Price Order No. 823 (Amendment No. 2 of Price Order No. 739)
(Chocolates)
PURSUANT to the powers conferred on it by the Control of Prices Act, 1947, the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following amending Price Order:
- This Order may be cited as Price Order No. 823, and shall be read together with and deemed part of Price Order No. 739* (hereinafter referred to as the principal Order).
- This Order shall come into force on the 20th day of December, 1947.
- The Schedule to the principal Order is hereby amended as follows:-
(a) In its reference to Chocolates (assortments, loose)-By inserting after the words "Lady Baltimore", the words "and Centennial Assortment".
(b) In its reference to Chocolates (small-box lots)--
(i) By inserting before the words "Lady Baltimore" the words "Centennial Assortment".
(ii) By deleting the words "Dessert Mints" and inserting the same words after the words "Winning Post".

Price Order No. 824 (Bananas)
PURSUANT to the powers conferred on it by the Control of Prices Act, 1947, the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:-
- This Order may be cited as Price Order No. 824, and shall come into force on the 29th day of December, 1947.
- (1) Price Order No. 119* is hereby revoked.
(2) The revocation of the said Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.
APPLICATION OF THIS ORDER - This Order applies with respect to all bananas sold by way of retail in New Zealand.
FIXING MAXIMUM RETAIL PRICES OF BANANAS - (1) The maximum price that may be charged or received by any retailer for any bananas to which this Order applies shall be determined as follows:-
(a) With respect to bananas sold at any place within the metropolitan areas of Auckland, Wellington, Christchurch, or Dunedin: At the rate of 7Β½d. per pound:
(b) With respect to bananas sold elsewhere in New Zealand: At the rate of 8d. per pound.
(2) If in respect of any lot of bananas the price calculated in accordance with the foregoing provisions of this clause is not an exact number of pence or half-pence, the maximum price of the lot shall be computed to the nearest upward halfpenny.
PROVISION FOR SPECIAL PRICES - Notwithstanding anything to the contrary in the foregoing provisions of this Order, and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any retailer, may authorize special maximum prices in respect of any bananas to which this Order applies where for any reason extraordinary charges (freight or otherwise) are incurred by the retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of bananas or may relate generally to all bananas to which this Order applies sold by the retailer while the approval remains in force.
DUTY IMPOSED ON RETAILERS - Every retailer who offers or exposes for sale in any shop any bananas to which this Order applies shall keep in a prominent position in such proximity to the bananas to which it relates as to be obviously in relation thereto a ticket, placard, or label on which shall be stated in legible and prominent characters the retail price per pound of the bananas.

DEFINITION OF METROPOLITAN AREAS
Name of Metropolitan Area. Districts included therein.
Auckland The City of Auckland, the boroughs of Birkenhead, Devonport, Ellerslie, Mount Albert, Mount Eden, New Lynn, Newmarket, Northcote, Onehunga, One Tree Hill, Otahuhu, and Takapuna, and the road districts of Mount Roskill, Mount Wellington, and Panmure Township.
Wellington The cities of Wellington and Lower Hutt, the boroughs of Eastbourne and Petone, and the Town District of Johnsonville.
Christchurch The City of Christchurch and the boroughs of Lyttelton and Riccarton.
Dunedin The City of Dunedin and the boroughs of Green Island, Port Chalmers, St. Kilda, and West Harbour.
