"Special Conditions applying to Sick Leave for Home Service Section

"637. (a) Sick leave may be granted in accordance with the scales and conditions laid down in Regulation 636 in the case of soldiers of the Home Service Section, N.Z. Regular Force, where the sickness is not a recurrence or aggravation of a disability existing on his enlistment in or transfer to the Home Service Section. An application from the soldier’s Commanding Officer for the granting of sick leave under these conditions must be supported by medical certificate to this effect.

"(b) Where sickness of a soldier of the Home Service Section, N.Z. Regular Force, is considered to be attributable to a recurrence or aggravation of a disability existing on his enlistment in or transfer to the Home Service Section, sick leave without pay may be granted in accordance with conditions laid down in Regulation 636.

"Recording of Leave

"638. (a) Upon an officer or soldier being enlisted, Army Headquarters will enter the member’s leave entitlement on the original and duplicated forms N.Z. 6, and will despatch the duplicate to District, &c., Headquarters, who will notify the unit concerned.

"(b) All leave granted will be published in Routine Orders of the unit to which the officer or soldier is posted.

"(c) Individual leave records will be compiled from Routine Orders. The following records will be maintained:—

"(i) Units will maintain a personal leave sheet, which will be attached to the unit personal file.

"(ii) District, &c., Headquarters will maintain a leave record on form N.Z. 6 attached to the duplicate personal file.

"(iii) Army Headquarters will maintain a leave record on form N.Z. 6 attached to the original personal file.

"(d) Where an officer or soldier is transferred from one unit or district to another, the unit personal file will be despatched direct to the new unit. The duplicate personal file will be forwarded via Army Headquarters to the District, &c., Headquarters to which the officer or soldier has been transferred."

  1. Regulation 664 of the principal regulations is revoked.

  2. Paragraph 7 of Appendix VIII of the principal regulations, as amended by Regulations for the New Zealand Military Forces 1927, Amendment No. 35, is revoked and the following substituted:—

"7. (1) Except as otherwise provided by these regulations, every officer or soldier who has been convicted of an offence under sections 4, 7, 12, 16, 18, or 41 of the Army Act shall be liable, at the discretion of the Army Board, to forfeit any war medal (except one awarded for gallantry) of which he may be in possession or to which he may be entitled, together with any annuity, gratuity, or pension appertaining thereto not already paid.

"(2) Every officer or soldier who is, while subject to military law, convicted on indictment by the civil power, shall be liable, at the discretion of the Army Board, to forfeit any war medal (except one awarded for gallantry) of which he may be in possession or to which he may be entitled, including any medal awarded for long service, meritorious service, or efficiency of which he may be in possession or to which he may be entitled, together with any annuity, gratuity, or pension appertaining thereto not already paid.

"(3) Any officer or soldier who is sentenced to death by court-martial or who is dismissed or removed from the service for misconduct shall forfeit any medal awarded for long service, meritorious service (except one awarded for gallantry), or efficiency of which he may be in possession or to which he may be entitled, together with any annuity, gratuity, or pension appertaining thereto not already paid.

"(4) Any war medal or any medal awarded for long service, meritorious service (except one awarded for gallantry), or efficiency forfeited by an officer or soldier may be restored at the discretion of the Army Board. Restoration of a medal, carrying with it an annuity, gratuity, or pension shall entail restoration of the annuity, gratuity, or pension as from the date of restoration of the medal."
