Government Orders and Appointments




Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred
on him by section eleven of the said Act, as set out in section twenty-
nine of the Finance Act, 1932 (No. 2), and of all other powers and
authorities enabling him in this behalf, doth hereby consent to the
raising in New Zealand by the said local authority of the said loan
for the said purpose up to the amount of nineteen thousand five
hundred pounds (£19,500), and in giving such consent doth hereby
determine as follows :
(1) The term for which the said loan or any part thereof may
be raised shall not exceed ten (10) years.
(2) The rate of interest that may be paid in respect of the said
loan or any part thereof shall be such as shall not produce to the
lender or lenders a rate or rates exceeding three pounds two shillings
and sixpence (£3 2s. 6d.) per centum per annum.
(3) The said local authority shall, before raising the said loan
or any part thereof, make provision for the repayment thereof by
establishing a sinking fund under the Local Bodies' Loans Act,
1926, or under such other statutory enactment as may be applicable,
and shall thereafter make payments to such sinking fund at intervals
of not more than one year at a rate or rates per centum which shall
be not less than nine pounds ten shillings (£9 10s.), such payments
to be made in respect of every part of the said loan for the time
being so borrowed and not repaid, the first such payment to be
made not later than one year after the first day from which interest
to the lender or lenders is computed on the said loan or any part
thereof so raised.
(4) The payment of interest and the repayment of principal
in respect of the said loan shall be made in New Zealand.
(5) No amount payable as either interest or sinking fund in
respect of the said loan shall be paid out of loan-money.
(6) The rate for brokerage, underwriting, and procuration fees
in respect of the raising of the said loan or any part thereof shall
not in the aggregate exceed one-half per centum of any amount
raised.
(7) No moneys shall be borrowed under this consent after the
expiration of two years from the date hereof.
(8) Any proceeds from the sale of the remaining portion of
the old milk-station premises in Dixon Street are to be applied in
redemption of the said loan or into the sinking fund of the said
loan.

Consenting to the Raising of a Loan of £1,400 by the Waverley Town
Board and prescribing the Conditions thereof

ORDER IN COUNCIL
At the Government House at Wellington, this 2nd day of
July, 1947
Present:
WHEREAS the Waverley Town Board (hereinafter called the
said local authority) proposes, pursuant to the terms of a
requisition issued under section twenty-two of the Health Act,
1920, to raise a loan of one thousand four hundred pounds (£1,400),
to be known as "Water-supply Loan, 1947" (hereinafter called the
said loan), for the purpose of installing a filtration and chlorination
plant to increase the supply of wholesome water to the Board's
district :
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in pursuance
and exercise of the powers and authorities conferred on him by
section eleven of the Local Government Loans Board Act, 1926,
as set out in section twenty-nine of the Finance Act, 1932 (No. 2),
and of all other powers and authorities enabling him in this behalf,
doeth hereby consent to the raising in New Zealand by the said local
authority of the said loan for the said purpose up to the amount
of one thousand four hundred pounds (£1,400), and in giving such
consent doth hereby determine as follows :
(1) The term for which the said loan or any part thereof may
be raised shall not exceed twenty (20) years.
(2) The rate of interest that may be paid in respect of the
said loan or any part thereof shall be such as shall not produce
to the lender or lenders a rate or rates exceeding three pounds five
shillings (£3 5s.) per centum per annum.
(3) The said loan or any part thereof, together with interest
thereon, shall be repaid by equal aggregate annual or half-yearly
instalments extending over the term as determined in (1) above.
(4) The payment of such instalments shall be made in New
Zealand, and no instalments shall be paid out of loan-moneys.
(5) The rate payable for brokerage, underwriting, and pro-
curation fees in respect of the raising of the said loan or any part
thereof shall not in the aggregate exceed one-half per centum of
any amount raised.
(6) No moneys shall be borrowed under this consent after the
expiration of two years from the date hereof.

Delegation to the Whakatane County Council of the Power of
appointing Trustees for the Murupara Cemetery

Pursuant to section five of the Cemeteries Act, 1908, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, doth hereby delegate
to the Whakatane County Council the powers conferred upon him
by section four of the said Act of appointing and removing trustees
in respect of the cemetery within the meaning of the said Act,
known as the Murupara Cemetery, and being the land described in
the Schedule hereto.

Recreation Reserve in Westland Land District brought under Part II
of the Public Reserves, Domains, and National Parks Act, 1928

His Excellency the Governor-General in Council
By virtue of the powers and authorities vested in me by the
thirty-fourth section of the Public Reserves, Domains, and
National Parks Act, 1928, I, Lieutenant-General Sir Bernard Cyril
Freyberg, the Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive Council
of the said Dominion, do hereby order and declare that the reserve
for recreation in the Westland Land District described in the
Schedule hereto shall be and the same is hereby brought under the
operation of and declared to be subject to the provisions of Part II
of the said Act, and such reserve shall hereafter be known as the
Karoro Domain, and be managed, administered, and dealt with
as a public domain.

appoint

Thomas George Jamieson,
to be the Karoro Domain Board, having control of the land
described in the Schedule hereto; and doth hereby appoint
Thursday, the seventeenth day of July, one thousand nine hundred
and forty-seven, at half past seven o'clock p.m., as the time when,
and the Baptist Church Sunday School-house, Karoro, as the place
where, the first meeting of the Board shall be held.
