Consenting to the Raising of Portion (£50,000) of the Bay of Islands Electric-power Board's Loan of £200,000 and prescribing the Conditions thereof

At the Government House at Wellington, this 3rd day of September, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Bay of Islands Electric-power Board (hereinafter called the said local authority) is desirous of raising the sum of fifty thousand pounds (£50,000) (hereinafter called the said sum), being portion of a loan of two hundred thousand pounds (£200,000), known as “Additional Areas Loan, 1945,” authorized by a poll of ratepayers taken on the twenty-seventh day of October, one thousand nine hundred and forty-five, for the purpose of arranging for the supply and distribution of electric energy for the benefit of all that area of land included in the Bay of Islands Electric-power District by a Proclamation dated the fifteenth day of December, one thousand nine hundred and forty-one, comprising the whole of the Counties of Whangaroa and Hokianga as present constituted and by a Proclamation dated the twelfth day of April, one thousand nine hundred and forty-five, comprising that portion of the Mangonui County as described in the Schedule thereto, and for such purpose to do all or any of such matters and things as the said local authority is empowered to do by the Electric-power Boards Act, 1925, and the amendments thereto, and in respect of which works guarantees as described in clauses twenty-one to forty-three of the Electrical Supply Regulations 1935 have first been given in favour of the said local authority for payments amounting in each of not less than five (5) consecutive years from the completion of such works to at least fourteen (14) per centum of the estimated capital cost of such works, and for providing financial assistance to consumers and for trading purposes as provided in section one hundred and eighteen of the Electric-power Boards Act, 1925 :

And whereas the said local authority has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said sum :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum for the said purpose up to the amount of fifty thousand pounds (£50,000), and in giving such consent doth hereby determine as follows :—

(1) The term for which the said sum or any part thereof may be raised shall not exceed twenty-five (25) years.

(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds five shillings (£3 5s.) per centum per annum.

(3) The said sum shall be free of principal repayments during the first year from the date of the borrowing thereof.

(4) Thereafter the said sum, together with interest thereon, shall be paid by equal aggregate annual or half-yearly instalments extending over the balance of the term amounting to twenty-four (24) years.

(5) The payment of interest for the first year and thereafter the payment of the instalments of principal and interest shall be made in New Zealand.

(6) No interest after the first year and no instalments of principal and interest shall be paid out of loan-moneys.

(7) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(8) No money shall be borrowed under this consent after the expiration of two years from the date hereof.

Appointing the Transport Appeal Authority under the Transport Licensing Act, 1931

IN pursuance and exercise of the powers conferred on him by the Transport Licensing Act, 1931, and section eighty-two of the Statutes Amendment Act, 1941, His Excellency the Governor-General doth hereby appoint His Honour Judge Kendrick Gee Archer, of Wellington, to be the Transport Appeal Authority for a term commencing on the first day of October, one thousand nine hundred and forty-seven, and expiring on the thirty-first day of December, one thousand nine hundred and forty-seven.

As witness the hand of His Excellency the Governor-General, this 8th day of September, 1947.

Officers authorized to take and receive Statutory Declarations

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

Revoking a Sanctuary under the Animals Protection and Game Act, 1921–22, Otago Acclimatization District

PURSUANT to section six of the Animals Protection and Game Act, 1921–22 (hereinafter referred to as the said Act), I, Lieutenant General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby revoke the Warrant made under the said section on the twentieth day of February, one thousand nine hundred and twenty-nine, and published in the Gazette of the twenty-first day of the same month, at page 445, declaring certain areas to be sanctuaries under the said Act, in so far as that Warrant relates to the area included under the heading “Otago Acclimatization District” and described in the Schedule hereto.

SCHEDULE

CERTAIN land in Tarras Survey District: All that area in the Otago Land District, the property of Mrs. E. Oliver, of Bendigo, being Section 7, Block III, Tarras Survey District, containing by admeasurement 200 acres, more or less.

Member appointed to Lake Kaniere Scenic Board

WHEREAS by a Warrant dated the fifth day of November, one thousand nine hundred and forty-five, and published in the Gazette of the eighth day of that month, the control of a certain reserve in the Westland Land District, known as the Lake Kaniere Scenic Reserve, was vested in certain persons therein named, who were by the said Warrant constituted a special Board by the name of the Lake Kaniere Scenic Board, in pursuance of section thirteen of the Scenery Preservation Act, 1908: And whereas it is desirable that Arnold Edward Perry should be appointed a member of the said Board in place of Charles Lawrence Harper, who has resigned :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred on him by section thirteen of the Scenery Preservation Act, 1908, and of all other powers and authorities enabling him in this behalf, doth hereby appoint the said

Arnold Edward Perry

to be a member of the Lake Kaniere Scenic Board constituted by the Warrant dated the fifth day of November, one thousand nine hundred and forty-five, hereinbefore referred to, in place of the said Charles Lawrence Harper.
