Domain Board appointed to have Control of the Whakatane Domain

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke an Order in Council dated the twentieth day of January, one thousand nine hundred and forty-three, and published in the Gazette of the twenty-eighth day of that month, appointing a Domain Board to control the Whakatane Domain, and doth hereby appoint

The Whakatane Borough Council
to be the Whakatane Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Monday, the fourteenth day of July, one thousand nine hundred and forty-seven, at eight o'clock p.m., as the time when, and the Borough Council Chambers, Commerce Street, Whakatane, as the place where, the first meeting of the Board shall be held.

SCHEDULE

AUCKLAND LAND DISTRICT.-WHAKATANE DOMAIN
ALL that area containing by admeasurement 35 acres 1 rood 25·2 perches, more or less, being Allotment 285 and part Allotment 286, Waimana Parish : Bounded towards the north by Lots 1 to 7 on plan No. 17587, deposited in the office of the District Land Registrar at Auckland, 636·9 links ; towards the west by Lot 7 on plan No. 17587 aforesaid, 250 links ; towards the north by Domain Road, 159·5 links ; towards the east by Lot 8 on plan No. 17587 aforesaid, 250 links ; towards the north by Lots 8 to 12 on plan No. 17587 aforesaid, 387 links ; towards the east by Lots 15 to 22 on plan No. 17587 aforesaid, 707·9 links ; towards the north by Lot 22 on plan No. 17587 aforesaid, 250 links ; towards the east and north by Francis Street, 441 and 100 links ; towards the east by Allotment 263, Waimana Parish, 576 links ; towards the north by Allotments 263 and 263A, Waimana Parish, 641 links ; towards the east by Valley Road, 630 links ; towards the south generally by Goulstone Road, 1712, 375, and 530 links ; and towards the west by part Allotment 287, Waimana Parish, and Lots 52, 51, 50, 49, 48, and 47 on plan No. 15708, deposited in the office of the District Land Registrar at Auckland, 1975 links : be all the aforesaid linkages a little more or less. As the same is more particularly delineated on the plan marked L. and S. 1/217, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

Also Allotments 263 and 263A, Waimana Parish : Area, 4 acres 1 rood 22 perches, more or less.

Also all that area in the Borough of Whakatane situated in Block II, Whakatane Survey District, containing by admeasurement 8·8 perches, more or less, being Lot 1 on Deposited Plan 29635, being part of Allotment 287, Waimana Parish, and being the whole of the land comprised and described in Certificate of Title, Volume 731, folio 219, Auckland Registry. As the same is more particularly delineated on the plan marked L. and S. 1/217A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

At the Government House at Wellington, this 2nd day of July, 1947
Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council dated the sixteenth day of May, one thousand nine hundred and thirty-four, and published in the Gazette of the twenty-fourth day of the same month, at page 1525, the Northern Steamship Company, Limited (hereinafter called the company), was licensed to use and occupy a part of the foreshore and land below low-water mark at Kawakawa, in the Bay of Islands Harbour, as a site for a landing-stage and shed :

And whereas the company has applied to have the hereinbefore-recited Order in Council revoked, and it is desirable to revoke the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the sixteenth day of May, one thousand nine hundred and thirty-four; as from the first day of April, one thousand nine hundred and forty-seven.

Consenting to the Registration of Certification Trade-marks in the Name of The Ventile Fabrics Association of Great Britain

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to subsection eight of section thirty-nine of the Patents, Designs, and Trade-marks Amendment Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby consent to the registration under the said section thirty-nine of certification trade-marks in the name of The Ventile Fabrics Association of Great Britain in respect of—

(1) Textile piece-goods in Class 24 pursuant to application No. 42739, and
(2) Complete articles of clothing in Class 25 pursuant to application No. 42740,

advertised in the Patent Office Journal of the twenty-seventh day of March, one thousand nine hundred and forty-seven.

Vesting the Control of a Reserve in the Ratanui Memorial Public Hall Board

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the land described in the Schedule hereto was by Warrant published in Gazette of the fifteenth day of March, one thousand nine hundred and twenty-three, permanently reserved for a site for a public hall : And whereas it is expedient that the control of the said reserve should be vested in a special Board as hereinafter provided :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the reserve described in the Schedule hereto, for the period of five years from the date hereof (unless previously amended or revoked under the said Act), in the undermentioned persons, namely:—

John Randall Maginness,
Alexander Francis Sheed,
Percy Shaw,
William Elmslie Craigie,
Mervyn Robert McTaggart,
Derby Slater, and
John William Allan,
who are hereby constituted for that purpose a special Board by the name of the Ratanui Memorial Public Hall Board (hereinafter referred to as the Board), with the powers and subject to the conditions hereinafter contained, that is to say :—

  1. The Board shall meet for the transaction of business at the Ratanui Memorial Public Hall, or at such other place and at such time as may from time to time be fixed by the Board. The first meeting shall be held on Saturday, the twelfth day of July, one thousand nine hundred and forty-seven.

  2. The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days' notice of any such meeting is given to each member, specifying the business to be transacted at such special meeting ; and no other business than that so specified shall be transacted at such meeting.

  4. Any four members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

  6. If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

  8. The Board shall have prepared and submitted at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.
