And whereas the Land Sales Committee did on the 28th day of January, 1948, make an order determining that the lands described in the said Second Schedule are farm lands suitable for the settlement of a discharged serviceman or of two or more discharged servicemen :

And whereas no appeal from the said Order was made within the time prescribed by the said Act or within any further time allowed by the Court :

And whereas the said lands are not the lands of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Second Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 31st day of May, 1948, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

FIRST SCHEDULE

AUCKLAND LAND DISTRICT

ALL that parcel of land situated in Blocks XV and XVI, Maungakawa Survey District, containing by admeasurement one hundred and ninety (190) acres two (2) roods thirty-three (33) perches, more or less, being all of the land on Deposited Plan 22244, being part of Kiwitahi No. 1A Block, and being all of the land described in certificate of title, Vol. 620, folio 72 (Auckland Registry).

Also all that parcel of land situated in Blocks XV and XVI, Maungakawa Survey District, containing by admeasurement five hundred and twenty (520) acres one (1) rood and thirty-six (36) perches, more or less, being parts of Te Au-o-Waikato No. 2B Section 1 Block, and part of the land on Deposited Plan 6647, being part of Kiwitahi No. 1A Block, and being all of the land described in certificate of title, Vol. 620, folio 73 (Auckland Registry).

SECOND SCHEDULE

AUCKLAND LAND DISTRICT

ALL that area situated in Blocks XV and XVI, Maungakawa Survey District, containing by admeasurement two hundred and thirty (230) acres, more or less, being part of the land on Deposited Plan 6647, being part Kiwitahi No. 1A Block, and being part of the land described in Certificate of Title, Vol. 620, folio 73 (Auckland Registry).

Also all that area situated in Block XV, Maungakawa Survey District, containing by admeasurement eleven (11) acres three (3) roods twenty-five (25) perches, more or less, being part of the land on Deposited Plan 6647, being part Kiwitahi No. 1A Block, and being part of the land described in Certificate of Title, Vol. 620, folio 73 (Auckland Registry). As the same are more particularly delineated in Survey Office plan 33884, lodged in the office of the Chief Surveyor at Auckland, and thereon outlined red.

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice declaring Lands taken for the Settlement of Discharged Servicemen

WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 24 on the 8th day of May, 1947, at page 544 :

And whereas an objection was made by the owners in the manner prescribed by the said Act, objecting to the taking of the said lands and claiming the right to retain part of the said lands :

And whereas the Minister of Lands did not revoke his notice of intention to take the said lands :

And whereas the Land Sales Committee to which the objection was referred did on the 16th day of January, 1948, make an order disallowing such objection and declaring the said lands to be suitable for the settlement of a discharged serviceman or of two or more discharged servicemen :

And whereas an appeal was made against such order by the owners in the manner prescribed by the said Act :

And whereas the owners withdrew such appeal :

And whereas the owners have agreed to an amended vesting-date :

And whereas the said lands are not the lands of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 14th day of July, 1948, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

SCHEDULE

GISBORNE LAND DISTRICT

ALL that parcel of land containing fifteen (15) acres two (2) roods, more or less, situated in Block VII, Patutahi Survey District, being Section 134, Patutahi Rural, and being all the land comprised in certificate of title, Vol. 23, folio 295 (Gisborne Registry).

Also all that parcel of land containing two hundred and sixty-six (266) acres one (1) rood two (2) perches, more or less, situated in Block VII, Patutahi Survey District, being part of Section 92, Patutahi Rural, and being all the land comprised in certificate of title, Vol. 24, folio 12 (Gisborne Registry).

Also all that parcel of land containing one thousand nine hundred and eighty-one (1,981) acres one (1) rood thirty-seven (37) perches, more or less, situated in Block VII, Patutahi Survey District, being Section 97 and part of Section 99, Patutahi Rural, and being all the land comprised in certificate of title, Vol. 28, folio 186 (Gisborne Registry).

Also all that parcel of land containing one thousand and five (1,005) acres, more or less, situated in Blocks VI and X, Patutahi Survey District, being Section 101, Patutahi Rural, and being all the land in certificate of title, Vol. 36, folio 209 (Gisborne Registry).

Also all that parcel of land containing one thousand five hundred and fifty-nine (1,559) acres, more or less, being part of Section 6, Block IX, Patutahi Survey District, and being all the land in certificate of title, Vol. 45, folio 208 (Gisborne Registry).

Also all that parcel of land containing ninety (90) acres three (3) roods and twenty-four (24) perches, more or less, being Lot 2 of Mangaheia No. 1A No. 2 Block and Lot 2 of Mangaheia No. 1A No. 3 Block on Deposited Plan No. 1063, Block XIII, Uawa Survey District, and being all the land comprised in certificate of title, Vol. 35, folio 289 (Gisborne Registry).

Also all that parcel of land containing two thousand nine hundred and twenty-five (2,925) acres three (3) roods and seven (7) perches, more or less, being Lots 2, 3, 4, 5, 6, 16, and 17 on Deposited Plan No. 2711, and part of Lot 7 on Deposited Plan No. 2342, being parts of Mangaheia No. 1D Block, Blocks IX and XIII, Uawa, and XII, Waingaromia Survey Districts, and being all the land comprised in certificate of title, Vol. 65, folio 298 (Gisborne Registry).
