Amending a Proclamation defining the Middle-line of a Further Portion of the Wellington-Napier Railway (Lower Hutt Valley Duplication)

A PROCLAMATION

PURSUANT to the Public Works Act, 1928, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby revoke so much of the Schedule to the Proclamation dated the eleventh day of August, one thousand nine hundred and twenty-five, and published in the New Zealand Gazette No. 59 of the thirteenth day of the same month, at page 2409, defining the middle-line of a railway in Blocks X, IX, and IV, Belmont Survey District—viz., a deviation of the Wellington-Napier Railway (Lower Hutt Valley Duplication)—as defines the middle-line of the said railway between a point marked 13 miles 68 chains on the plan marked P.W.D. 63247 referred to therein and the point of termination of the said middle-line at the chainage marked 16 miles 27 chains on the said plan, and in lieu thereof do hereby proclaim and declare that the middle-line of the said portion of railway shall be that defined and set forth in the Schedule hereto; and I do also declare that this Proclamation, in so far as it refers to the substituted middle-line, shall affect only that land situated within the limits as defined on the plan marked P.W.D. 127106 referred to in the Schedule hereto.

SCHEDULE

COMMENCING in Section 64, Hutt Registration District, Block X, Belmont Survey District, at a point 12 chains from the north boundary of D.P. 12454, which point is marked 13 miles 68 chains on P.W.D. 127106, being the point marked 13 miles 68 chains on plan P.W.D. 63247 on the middle-line of the railway defined in a Proclamation dated 11th August, 1925, and published in the New Zealand Gazette No. 59 of 13th August, 1925, at page 2409; proceeding thence in a north-easterly and then easterly direction generally for a distance of about 3 miles 6 chains, and passing in, into, through, or over the following lands, &c., viz.: Part Section 64, D.P. 13113, being part Section 199, both of Hutt District, Block X, Belmont Survey District; thence crossing the Hutt River into Lots 10, 7, and 8, D.P. 5786, part Section 179, Hutt District; thence along railway land, D.P. 3448, being part Section 178, Hutt District, railway land, Sections 196 and 456, Hutt District, railway land, crossing the Hutt River, Sections 81 and 82, Hutt District, railway land, and Section 83, Hutt District, Block IV, Belmont Survey District; and terminating on railway land at a point marked 16 miles 74 chains opposite Lot 3, D.P. 13292, being part Section 97, Hutt Registration District, Block I, Rimutaka Survey District; including all adjoining and intervening places, lands, reserves, roads, tracks, lakes, rivers, streams, and watercourses: all in the Wellington Land District. As the same is more particularly delineated on the plan marked P.W.D. 127106, deposited in the office of the Minister of Works at Wellington.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 30th day of July, 1948.

A PROCLAMATION

PURSUANT to the Public Works Act, 1928, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the additional land described in the Schedule hereto is hereby taken for a public school and shall vest in the Education Board of the District of Auckland as from the date hereinafter mentioned; and I do also declare that this Proclamation shall take effect on and after the ninth day of August, one thousand nine hundred and forty-eight.

SCHEDULE

APPROXIMATE area of the piece of additional land taken: 1 acre 2 roods 0·1 perches.

Being part Lot 2 on D.P. 28474, being part of Allotments 124 and 337, Taupiri Parish.

Situated in Block X, Hapuakohe Survey District (Auckland R.D.). (S.O. 33608.)

In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 127376, deposited in the office of the Minister of Works at Wellington, and thereon coloured sepia.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 20th day of July, 1948.

A PROCLAMATION

PURSUANT to the Public Works Act, 1928, and section thirty of the Finance Act (No. 2), 1945, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the land described in the Schedule hereto is hereby taken for better utilization; and I do also declare that this Proclamation shall take effect on and after the sixth day of August, one thousand nine hundred and forty-eight.
