Authorizing the Acquisition of Land notwithstanding the Provisions
as to Limitation of Area

ORDER IN COUNCIL

At the Government House at Wellington, this 27th day of
August, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section two hundred and forty-six of the Native
Land Act, 1931, His Excellency the Governor-General, acting
by and with the advice and consent of the Executive Council, doth
hereby authorize the acquisition by the New Zealand Loan and
Mercantile Agency Company, Limited, of an undivided half-share
in the freehold of the land described in the Schedule hereto,
notwithstanding the provisions of Part XII of the said Act.

SCHEDULE

ALL that piece of land containing 6 acres, more or less, being all the
land in Deposited Plan 12641, and being part Section 1A, Block XVI,
Rotorua Survey District, and being the whole of the land comprised
in Certificate of Title, Volume 300, folio 282 (Auckland Registry).

Authorizing the Laying-off of a Street off Mountain Road, in the
City of Auckland, of a Width less than 66 ft., but not less than
40 ft., subject to a Condition as to the Building-line

At the Government House at Wellington, this 3rd day of
September, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Municipal Corporations Act, 1933, and the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
authorize the Auckland City Council to permit the laying-off of the
proposed street described in the Schedule hereto of a width less
than sixty-six feet, but not less than forty feet, subject to the
condition that no building or part of a building shall at any time
be erected on the residue of Lot 1 on D.P. 28400 or on Lot 2 on
D.P. 28400, being parts Allotment 58 of Section 6, Suburbs of
Auckland, within a distance of thirty-three feet from the centre-
line of the said street.

SCHEDULE

THAT proposed street in the North Auckland Land District, City of
Auckland, containing by admeasurement 3 roods 11 perches, more
or less, being parts Lots 1 and 2, D.P. 28400, being parts Allotment
58 of Section 6, Suburbs of Auckland. As the same is more particu-
larly delineated on the plan marked P.W.D. 125955, deposited in
the office of the Minister of Works at Wellington, and thereon
coloured red.

of a Width less than 66 ft., but not less than 40 ft., subject to a
Condition as to the Building-line

September, 1947

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Municipal Corporations Act, 1933, and the
Public Works Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said Dominion,
doth hereby authorize the West Harbour Borough Council to permit
the laying-off of the proposed street described in the Schedule
hereto of a width less than sixty-six feet, but not less than forty
feet, subject to the condition that no building or part of a building
shall at any time be erected on Lots 1, 2, 3, 5, 6, 7, 8, 9, 10, or 11
of a subdivision of the land fronting the said street, as shown on
the plan referred to in the Schedule hereto, within a distance of
forty-eight feet from the centre-line of the said street.

SCHEDULE

THAT proposed street in the Otago Land District, Borough of West
Harbour, containing by admeasurement 1 rood 30 perches, more
or less, being part Section 28, Sawyer's Bay District. As the same
is more particularly delineated on the plan marked P.W.D. 125564,
deposited in the office of the Minister of Works at Wellington, and
thereon coloured red.

The Southern Side of Portion of District Road, in the Borough of
West Harbour, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the Building-
line

At the Government House at Wellington, this 3rd day of
September, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the West Harbour
Borough Council on the fifth day of August, one thousand nine
hundred and forty-seven, viz. :

“The West Harbour Borough Council, being the local
authority having control of the streets in the Borough of West
Harbour, by resolution declares that the provisions of section
one hundred and twenty-eight of the Public Works Act, shall
not apply to the southern side of that portion of District Road
fronting part Lot 1, D.P. 237, Extension of Township of
Ravensbourne ”;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of the
portion of District Road (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said portion
of street.

SCHEDULE

THE southern side of all that portion of street situated in the Otago
Land District, Borough of West Harbour, known as District Road,
fronting part Lot 1, D.P. 237, Extension of Township of Ravens-
bourn. As the same is more particularly delineated on the plan
marked P.W.D. 125470, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.

in the office of the Minister of Works at Wellington, and thereon
coloured red.
