Authorizing David McLeod and Charles Leslie Orbell, both of Cass, Sheep-farmers, to use Water from the Grasmere Creek for the Purpose of generating Electricity, and to erect and use Electric Lines in the Tawera County

ORDER IN COUNCIL
At the Government House at Wellington, this 1st day of September, 1948
Present:
His Excellency the Governor-General in Council
Pursuant to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby grant to David McLeod and Charles Leslie Orbell, both of Cass, Sheep-farmers (hereinafter with their successors and assigns referred to as the licensees), as tenants in common in equal shares, a licence, subject to the conditions hereinafter set forth, to take and use from the Grasmere Creek (hereinafter referred to as the said stream), in the County of Tawera, Canterbury Land District, for the purposes hereinafter set forth, a stream of water not exceeding eight cubic feet per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.
CONDITIONS
- IMPLIED CONDITIONS
The conditions directed to be implied in all licences by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
- LICENCE SUBJECT TO REGULATIONS
This licence is issued under the Water-power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, and the Radio Interference Regulations 1934, and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.
- UTILIZATION OF WATER AND LOCATION OF HEADWORKS
The said water shall be used under this licence solely for the purpose of generating electricity up to a maximum capacity of 8 kilowatts, and shall be taken from the said stream at a point in Section 33814, Block I, Grasmere Survey District, Tawera County, as indicated on the plan marked S.H.D. 22, deposited in the office of the Minister in Charge of the State Hydro-electric Department.
- GENERAL DESCRIPTION OF WORKS
The licensees are hereby authorized, subject to the conditions herein contained, to construct, maintain, and use the following works for the purposes of this licence, the position of the said works being indicated on the said plan S.H.D. 22:β
(a) Headworks consisting of dam and necessary intake situated in Section 33814, Block I, Grasmere Survey District:
(b) Water-race leading to the power-house hereinafter referred to, giving a static head of approximately 20 ft., also tail-race from the power-house to the Sarah Creek:
(c) Water-turbine and power-house situated in Section 33814, Block I, Grasmere Survey District, with all necessary equipment for generating electricity:
(d) Electric lines leading from the said power-house across Sections 33814, 6714, 33817, 33819, and 33815, Block I, Grasmere Survey District, and across the West Coast Railway-line, the Craigieburn Road, and the West Coast Road to the licenseesβ homestead and other buildings situated in the said Section 33815, the said lines being more particularly shown by means of black lines on the said plan S.H.D. 22.
- SYSTEM OF SUPPLY
The system of supply shall be as described in paragraphs (d) and (e) of clause 21-01 of the Electrical Supply Regulations 1935. The generating voltage shall be 230 volts, and the transmission voltage shall be 3,300 volts.
- DURATION OF LICENCE
Unless sooner determined, this licence shall continue in force until the 31st day of March, 1969, or until electrical energy is available from an Electric-power Board or other public source of supply, whichever is the earlier.
- RENTAL
For the purpose of assessing the annual rental payable in respect of this licence, the licensees may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and, failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 8 kilowatts.

Authorizing the Wanganui-Rangitikei Electric-power Board to erect, maintain, and use Electric Lines within Part of the Waimarino County

His Excellency the Governor-General in Council
Pursuant to the Public Works Act, 1928, and the Electric-power Boards Act, 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth, subject to the conditions set forth in the First Schedule hereto, hereby authorize the Wanganui-Rangitikei Electric-power Board (hereinafter with its successors and assigns referred to as the licensee) to lay, construct, put up, place, and use the electric lines described in the Second Schedule hereto; and, further, for the purposes of section seventy-six of the Electric-power Boards Act, 1925, subject to the said conditions, doth hereby authorize the licensee to construct and maintain the said electric works.
FIRST SCHEDULE
- IMPLIED CONDITIONS
The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

In respect of the lines hereby authorized, the licensee shall comply with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with any regulations made or to be made in amendment or amplification thereof or in substitution therefor.
- SYSTEM OF SUPPLY
The system of supply shall be as described in paragraphs (a) and (f) of clause 21-01 of the Electrical Supply Regulations 1935. The primary distribution voltage shall be 11,000 volts.
- DURATION OF LICENCE
This licence shall, unless sooner determined, continue in force until the 24th day of October, 1964.
- CHARGES ON SALE
The licensee shall not, in respect of electrical energy supplied by means of the electric lines described in the Second Schedule hereto, make any charge in excess of the corresponding charge which it is authorized to make by the Order in Council dated the 24th day of October, 1922, and published in the Gazette on the 26th day of the same month.
- TIME FOR COMPLETION OF WORKS
The period for the substantial completion of the works hereby authorized shall be three years from the date of this licence.
SECOND SCHEDULE
Lines adapted for the supply of electrical energy by the systems of supply hereinbefore described, within the area described in the Proclamation dated the 18th day of May, 1948, and published in the Gazette on the 27th day of the same month at page 611, the electric lines now proposed to be erected and used being shown by means of red lines and green lines on the plan marked S.H.D. 34, deposited in the office of the Minister in Charge of the State Hydro-electric Department.

Pursuant to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby consent to the assignment to Peter Gervase Markham, of Te Oka, Farmer, of the rights, powers, and privileges under an Order in Council dated the fourteenth day of January, one thousand nine hundred and thirty-two, and published in the Gazette on the twenty-first day of the same month at page 105, authorizing Thomas Feather (senior), of Te Oka, Farmer, to use water for the purpose of generating electricity and to erect and use certain electric lines.
