Varying the Determinations in respect of the Thames Valley Electric-
power Board's Loan of £100,000

At the Government House at Wellington, this 27th day of August, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the fifteenth day of January, one thousand nine hundred and forty-seven (hereinafter referred to as the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Thames Valley Electric-power Board (hereinafter referred to as the said local authority) of a loan of one hundred thousand pounds (£100,000), to be known as “ Extension Loan, 1946 ” (hereinafter referred to as the said loan) :

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that in lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause three of the said Order in Council, the said loan or any part thereof shall be repaid by equal half-yearly instalments of principal extending over the term of the loan as determined in clause one of the said Order in Council.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the seventeenth day of April, one thousand nine hundred and forty-six (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Waimate Borough Council (hereinafter called the said local authority) of a loan of nineteen thousand pounds (£19,000), to be known as “ Housing Loan No. 1, 1945 ” (hereinafter called the said loan) :

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary certain of the determinations aforesaid in respect of the said loan :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing that in lieu of a term not exceeding fifteen (15) years, as set out in clause one of the said Order in Council, the term for which the said loan or any part thereof may be raised shall not exceed twenty-five (25) years.

Varying the Determinations in respect of Loans, or Portions thereof, being raised by the Dunedin City Council

At the Government House at Wellington, this 27th day of August, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Orders in Council made on the respective dates set out in the second column of the Schedule hereto, consent was given to the raising by the Dunedin City Council (hereinafter referred to as the said local authority) of the respective loans or portions thereof specified in the first column of the said Schedule, subject in each case to the determinations set forth in such Orders in Council :

And whereas by Order in Council made on the eleventh day of July, one thousand nine hundred and forty-five, the period within which each loan might be raised was extended to the twenty-seventh day of August, one thousand nine hundred and forty-seven, in respect of the sum then unraised :

And whereas in respect of each such loan the sum specified in the third column of the said Schedule opposite such loan (hereinafter referred to as the said sum) has still not yet been raised, and it is expedient to again vary the determinations in respect of each such loan in so far as such determinations apply to the raising of the said sum by again extending the term within which the said sum or any portion may be raised :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby, in respect of each loan referred to in the Schedule hereto, vary the determinations in respect of the raising of such laon, in so far as such determinations apply to the raising of the said sum, by prescribing that no moneys shall be borrowed under the respective Order in Council after the twenty-seventh day of August, one thousand nine hundred and forty-nine.

PURSUANT to section one hundred and sixty-seven of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the fourth day of April, one thousand nine hundred and thirty-two, and published in the Gazette on the seventh day of April, one thousand nine hundred and thirty-two, at page 735, and affecting Hauturu East B 2 Section 2A 1A and other blocks by excluding therefrom the lands described in the Schedule hereto.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes of a hospital (nurses' home).

SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken: 10 acres 1 rood 5·5 perches.

Being part Sections 8, 9, and 10, Block I, D.Ps. 539 and 1769, Upper Kaikorai District, and being the whole of the land comprised and described in Certificate of Title, Volume 140, folio 270 (Otago Land Registry).
