  1. The Board shall control the said reserve and the building erected thereon for the purposes of a memorial public hall, and shall also afford settlers and residents of Ratanui and the surrounding district such facilities for meeting within the said hall as may from time to time be determined by the Board; provided that the Board shall have power to fix reasonable charges for the use of the said hall.

Present:

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Mount Eden Borough Council on the twenty-sixth day of May, one thousand nine hundred and forty-seven (in so far as it affects the side and portion of street described in the Schedule hereto), viz.:-

"The Mount Eden Borough Council, being the local authority having control of the streets in the Borough of Mount Eden, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of Carrick Place adjoining Lot 2 and parts Lots 1 and 7, D.P. 181, being part Allotment 8, Section 10, Suburbs of Auckland, comprised in Certificate of Title 462/181";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Carrick Place (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE north-eastern side of all that portion of street situated in the North Auckland Land District, Borough of Mount Eden, known as Carrick Place, fronting parts of Lots 1 and 7, D.P. 181, being part of Allotment 8 of Section 10, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 125630, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Shipka Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE north-eastern side of all that portion of street situated in the Otago Land District, Borough of Green Island, known as Shipka Street, fronting Lots 37, 38, 39, 40, and 41, Deeds Plan 145, Township of Plevna. As the same is more particularly delineated on the plan marked P.W.D. 125651, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Pursuant to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

In pursuance and exercise of the powers and authorities conferred upon me by subsection one of section one hundred and sixty-seven of the Coal-mines Act, 1925, and of all other powers and authorities enabling me in this behalf, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby declare that the unalienated Crown land described in the Schedule hereto is set apart for the purposes of Part III of the said Act, and do hereby further declare that this notice shall take effect as from the date of the publication hereof in the New Zealand Gazette.
