Consenting to the Raising of a Loan of £120,730 by the Christchurch City Council and prescribing the Conditions thereof

ORDER IN COUNCIL
At the Government House at Wellington, this 23rd day of July, 1947
Present:
His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the Christchurch City Council (hereinafter called the said local authority) proposes, pursuant to the terms of a requisition issued under section twenty-two of the Health Act, 1920, to raise a loan of one hundred and twenty thousand seven hundred and thirty pounds (£120,730), to be known as "Water-supply Extension Loan, 1947" (hereinafter called the said loan), for the purpose of providing waterworks for the purpose of extending the water-supply of the Christchurch City Council:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of one hundred and twenty thousand seven hundred and thirty pounds (£120,730), and in giving such consent doth hereby determine as follows:-
(1) The term for which the said loan or any part thereof may be raised shall not exceed thirty (30) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds (£3) per centum per annum.
(3) The said loan or any part thereof shall be repaid by the annual redemption of debentures in the years set out in the first column of the Schedule hereunder of the amounts stated opposite each such year in the second column of the said Schedule.

(4) The payment of interest and the redemptions in respect of the said loan shall be made in New Zealand.
(5) No amount payable either as interest or as a redemption in respect of the said loan shall be paid out of loan-moneys.
(6) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(7) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the Dannevirke Borough Council (hereinafter called the said local authority) proposes, pursuant to the terms of a requisition issued under section twenty-two of the Health Act, 1920, to raise a loan of fourteen thousand one hundred and seventy pounds (£14,170), to be known as "Drainage and Sewerage Loan, 1947" (hereinafter called the said loan), for the purpose of providing for the more urgent renewal works in respect of defective and collapsed sewers:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of fourteen thousand one hundred and seventy pounds (£14,170), and in giving such consent doth hereby determine as follows:-
(1) The term for which the said loan or any part thereof may be raised shall not exceed twenty (20) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds five shillings (£3 5s.) per centum per annum.
(3) The said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.
(4) The payment of such instalments shall be made in New Zealand, and no instalments shall be paid out of loan-moneys.
(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Amending an Order in Council authorizing the Heathcote County Council to erect Electric Lines within the Heathcote County
WHEREAS the Heathcote County Council (hereinafter called the said local authority) proposes, pursuant to the terms of a requisition issued under section twenty-two of the Health Act, 1920, to raise a loan of fourteen thousand one hundred and seventy pounds (£14,170), to be known as "Electric Lines Extension Loan, 1947" (hereinafter called the said loan), for the purpose of providing electric lines for the purpose of extending the area of supply of the Heathcote County Council:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of fourteen thousand one hundred and seventy pounds (£14,170), and in giving such consent doth hereby determine as follows:-

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby further amend the Order in Council dated the eleventh day of November, one thousand nine hundred and thirty, and published in the Gazette on the twentieth day of the same month, at page 3585, as amended by the Order in Council dated the twenty-first day of September, one thousand nine hundred and thirty-eight, and published in the Gazette on the sixth day of October of the same year, at page 2184, authorizing the Heathcote County Council to erect electric lines within the County of Heathcote, by deleting clause one of the Schedule thereto and substituting the following clause:-
"1. AREA OF SUPPLY
"The area of supply shall comprise the Cashmere Riding of the County of Heathcote as at present constituted, the same being more particularly delineated on the plan marked P.W.D. 75490, deposited in the office of the Minister of Works, and that portion of the Heathcote Valley Riding of the said county as at present constituted which is coloured green on the plan marked S.H.D. 7, deposited in the office of the Minister in Charge of the State Hydro-electric Department."

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the powers vested in him by section six of the Housing Amendment Act, 1940, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the access-way described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Citizens of the City of Christchurch and be under the control and management of the Christchurch City Council.
SCHEDULE
APPROXIMATE area of the access-way dealt with : 32-8 perches.
Being part Lot 12, D.P. 1964, and part Lot 1, D.P. 12089 (part Rural Section 197).
Situated in the City of Christchurch (Canterbury R.D.).
