SEPT. 30] \nTHE NEW ZEALAND GAZETTE \nPrice Order No. 942 (Cheese) \nPURSUANT to the Control of Prices Act, 1947, the Price \nTribunal, acting with the authority of the Minister of \nIndustries and Commerce, doth hereby make the following Price \nOrder: \nPRELIMINARY \n1. This Order may be cited as Price Order No. 942, and shall \ncome into force on the 1st day of October, 1948. \n2. (1) Price Order No. 776 is hereby revoked. \n(2) The revocation of the said Order shall not affect the \nliability of any person for any offence in relation thereto committed \nbefore the coming into force of this Order. \n3. (1) In this Order, unless the context otherwise requires,- \n"The said Act" means the Control of Prices Act, 1947 : \n"Export size", in relation to any cheese, means a cheese \nweighing or reputed to weigh approximately 80 lb. : \n"Medium size", in relation to any cheese, means a cheese \nweighing or reputed to weigh approximately 40 lb. : \n"Pancake size", in relation to any cheese, means a cheese \nweighing or reputed to weigh approximately 20 lb. : \n"Standard crate lot", in relation to a transaction for the \nsale of cheeses, means a lot consisting of two cheeses \nof export size, or three cheeses of medium size, or six \ncheeses of pancake size. \n(2) Terms and expressions defined in the said Act and used \nin this Order have the meanings severally assigned thereto by \nthat Act. \n4. For the purposes of this Order, and notwithstanding anything \nto the contrary in the said Act, any person who sells by retail \nto any one purchaser, for delivery at any one time, not less than \nthree standard crate lots of export-size, medium-size, or pancake- \nsize cheeses, whether or not all the standard crate lots contain \nthe same size of cheeses, shall in respect of that sale be deemed \nto be a wholesaler, and the provisions of this Order as to maximum \nwholesale prices shall apply accordingly with respect to every \nsuch sale. \nAPPLICATION OF THIS ORDER \n5. (1) Except as otherwise provided herein, this Order applies \nonly with respect to Cheddar cheese that is sold by a wholesaler \nor retailer, as the case may be, within four months after the date \nof its manufacture. \n(2) For the purposes of this clause the date of the manufacture \nof any cheese shall be deemed to be the date indicated on the cheese \nin accordance with the requirements of the Dairy-produce Regulations 1938t. \n(3) Every person who sells any Cheddar cheese by retail \n(whatever the age of such cheese) shall keep, for a period of not \nless than four months, a record showing the date of the delivery \nof the cheese to the retailer, and also- \n(a) If the whole cheese was sold, without cutting, the date of \nits sale ; or \n(b) In any other case, the date on which the cheese was first \ncut. \n6. (1) In its application to sales by wholesalers, this Order \napplies only to the sale of export-size, medium-size, and pancake- \nsize cheeses. \n(2) In its application to sales by retailers, this Order applies \nto the sale of all Cheddar cheese referred to in subclause (1) of \nclause 5 hereof. \nFIXING MAXIMUM PRICES FOR CHEESE TO WHICH THIS ORDER \nAPPLIES \nWholesalers' Prices \n7. (1) The maximum price that may be charged or received by \nany wholesaler for any cheese to which this Order applies shall be \ncomputed as follows:- \nMaximum Price per Pound. \nNature of Sale. \nExport Medium Pancake \nSize. Size. Size. \ns. d. s. d. s. d. \n(a) Sales in standard crate lots 1 2½ 1 2⅜ 1 2½ \n(crated) \n(b) Sales in standard crate lots 1 1¾ 1 2 1 2⅜ \n(uncrated) \n(c) Sales of less than a standard 1 1⅞ 1 2½ 1 2½ \ncrate lot \n(2) For the purposes of this clause the weight of any cheeses \nsold in crates shall be deemed to be their weight as at the time \nof crating, and the weight of uncircled cheeses shall be deemed to \nbe their actual weight when delivered to the purchaser. \n Gazette, 16th October, 1947, Vol. III, page 1695. \n† Statutory Regulations 1938, Serial number 1938/91, page 396. \nRetailers' Prices \n8. (1) The maximum price that may be charged or received \nby any retailer for any cheese to which this Order applies shall be \ndetermined in accordance with the following provisions, namely :- \n(a) In the case of cheese sold by a retailer to whom supplies \nof Cheddar cheese are available, free of freight charges, \nfor delivery at his store from any source whatever, the \nmaximum retail price shall be ls. 5d. a pound : \n(b) In cases to which the last preceding paragraph does not \napply, the maximum retail price shall be ls. 5d. a pound, \nincreased to the next upward halfpenny by a proportionate part of the freight charges incurred by the \nretailer in obtaining delivery at his store : \nProvided that where any cheese to which this \nparagraph applies is obtained by the retailer from a \nsource of supply that is not the nearest or most convenient of access to the retailer’s store, the increase of the \nprice per pound authorized by this paragraph shall not \nexceed a proportionate part of the freight charges that \nwould have been incurred by the retailer if the cheese \nhad been obtained from the source of supply nearest \nor most convenient of access to his store, and if delivery \nhad been effected by a common carrier at current freight \nrates. \n(2) Where the quantity of cheese sold by a retailer in any one \ntransaction is not an exact number of pounds, the maximum price \nshall be computed at the rate per pound fixed in accordance with \nthe last preceding subclause. \n(3) If in respect of any cheese the retail price charged in \naccordance with the provisions of this clause is not an exact number \nof pence or halfpence, the maximum price shall be computed to the \nnext upward halfpenny. \nSPECIAL PRICES WHERE EXTRAORDINARY CHARGES INCURRED \n9. Subject to such conditions, if any, as it thinks fit, the \nTribunal, on application by any wholesaler or retailer, may authorize \nspecial prices in respect of any cheese to which this Order applies \nwhere for any reason extraordinary charges (freight or otherwise) \nare incurred by the wholesaler or retailer. Any authority given by \nthe Tribunal under this clause may apply with respect to a specified \nlot or consignment of cheese or may relate generally to all cheese \nto which this Order applies sold by the wholesaler or retailer while \nthe approval remains in force. \nDated at Wellington, this 29th day of September, 1948. \nThe Seal of the Price Tribunal was affixed hereto in the presence \nof— \n[L.S.] \nW.
