and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-second day of November, one thousand nine hundred and forty-six, viz. :
"The Waitaki County Council, being the local authority having control of the roads in the County of Waitaki, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-west side of that portion of the road adjoining Lots Thirty-seven, Thirty-eight, Thirty-nine, and Forty (37-40), Township of Ngapara, comprised in Certificate of Title 40/2 "; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of the unnamed road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE
THE south-western side of all that portion of unnamed road situated in the Otago Land District, County of Waitaki, fronting Lots 37, 38, 39, and 40, D.P. 134, Township of Ngapara. As the same is more particularly delineated on the plan marked P.W.D. 125088, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the fourteenth day of August, one thousand nine hundred and forty-six, viz. :
"The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the eastern side of Wilton Road South fronting Lot 13, Deeds Plan 108 ";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Wilton Road South (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
THE eastern side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Wilton Road South, fronting part Lot 13, Deeds Plan 108, being part Section 32, Karori District. As the same is more particularly delineated on the plan marked P.W.D. 125300, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Clutha County Council on the twenty-eighth day of January, one thousand nine hundred and forty-seven, viz. :
"The Clutha County Council, being the local authority having control of the roads in the County of Clutha, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of the portion of Lambourne Road adjoining Lot 76, Block I, Pomahaka Survey District, being lands in Certificate of Title 269/133 ";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Lambourne Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE
THE western side of all that portion of road situated in the Otago Land District, County of Clutha, known as Lambourne Road, fronting parts Lot 76, Clydevale Estate, D.P. 1959, Section 1077R, Block I, Pomahaka District. As the same is more particularly delineated on the plan marked P.W.D. 125134, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Boundaries of Borough of Timaru and County of Levels altered

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS, in pursuance of section one hundred and thirty-seven of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area be excluded from the County of Levels and included in the Borough of Timaru:
And whereas a Commission appointed under the said section held inquiries and recommended that the said area be excluded from the County of Levels and included in the Borough of Timaru:
And whereas it is deemed expedient to make the alteration of boundaries recommended by the said Commission:
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the thirtieth day of June, one thousand nine hundred and forty-seven, the area described in the Schedule hereto shall be excluded from the County of Levels and included in the Borough of Timaru.
SCHEDULE
AREA EXCLUDED FROM THE COUNTY OF LEVELS AND INCLUDED IN THE BOROUGH OF TIMARU
ALL that area in the Canterbury Land District, bounded by a line commencing at the present boundary of the Borough of Timaru at the northernmost corner of Lot 3 on Plan 4576, deposited in the office of the District Land Registrar at Christchurch, being the point of intersection of the south side of Macdonald Street with the west side of Evans Street; thence in a northerly direction across Macdonald Street, and along the west side of the Main North Road to its intersection with the centre-line of the east end of Grant’s Road; thence in a westerly direction along the centre-line of Grant’s Road to its intersection with the centre-line of Bouverie Street; thence in a southerly direction along the centre-line of Bouverie Street to its intersection with the centre-line of the western part of Grant’s Road; thence in a westerly and north-westerly direction along the centre-line of Grant’s Road to its intersection with the centre-line of Old North Road; thence in a south-westerly direction along the centre-line of Old North Road to its intersection with the centre-line of Page’s Road; thence in a westerly direction along the centre-line of Page’s Road to its intersection with the centre-line of Clyde Street; thence in a southerly direction along the centre-line of Clyde Street to its intersection with the centre-line of Tyne Street; thence in a south-easterly direction along the centre-line of Tyne Street to its intersection with the centre-line of Essex Street; thence in a southerly and south-easterly direction along the centre-line of Essex Street to its intersection with the present boundary of the said borough running in a north-easterly direction parallel to and five chains distant from the north-west side of Selwyn Street; thence easterly, north-easterly, and northerly generally along the boundary of the said borough to the northernmost point of Lot 3 aforesaid, the place of commencement, as shown on borough plan No. 12/93.

Officer authorized to take and receive Statutory Declarations

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that Walter Charles Bignell, being an officer in the service of the Crown holding the office of Inspector of Works, Public Works Department, at Lake Pukaki, is authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.
As witness the hand of His Excellency the Governor-General, this 19th day of June, 1947.
