SCHEDULE

First, the north-eastern side of all that portion of street situated in the Auckland Land District, Borough of Thames, known as Martha Street, fronting Lot 354, Kauaeranga No. 3 Block.

Secondly, the north-eastern side of all that portion of the said street situated in the said land district and borough fronting Lots 357 and 358, Kauaeranga No. 4 Block.

Thirdly, the south-western side of all that portion of the said street situated in the said land district and borough fronting Lots 334A and 291, Kauaeranga Nos. 7 and 8 Blocks.

As the same are more particularly delineated on the plan marked P.W.D. 127411, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

ORDER IN COUNCIL

At the Government House at Wellington, this 4th day of August, 1948

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Thames Borough Council on the eleventh day of November, one thousand nine hundred and forty-seven, in so far as it affects the sides and portions of street described in the Schedule hereto, viz.:

“The Thames Borough Council, being the local authority having control of the streets in the Borough of Thames, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Ash Street adjoining all that piece of land situated in the Borough of Thames, being parts of Kauaeranga E 12 and E 13 Blocks, and being the whole of the land comprised and described in Certificate of Title, Volume 562, folio 229 (limited as to parcels), of the Register-book in the Auckland District Land Registry, and also all that piece of land situated in the Borough of Thames, being part of Kauaeranga E 12 Block, and being the whole of the land comprised and described in Certificate of Title, Volume 562, folio 218 (limited as to parcels), of the Register-book aforesaid;”

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western or south-eastern sides of the portions of Ash Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of street.


SCHEDULE

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Rotorua Borough Council on the seventeenth day of March, one thousand nine hundred and forty-eight, in so far as it affects the portion of street described in the Schedule hereto, viz.:

“The Rotorua Borough Council, being the local authority having the control of the streets in the Borough of Rotorua, hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Lytton Street containing 1 rood 12·6 perches, being a portion of Lot 4 on a plan deposited in the Land Registry Office at Auckland as No. 2494”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portion of Lytton Street (described in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said portion of street.


SCHEDULE

ALL that portion of street situated in the Auckland Land District, Borough of Rotorua, known as Lytton Street, fronting parts of Lot 4, D.P. 2494, being part Section 31, Suburbs of Rotorua. As the same is more particularly delineated on the plan marked P.W.D. 125963, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Officers authorized to take and receive Statutory Declarations

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

Appointing a Member of the Main Highways Board

WHEREAS by a Warrant dated the seventh day of November, one thousand nine hundred and thirty, William Morrison, Farmer, was appointed a member of the Main Highways Board in terms of subsection three, clause (c), of section five of the Main Highways Act, 1922:

And whereas the said William Morrison resigned on the first day of July, one thousand nine hundred and forty-eight:

And whereas William George Belton, Waverley, Farmer, has been recommended by the Executive Body of the New Zealand Counties' Association:

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the Main Highways Act, 1922, and of all other powers and authorities enabling me in this behalf, do hereby appoint the said

William George Belton

to be a member of the Main Highways Board in terms of subsection three, clause (c), of section five of the Main Highways Act, 1922.

As witness the hand of His Excellency the Governor-General, this 2nd day of August, 1948.
