Declaring Number of Members and Apportioning Representation on the Otago Catchment Board

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 17th day of March, 1948

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to the Soil Conservation and Rivers Control Act, 1941, and to section twenty of the Local Government Commission Act, 1946, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the Otago Catchment Board shall consist of ten elective members and five non-elective members, and that the number of such elective members to be representative of each separate constituent district or combined district within the catchment district on the said Board shall be the number specified in the Schedule hereto opposite the name of that constituent district or group of names of constituent districts comprising a combined district, and doth further declare that each group of constituent districts the names of which are bracketed together in the first column of the Schedule hereto is hereby constituted a combined district for the purposes of the said Acts, and that the principal local authority of each such combined district shall be the local authority of the district distinguished in the first column of the Schedule hereto by the letter \"(P)\".

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and with the consent of the licensee, doth hereby revoke the Order in Council dated the fifteenth day of October, one thousand nine hundred and thirty-four, and published in the Gazette on the eighteenth day of the same month, at page 3330, authorizing Robert Thomson, of Poerua, Greymouth, to use water for the purpose of generating electricity.

The Crown Lands (Shirley) Building-line Restriction Regulations 1948

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section forty-one of the Statutes Amendment Act, 1946, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS

  1. These regulations may be cited as the Crown Lands (Shirley) Building-line Restriction Regulations 1948.
  2. These regulations shall apply to the land described in the Schedule hereto (hereinafter referred to as the said land).
  3. No building or part of a building shall at any time be erected on the said land within a distance of forty-eight feet from the centre-line of portion of a proposed street to be known as Cargill Place.

SCHEDULE
Canterbury Land District

ALL that area containing by admeasurement 2 acres and 36.7 perches, more or less, being Sections 5, 6, 7, 8, 9, 10, 17, 18, 19, 20, 21, and 22, as shown on plan recorded in the office of the Chief Surveyor at Christchurch as S.O. 7931, being part Lot 53, Deposited Plan 7712, part Rural Section 325, City of Christchurch, and being part of the land contained in Certificate of Title, Volume 493, folio 234 (Canterbury Registry). As the same is more particularly delineated on the plan marked L. and S. 22/4812/9A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Vesting the Control of Scenic Reserves in the Pounawea Scenic Reserves Board

IN pursuance and exercise of the powers and authorities conferred upon him by the Scenery Preservation Act, 1908 (hereinafter referred to as the said Act), His Excellency the Governor-General of the Dominion of New Zealand doth hereby revoke a Warrant dated the eighteenth day of January, one thousand nine hundred and forty-four, and published in the Gazette of the twentieth day of that month, vesting the control of scenic reserves in the Pounawea Scenic Reserves Board, and doth hereby vest the control of the scenic reserves described in the Schedule hereto (being land reserved under the said Act) for the period of five years from the date hereof (unless previously altered or revoked under the said Act) in the undermentioned persons, namely,β€”

The Catlins Riding member of the Clutha County Council, ex officio,
Isaac Gordon Dryden,
James Henry Richard Pagey,
John Reid Wilson,
Arthur Henry Bates Brough,
Allan Mitchell,
James Frederick Wratten,
Joseph Alexander Bower, and
Henry Arthur Sell,
who are hereby constituted for that purpose a special Board by the name of the Pounawea Scenic Reserves Board (herein referred to as the Board), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say :β€”

  1. The first meeting of the Board shall be held on Monday, the fifteenth day of March, one thousand nine hundred and forty-eight, at eight o'clock p.m., at Pounawea, and thereafter the Board shall meet for the transaction of business on the second Monday in each quarter at the time and place aforesaid, or at such other time or place as may from time to time be fixed by the Board.
