“(o) The employee shall duly procure term reports on his
attendance and progress to be obtained from the
University college he is attending and produced to the
General Manager, and if at any time any such reports
show, in the General Manager’s opinion, that the
employee is abusing the concession granted to him
under this regulation, or that he is not utilizing it
to the best of his ability, or if the exigencies of the
Department at any time so require, the General
Manager may terminate the special leave forthwith:
“(p) The employee shall not resign from or leave the Department during the period of his special leave or during
the period of five years next following the expiration
thereof otherwise than by way of retirement with the
consent or by the direction of the Minister on the
ground of being medically unfit for further duty.”
(2) This regulation shall be deemed to have come into force
on the 3rd day of March, 1947.
- Regulation 147 of the principal regulations is revoked, and
the following regulation is substituted :-
“147. (1) In this regulation--
“‘Dependent children’ means such of a retiring member’s
own children, stepchildren, and legally adopted
children as, in the opinion of the General Manager,
are substantially dependent upon the income of such
retiring member for their maintenance and who-
“ (a) If male are under eighteen years of age, or
if female are unmarried; and
“(b) Reside at the home of the retiring member
or solely for educational purposes reside for a portion
of the year elsewhere than at that home :
“‘Retiring member’ means a member who has completed
his last day on duty in the service of the Department
and who, on his retirement from the service-
“ (a) Becomes entitled to receive a retiring-
allowance under the provisions of Part III of the
Act ; or
“ (b) Would be entitled to receive a retiring-
allowance under the provisions of Part III of the
Act had he been a contributor at the time of his
retirement; or
“ (c) Would be entitled to receive a retiring-
allowance under the provisions of Part III of the
Act had he not, on his retirement, or before receiving
his first instalment of retiring-allowance, elected to
receive a refund of his contributions.
“(2) A retiring member who is granted retiring leave on full
pay may, on application, be granted free passes available over all
the Government railway-lines open for traffic in favour of his wife
and dependent children. Such free passes shall be available for a
period not exceeding three months, which period of availability
may commence at any date not later than six months after the date
on which the retiring member’s retiring leave commences.”
- Regulations 155, 156, and 157 of the principal regulations
are revoked, and the following regulation is substituted :-
“155. (1) In this regulation--
“‘Retired member’ means a member who has retired
from the service of the Department and who-
“ (a) Is in receipt of a retiring-allowance under
the provisions of Part III of the Act ; or
“ (b) Would on retirement have been entitled to
receive a retiring-allowance under the provisions of
Part III of the Act had he been a contributor at
the time of his retirement; or
“ (c) Would be in receipt of a retiring-allowance
under the provisions of Part III of the Act had he
not, on his retirement, or before receiving his first
instalment of retiring-allowance, elected to receive a
refund of his contributions :
“‘Deceased member’ means a person who, at the time of
his death, was a member of the Department :
“‘Deceased retired member’ means a person who, at the
time of his death, was a retired member :
“‘Housekeeper’ means a person—
“(a) Who resides with a retired member who is
not married, or, if married, is not living with his wife
or her husband, and who is a bona fide householder;
and
“(b) Whose sole occupation is to keep house for
such retired member; and
“(c) Who is not substantially dependent upon
the income of a person other than such retired
member:
“Provided that if any question arises as to
whether any person is a ‘housekeeper’ within the
meaning of this definition or as to whether any
retired member is a bona fide householder, it shall be
determined by the General Manager.
“‘Month’ means a named month of the year.
“PRIVILEGE TICKETS FOR RETIRED MEMBERS AND THEIR
FAMILIES
“(2) Privilege-ticket orders may, on the application of a
retired member, be issued in favour of himself and his wife or
housekeeper. The retired member and his wife or housekeeper
shall each be entitled to receive not more than fifty-two privilege-
ticket orders in any year.

“(3) Privilege-ticket orders may, on the application of a
retired member, be issued in favour of those of his children, or his
legally adopted children, who are under sixteen years of age and
who reside at the home of such retired member or who come within
the provisions of clause (8) hereof. No such child shall be entitled
to receive more than one such order in any month.
“PRIVILEGE TICKETS FOR WIDOWS AND CHILDREN OF DECEASED
RETIRED MEMBERS
“(4) Privilege-ticket orders may, on the application of the
widow of a deceased retired member, be issued in favour of herself
during her widowhood. No such widow shall be entitled to receive
more than fifty-two such orders in any year.
“(5) Privilege-ticket orders may be issued to those of the
children, or legally adopted children, of a deceased retired member
who are under sixteen years of age and who-
“(a) If he leaves a widow surviving him-
“(i) Reside at the home of the widow or who
come within the provisions of clause (8) hereof; or
“(ii) Resided at the home of the widow until
her death or who, until her death, came within the
provisions of clause (8) hereof; or
“(b) If he leaves no widow surviving him: Resided at the
home of the deceased retired member during his
lifetime or who, during such time, came within the
provisions of clause (8) hereof.
“No such child shall be entitled to receive more than one such
order in any month. The orders may be issued on the application
of the widow or of the person normally in charge of the children,
as the case may be. Such issue shall cease upon remarriage of
the widow.
“PRIVILEGE TICKETS FOR WIDOWS AND CHILDREN OF DECEASED
MEMBERS
“(6) Privilege-ticket orders may, on the application of the
widow of a deceased member, be issued in favour of herself during
her widowhood. No such widow shall be entitled to receive more
than fifty-two such orders in any year.
“(7) Privilege-ticket orders may be issued to those of the
children, or legally adopted children, of a deceased member, who
are under sixteen years of age and who-
“(a) If he leaves a widow surviving him-
“(i) Reside at the home of the widow or who
come within the provisions of clause (8) hereof; or
“(ii) Resided at the home of the widow until
her death or who, until her death, came within the
provisions of clause (8) hereof; or
“(b) If he leaves no widow surviving him: Resided with the
deceased member during his lifetime or who, during
such time, came within the provisions of clause (8)
hereof.
“Children under fourteen years of age shall be entitled to
receive not more than fifty-two privilege-ticket orders in any year,
and children fourteen years of age or more but under sixteen years
of age shall be entitled to receive one such order in any month.
The orders may be issued on the application of the widow or of the
person normally in charge of the children, as the case may be.
Such issue shall cease upon remarriage of the widow.
“CHILDREN OF RETIRED MEMBERS, DECEASED RETIRED MEMBERS,
OR DECEASED MEMBERS RESIDING AWAY FROM HOME SOLELY
FOR EDUCATIONAL PURPOSES
“(8) A child of a retired member, a deceased retired member,
or a deceased member who, solely for educational purposes, resides
for a portion of the year elsewhere than at the home of the retired
member, or of the widow of the retired member or member, or of
the person normally in charge of the child, as the case may be,
shall not be debarred from receiving privilege-ticket orders if the
child is otherwise eligible to receive such orders.
“PRIVILEGE TICKETS FOR STEPCILDREN
“(9) Privilege-ticket orders may, at the discretion of the
General Manager, be issued in favour of the stepchildren of a retired
member, a deceased retired member, or a deceased member, on the
conditions appropriate to and governing the issue of privilege-
ticket orders to children, or legally adopted children, subject to
such modifications as the General Manager may deem fit.
“PRIVILEGE TICKETS FOR RETIRED TEMPORARY EMPLOYEES AND
THEIR WIVES
“(10) (a) Privilege-ticket orders may, on the application of a
retired temporary employee, be issued in favour of himself and his
wife. The retired temporary employee and his wife shall each be
entitled to receive not more than fifty-two privilege-ticket orders in
any year.
“(b) For the purposes of this clause and clause (13) hereof
‘retired temporary employee’ means a person-
“(i) Whose last continuous period of service in the Depart-
ment was as a temporary employee and was not less
than ten years in duration; and
“(ii) Who attained the age of sixty years prior to the termi-
nation of such last continuous period of service; and
“(iii) Whose services in the Department were dispensed with
through no fault of such employee or who voluntarily
retired from the service.
