule hereto.
FIRST SCHEDULE
- IMPLIED CONDITIONS
THE conditions directed to be implied in all licences by the Electrical
Supply Regulations 1935 and the Electrical Wiring Regulations
1935 shall be incorporated in and shall form part of this licence,
except in so far as the same may be inconsistent with the provisions
hereof.
- LICENCE SUBJECT TO REGULATIONS
In respect of the lines hereby authorized, the licensee shall
comply with the Electrical Supply Regulations 1935, the Electrical
Wiring Regulations 1935, the Radio Interference Regulations 1934,
and with any regulations made or to be made in amendment or
amplification thereof or in substitution therefor.
- SYSTEM OF SUPPLY
The system of supply shall be as described in paragraphs (a)
and (f) of clause 21-01 of the Electrical Supply Regulations 1935.
The primary distribution voltage shall be 11,000 volts.
- DURATION OF LICENCE
This licence shall, unless sooner determined, continue in force
until the 7th day of January, 1967.
- CHARGES FOR ELECTRICAL ENERGY
The charge for electrical energy shall not exceed 1s. per unit
for lighting purposes and 6d. per unit for motor-power, heating,
or cooking purposes: Provided that “lighting purposes” shall
include the operation of motor generators for lighting purposes;
and, provided further, that if accounts are paid within fourteen
days of due date the charges shall not exceed 10d. per unit for
lighting purposes and 5d. per unit for motor-power, heating, or
cooking.
SECOND SCHEDULE
LINES adapted for the supply of electrical energy by the system of
supply hereinbefore described:—

Within that portion of the Borough of Waitara, as at present
constituted, which is shown outlined in blue on the plan marked
S.H.D. 33, deposited in the office of the Minister in Charge of the
State Hydro-electric Department, the lines at present proposed
to be used being indicated by means of green lines on the said plan
S.H.D. 33, and also on the plan marked S.H.D. 32, deposited as
aforesaid. -
In Section 29, Block III, Paritutu Survey District, in the
County of Taranaki, and in Section 7, Block I, Waitara Survey
District, in the County of Clifton, the said lines being more parti-
cularly shown coloured green on the aforesaid plan S.H.D. 32.
THIRD SCHEDULE
"2. SYSTEM OF SUPPLY
"THE system of supply shall be as described in paragraphs (a) and
(f) of clause 21-01 of the Electrical Supply Regulations 1935. The
primary distribution voltage shall be 11,000 volts."

Portion of the County of Buller

PURSUANT to the Public Works Act, 1928, His Excellency

consent of the Executive Council, doth hereby authorize Frank
Herbert Wood, of Karamea, Theatre-proprietor and Electrical
Wireman (hereinafter referred to as the licensee), subject to the
conditions hereinafter set forth, to lay, construct, put up, place,
and use the electric lines described in the Schedule hereto.
CONDITIONS
- IMPLIED CONDITIONS
THE conditions directed to be implied in all licences by the
Electrical Supply Regulations 1935 and the Electrical Wiring
Regulations 1935 shall be incorporated in and shall form part of
this licence, except in so far as the same may be inconsistent with
the provisions hereof.
- LICENCE SUBJECT TO REGULATIONS
This licence is issued under the Electrical Supply Regulations
1935, and is subject thereto and to the Electrical Wiring Regu-
lations 1935, the Radio Interference Regulations 1934, and to any
regulations made or to be made in amplification or amendment
thereof or in substitution therefor.
- SYSTEM OF SUPPLY
The system of supply shall be a direct-current system as
described in paragraph (d) of clause 21-01 of the Electrical Supply
Regulations 1935.
- DURATION OF LICENCE
Unless sooner determined, this licence shall continue in force
until the 31st day of March, 1969, or until electrical energy is
available from an Electric-power Board or other public source
of supply, whichever is the earlier.
- CHARGES ON SALE
The charges for electrical energy shall not exceed 9d. per unit
for all purposes. Payment shall not be demanded from any
consumer at intervals of less than twenty-one days apart.
SCHEDULE
LINES adapted for the distribution of electrical energy by the
system of supply prescribed in these presents within Block XIV,
Oparara Survey District, being portion of the County of Buller,
within a radius of ten chains from the centre of intersection of
Oparara Road, Waverly Street, Bridge Street, and Wharf Road,
as shown on the plan marked S.H.D. 41, deposited in the office
of the Minister in Charge of the State Hydro-electric Department;
the electric lines at present erected and proposed to be erected
being more particularly delineated by green lines on the said plan
S.H.D. 41.
