The Servicemen’s Settlement and Land Sales Act, 1943.—Notice declaring Lands taken for the Settlement of Discharged Servicemen

WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the First Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 19 on the 10th day of April, 1947, at page 439 :
And whereas an objection was made by the owners in the manner prescribed by the said Act objecting to the taking of the said lands and claiming the right to retain part of the said lands :
And whereas the Minister of Lands did not revoke his notice of intention to take the said lands :
And whereas the Minister of Lands did agree to the retention by the owners of the area specified in the said objection :
And whereas the owners have withdrawn the objection to the taking of the lands described in the Second Schedule hereto :
And whereas the owners have agreed to an amended vesting-date :
And whereas the Land Sales Committee did on the 18th day of December, 1947, make an order determining that the lands described in the said Second Schedule are farm lands suitable for the settlement of a discharged serviceman or of two or more discharged servicemen :
And whereas no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court :
And whereas the said lands are not the lands of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :
Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Second Schedule hereto are taken for the settlement of discharged servicemen, and hereby specifies the 31st day of March, 1948, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

FIRST SCHEDULE
AUCKLAND LAND DISTRICT
ALL that parcel of land situated in Blocks XII and XVI, Maungakawa Survey District, and Blocks VIII and XII, Wairere Survey District, containing approximately two hundred and ninety-eight (298) acres, being part of Lot 6, Deposited Plan 64, being part of Te Pae-o-Turawaru No. 2 Block, and being part of the land described in certificate of title, Vol. 17, folio 20 (Auckland Registry), bounded as follows: Commencing at the westernmost corner of the aforesaid Lot 6, and proceeding thence in a north-easterly direction by the north-western boundary of the said Lot 6, 5560 links; thence in a south-easterly direction by the north-eastern boundary of the aforesaid Lot 6, approximately 5000 links; thence in a south-westerly direction by a right line, approximately 2500 links, to a drain; thence in a south-westerly direction generally by that drain and a stream, approximately 3000 links, to a public road; thence in a north-westerly direction generally by the north-eastern sides of the aforesaid road, approximately 7300 links, to the point of commencement.
Also all that parcel of land situated in Blocks XII and XVI, Maungakawa Survey District, and Block XII, Wairere Survey District, containing approximately two hundred (200) acres, being part of Lot 7, Deposited Plan 64, being part of Te Pae-o-Turawaru No. 2 Block, and being part of the land described in certificate of title, Vol. 789, folio 253 (Auckland Registry), bounded as follows: Commencing at the westernmost corner of the aforesaid Lot 7 and proceeding thence in a north-easterly direction by the north-western boundary of the said Lot 7, 4840 and 255·9 links; thence in a south-easterly direction generally by the south-western sides of a public road, approximately 5800 links; thence in a south-westerly direction generally by a fence, approximately 1200 links, and by a drain, approximately 3300 links, to the Piakoiti Stream; thence in a north-westerly direction generally by the aforesaid Piakoiti Stream, approximately 6000 links, to the point of commencement.
As the same are more particularly delineated on the plan marked L. and S. 2963, deposited in the Head Office, Lands and Survey Department, at Wellington, and thereon edged red.

SECOND SCHEDULE
AUCKLAND LAND DISTRICT
All that parcel of land situated in Blocks XII and XVI, Maungakawa Survey District, and Blocks VIII and XII, Wairere Survey District, containing by admeasurement two hundred and thirteen (213) acres three (3) roods twenty (20) perches, more or less, being part of Lot 6, Deposited Plan 64, being part of Te Pae-o-Turawaru No. 2 Block, and being part of the land described in certificate of title, Vol. 872, folio 160 (Auckland Registry).
Also all that parcel of land situated in Blocks XII and XVI, Maungakawa Survey District, and Block XII, Wairere Survey District, containing by admeasurement two hundred and eight (208) acres one (1) rood twenty (20) perches, more or less, being part of Lot 7, Deposited Plan 64, being part of Te Pae-o-Turawaru No. 2 Block, and being part of the land described in certificate of title, Vol. 789, folio 253 (Auckland Registry). As the same are more particularly delineated on a plan lodged in the office of the Chief Surveyor at Auckland under No. S.O. 33838.

Alteration of Closed Season.—Waitakerei Forest Fire District
—
WHEREAS by notice published in the Gazette of the 24th day of January, 1929, at page 184, an area comprising 57,200 acres in Kumeu, Waitemata, Waitakerei, and Titirangi Survey Districts, Auckland Land District, was declared to be a fire district, and known as the Waitakerei Forest Fire District (hereinafter referred to as the said district) :
And whereas the period from the 1st day of January to the 31st day of March in any year (inclusive) was specified as the period (hereinafter referred to as the said closed season) for the said district during which it shall not be lawful for any person, save pursuant to the written permit of a Forest Officer, to set on fire or cause to be set on fire any timber (whether standing or not), or any undergrowth, or any debris from forest operations or land-clearing operations, or any grass or other specially inflammable material without taking such precautions as may be prescribed by a Forest Officer :
And whereas it is expedient that the closing-date for the said closed season for the said district be altered for the year 1948 :
Now therefore, in pursuance of section 27 of the Forests Act, 1921–22, I do hereby specify that the closed season for the said district is hereby extended to the 30th day of April, 1948 (inclusive).

Previous Notice: No. 9 of 1948 hereby cancelled.
Position: Lat., 40° 31′·3 S.; long., 173° 02′·5 E. (approx.).
Details: An examination of the area failed to reveal any trace of shoaling. Soundings when approaching, examining, and leaving the area correspond with charted depths.
A bank which has always existed in an approximate position 000° three-quarters of a mile from the lighthouse gave a least depth of 3¼ fathoms M.L.W.S.
