The Eastern Side of Portion of Quarry Road, in the County of Waikouaiti, Exempted from the Provisions of Section 128 of the Public Works Act, 1928, Subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government House at Wellington, this 15th day of September, 1948
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waikouaiti County Council on the thirty-first day of May, one thousand nine hundred and forty-eight, viz.:
“That the Waikouaiti County Council, being the local authority having control of the roads in the Waikouaiti County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of the portion of Quarry Road fronting Sections 50 and 51, Block 5, Hawksbury Survey District (title reference, Volume 268, folio 179) ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Quarry Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE
THE eastern side of all that portion of road in the Otago Land District, County of Waikouaiti, known as Quarry Road, fronting Sections 50 and 51, Block V, Hawksbury District. As the same is more particularly delineated on the plan marked P.W.D. 127639, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Varying the Determinations in Respect of the Auckland City Council's Loan of £481,300

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the twenty-second day of March, one thousand nine hundred and forty-eight, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Auckland City Council (hereinafter called the said local authority) of a loan of four hundred and eighty-one thousand three hundred pounds (£481,300), to be known as “ Works Loan, 1947 ” (hereinafter called the said loan) :
And whereas by Order in Council made on the twenty-third day of June, one thousand nine hundred and forty-eight, the determinations aforesaid were varied in respect of portion of the said loan amounting to three hundred and sixty-one thousand three hundred pounds (£361,300) :
And whereas no amount of the said loan has yet been raised, and it is again expedient to vary certain of the determinations in respect of the said loan :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing as follows :—
(1) In lieu of a term of twenty (20) years, as specified in clause one of the Order in Council made on the twenty-third day of June, one thousand nine hundred and forty-eight, in respect of portion of the said loan amounting to three hundred and sixty-one thousand three hundred pounds (£361,300), the term for which such sum or any part thereof may be raised shall be twenty-five (25) years.
(2) In lieu of a rate of interest not exceeding three pounds two shillings and sixpence (£3 2s. 6d.) per centum per annum, as specified in clause two of the Order in Council made on the twenty-third day of June, one thousand nine hundred and forty-eight, in respect of the portion of the said loan amounting to three hundred and sixty-one thousand three hundred pounds (£361,300), the rate of interest that may be paid in respect of such sum or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds five shillings (£3 5s.) per centum per annum.
(3) In lieu of repayment by the half-yearly redemption of debentures, as specified in clause three of the Order in Council made on the twenty-third day of June, one thousand nine hundred and forty-eight, in respect of the portion of the said loan amounting to three hundred and sixty-one thousand three hundred pounds (£361,300), and by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause three of the Order in Council made on the twenty-second day of March, one thousand nine hundred and forty-eight, in respect of the balance of the said loan, the said loan shall be repaid by the half-yearly redemption of debentures in the half-years set out in the first column of the Schedule hereunder of the amounts stated opposite each such half-year in the second column of the said Schedule.

WHEREAS by Order in Council made on the twenty-second day of March, one thousand nine hundred and forty-eight, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Auckland City Council (hereinafter called the said local authority) of a loan of six hundred and twenty-three thousand six hundred pounds (£623,600), to be known as “ Waterworks Development Loan No. 2, 1947 ” (hereinafter called the said loan) :
And whereas an amount of eighteen thousand pounds (£18,000) has been raised subject to the aforesaid determinations :
And whereas by Order in Council made on the twenty-third day of June, one thousand nine hundred and forty-eight, the determinations aforesaid were varied in respect of portion of the said loan amounting to two hundred and forty-three thousand six hundred pounds (£243,600) :
And whereas no further amount of the said loan has yet been raised, and it is again expedient to vary certain of the determinations aforesaid in respect of the said loan :
