Regulations for the New Zealand Military Forces 1927, Amendment No. 60

In pursuance and exercise of the powers and authorities conferred on me by the Defence Act, 1909, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby amend in the manner and to the extent set forth in the Schedule hereto the Regulations for the New Zealand Military Forces published in the New Zealand Gazette dated the 25th day of May, 1927.

REGULATIONS

  1. THESE regulations may be cited as the Regulations for the New Zealand Military Forces 1927, Amendment No. 60.

  2. These regulations shall be read with and form part of the Regulations for the New Zealand Military Forces 1927, published in the Gazette on the 25th day of May, 1927, at page 1555 (hereunder called the principal regulations).

  3. These regulations shall come into force on the day following notification in the Gazette of the making thereof.

  4. Regulation 129 of the principal regulations, as amended by the Regulations for the New Zealand Military Forces 1927, Amendment No. 57, is further amended by adding the following paragraph:

"(vii) All promotions of officers require the approval of the Minister of Defence."

  1. Regulations 624 to 638 (inclusive) of the principal regulations are revoked and the following substituted:

"LEAVE-N.Z. REGULAR FORCE

"Leave Categories

"624A. Leave is classified as follows:

"Travelling Leave. Overseas Drafting Leave.
"Annual Leave. Overseas Leave.
"Statutory Holidays. Business Leave.
"Week-end Leave. Retiring Leave.
"Compassionate Leave. Sick Leave.
"Examination Leave.

"Application of Leave Scales

"624B. The leave scales as herein laid down apply to all ranks of the N.Z. Regular Force.

"624C. All leave will be inclusive of Sundays but exclusive of statutory holidays, and will be on full pay and allowances unless otherwise stated.

"Bona fide Home

"624D. For the purpose of these regulations, the expression 'bona fide home' means any place in New Zealand which is-

"(a) The place of residence of the wife of a married officer or soldier or, in the case of a widower or officer or soldier divorced or separated (legally or otherwise) and having custody of children, the place of residence as laid down in (c) below.

"(b) (i) The place of residence of the parents or recorded next-of-kin of an unmarried officer or soldier living in camp; or

"(ii) The place of enlistment, provided subparagraph (b) (i) above does not apply.

"(c) The actual place of residence for the time being of an unmarried officer or soldier not living in camp: Provided, however, that if, prior to being employed on full-time service, he normally resided with his parents or in a place of residence maintained by him for his own use (i.e., not as lodger) his home shall be regarded as the place of residence of his parents or the original place of residence maintained, as the case may be.

"Marital Status

"624E. (a) The expression 'married officers or soldiers' includes the following:

"(i) Married officers or soldiers living under normal domestic relationship with their wives.

"(ii) Widowers with children.

"(iii) Officers or soldiers divorced or separated (legally or otherwise) and having custody of children.

"(iv) Officers or soldiers who have a 'reputed wife' and for whom the married scale of pay and allowances has been approved.

"(b) The expression 'unmarried officers or soldiers' includes all those not classed as married in the terms provided above.

"Responsibility of Commanding Officers

"625. Commanding Officers will be responsible that the interests of their subordinates regarding leave are preserved, and that any leave missed through the exigencies of the service is made up without unnecessary delay.

Free Travelling Warrants

"626. (a) Free travelling return warrants from station to bona fide home may be issued at the scale set out below, provided that the journey in one direction, by the most direct surface route, is in excess of fifty miles:

"Single officers or soldiers: One warrant per annum.
"Married officers or soldiers: Two warrants per annum.
"Regular Force Cadets and recruits under nineteen years of age under training in training establishments: Three warrants per annum.
"Recruits over nineteen years of age under training in training establishments may, with the approval of the Adjutant-General, be granted three warrants per annum.

"(b) In addition to the issue of warrants under (a) above, a free travelling return warrant from station to bona fide home may, where the medical officer certifies that in the interest of the Service it is necessary that sick leave be spent at home, be granted in conjunction with sick leave under the conditions as laid down in (a) above.

"(c) Where officers or soldiers return from service overseas they may be granted a free travelling warrant from port of disembarkation to their bona fide home, provided that the period of overseas service is twelve months or more.

"(d) The class of travelling warrant issued will be as laid down in Financial Instructions and Allowance Regulations.

Notification of Address

"627A. Officers or soldiers prior to proceeding on authorized leave will notify their Commanding Officer of their address while on leave, and will subsequently advise any change of address during such leave.

Quitting the Dominion

"627B. Officers or soldiers will not quit the Dominion without permission from Army Headquarters. Application for such permission will be forwarded through the usual channels.

Travelling Leave

"628. When the time taken in travelling by officers or soldiers on annual leave visiting their bona fide homes and returning to station is in excess of forty-eight hours, such excess time will be granted as travelling leave and will not be reckoned as part of their annual leave.

Annual Leave

"629A. Annual leave will be granted as follows:

"(a) Regular Force cadets and recruits under nineteen years of age undergoing training in a training establishment: Thirty days per annum (excluding travelling leave). Others: Twenty-four days per annum (excluding travelling leave).

"(b) On the approval of the Adjutant-General, recruits over nineteen years of age undergoing training in a training establishment may be granted leave as for cadets under nineteen years of age. Instructions will be issued from time to time to cover each group of cases.

Annual Leave Period

"629B. (a) The annual leave period will be from 1st April in any year to 31st March in the following year. All leave due for such period must be taken before the 30th April following such leave period, except as provided in Regulation 629C, or unless approval for deferment is given by the Adjutant-General.

"(b) Annual leave for the leave period during which an officer or soldier is retired will be calculated proportionately on a daily basis according to service during that leave period to the date of commencement of retiring leave.

Accumulation of Annual Leave

"629C. If an officer or soldier desires to accumulate annual leave, he may be allowed to do so for two years only, subject to his giving notice to his Commanding Officer before the 31st July in the year on account of which he desires to accumulate his leave.

Approval of Annual Leave

"629D. (a) Applications for annual leave not exceeding seven days may be approved by Unit Commanders.

"(b) Applications for annual leave in excess of seven days may, on the recommendation of the Unit Commanders, be approved by District (or equivalent) Commanders.

Statutory Holidays

"630A. (a) The following days will be observed as statutory holidays:

"Christmas Day. Easter Monday.
"Boxing Day. Anzac Day.
"New Year's Day. Sovereign's Birthday.
"Good Friday. Labour Day.
"Holy Saturday. Anniversary Day of the Province.

"(b) If leave for a statutory holiday cannot be given, equivalent leave must be granted within one month or the leave will be forfeited.

"(c) Statutory holidays occurring during the retiring leave of an officer or soldier will not be granted in addition to retiring leave.

Week-end Leave

"630B. Leave on Saturdays and Sundays and at night during the week may be granted by Unit Commanders, where military requirements permit, without being a debit against annual leave.
