Validating Proceedings in Connection with the Akaroa Borough Council's Loan of £1,500

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 11th day of February, 1947
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
WHEREAS the Akaroa Borough Council lately proceeded by way of special order to raise a loan of one thousand five hundred pounds (£1,500), to be known as “Bridge Replacement Loan, 1946” (hereinafter called the said loan):
And whereas the proceedings in connection with the said loan were irregular or defective in that although public notification of the subsequent meeting confirming the resolution as required by paragraph (c) of section sixty-two of the Municipal Corporations Act, 1933, as set out in paragraph (a) of section five of the Municipal Corporations Amendment Act, 1938, was given twice with an interval of not less than fourteen days between each, the notifications were not given within the period of twenty-eight days immediately preceding the date of such subsequent meeting:
And whereas it appears that the ratepayers of the district have not been misled by such irregularity or defect as aforesaid, and it is expedient to validate the same:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and twenty-two of the Local Bodies' Loans Act, 1926, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the said public notifications had been correctly given, and that the validity of the proceedings in connection with the said loan, or of the security for the said loan, shall not be called in question by reason only of the irregularity aforesaid.

Varying the Determinations in respect of the Wellington City Council's Loan of £16,400

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
WHEREAS by Order in Council made on the eighteenth day of December, one thousand nine hundred and forty-six (hereinafter referred to as the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Wellington City Council (hereinafter referred to as the said local authority) of a loan of sixteen thousand four hundred pounds (£16,400), to be known as “Anderson Park Restoration Loan, 1946” (hereinafter referred to as the said loan):
And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that in lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause three of the said Order in Council, the said local authority shall, before raising the said loan or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies' Loans Act, 1926, or under such other statutory enactment as may be applicable, and shall thereafter make payments to such sinking fund at intervals of not more than one year at a rate or rates per centum which shall be not less than nine pounds ten shillings (£9 10s.), such payments to be made in respect of every part of the said loan for the time being so borrowed and not repaid, the first such payment to be made not later than one year after the first day from which interest to the lender or lenders is computed on the said loan or any part thereof so raised.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the assignment to John McGregor Turnbull, of Dillondale, Kaikoura, Sheep-farmer, by Walter Scott, of Dillondale, Kaikoura, Farmer, of his rights, powers, and privileges under an Order in Council dated the sixteenth day of February, one thousand nine hundred and thirty-eight, and published in the Gazette on the seventeenth day of the same month, authorizing the said Walter Scott to use water for the purpose of generating electricity and to erect certain electric lines.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the additional land described in the Schedule hereto being taken for Post and Telegraph purposes.

APPROXIMATE area of the piece of additional land permitted to be taken: 31·92 perches.
Being Allotment 195 of Section 1, Town of Tauranga.
Situated in Block X, Tauranga Survey District (Borough of Tauranga) (Auckland R.D.). (S.O. 33256.)
