Directing Sale of Railway Land at Waipukurau under the Public Works Act, 1928

ORDER IN COUNCIL
At the Government House at Wellington, this 6th day of October, 1948
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was taken.
SCHEDULE
APPROXIMATE area of the piece of land directed to be sold: 8-55 perches.
Being part Block 16, Waipukurau Crown Grant District.
Situated in Waipukurau Borough. (S.O. 2326.)
In the Hawke's Bay Land District; as the same is more particularly delineated on the plan marked L.O. 9524, deposited in the office of the Minister of Railways at Wellington, and thereon coloured orange.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section five of the Maori Purposes Act, 1937,
His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Maori freehold land described in the Schedule hereto as a Maori reservation for the common use of the Ngatituera and Ngatihinearo sub-tribes of the Whanganui Tribe as a marae and meeting-place.

PURSUANT to section five of the Maori Purposes Act, 1937,
His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Maori freehold land described in the Second Schedule hereto as a Maori reservation for the common use of the members of the sub-tribes named in the First Schedule hereto, as a meeting-place and marae.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section five of the Maori Purposes Act, 1937,
His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Maori freehold land described in the Schedule hereto as a Maori reservation for the common use of the Ngati-mutunga Tribe as an urupa.
SCHEDULE
ALL that piece of land containing 2 roods, more or less, being Lot 1A, Subdivision 3, Section 24, Block IV, Waitara Survey District, and being the land known as Tautaratahi Urupa.

The South-eastern Side of Portion of Clarence Street, in the Borough of Thames, Exempted from the Provisions of Section 128 of the Public Works Act, 1928, Subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government House at Wellington, this 13th day of October, 1948
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Thames Borough Council on the twentieth day of May, one thousand nine hundred and forty-eight, viz.:-
"The Thames Borough Council, being the local authority having control of the streets in the Borough of Thames, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of that portion of Clarence Street adjoining all that piece of land in the Borough of Thames, being Lots Six Hundred and Seventeen, Six Hundred and Eighteen, and Six Hundred and Nineteen of the Whanaupo Block, and being part of the land comprised and described in Certificate of Title, Volume 563, folio 253 (limited as to parcels and title) of the Register-book in the Auckland District Land Registry";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Clarence Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
THE south-eastern side of all that portion of street situated in the Auckland Land District, Borough of Thames, known as Clarence Street, fronting Lots 617, 618, and 619, Whanaupo Block. As the same is more particularly delineated on the plan marked P.W.D. 127796, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the One Tree Hill Borough Council on the eighteenth day of August, one thousand nine hundred and forty-eight, viz.:-
"That the One Tree Hill Borough Council, being the local authority having control of the streets in the Borough of One Tree Hill, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of the portion of street adjoining part Lot 16, Section 11, Suburbs of Auckland, title reference C.T. 378/1";
