NOTICE is hereby given that the order of the Supreme Court of New Zealand dated the 13th day of December, 1946, confirming the reduction of the capital of the above-named company from £5,000 to £2,500, and the minute (approved by the Court) showing with respect to the capital of the company as altered the several particulars required by the above statute, were registered by the Registrar of Companies on the 13th day of January, 1947.

And further take notice that the said minute is in the words and figures following :—

“The capital of John Cock, Limited, henceforth is £2,500 divided into 5,000 fully paid shares of 10s. each, instead of the present registered capital of £5,000 divided into 5,000 shares of £1 each.”

NAPIER BOROUGH COUNCIL

NOTICE OF INTENTION TO TAKE LAND

NOTICE is hereby given that the Napier Borough Council proposes to execute a certain public work—namely, the construction of public offices for the holding of the meetings and transacting the business of the Council and for the use of its officers—and that, for the purpose of such public work, the lands described in the Schedule hereto are required to be taken under the provisions of the Public Works Act, 1928, and its amendments. 749

A plan of the lands required to be taken is deposited in the offices of the Napier Borough Council, Tennyson Street, Napier, and may be inspected during ordinary office hours without fee.

All persons having any well-grounded objections to the execution of the said public work or to the taking of the said lands are required to send their objections in writing within forty days from the first publication of this notice to the Napier Borough Council, Tennyson Street, Napier.

THE SCHEDULE

Firstly, all that piece of land situate in the Borough of Napier, containing by admeasurement 12·8 perches, more or less, being part of Town Section 254 of the Town of Napier, comprising the balance of Lot 1 on a plan deposited in the Land Transfer Office at Napier as No. 1051 after deducting therefrom Lot 2 on Deposited Plan No. 2015, and being the balance of the land comprised in certificate of title H.B. Vol. 94, folio 83 (Hawke’s Bay Registry); and, secondly, all that piece of land situate as aforesaid, containing by admeasurement 36 perches, more or less, being the balance of Town Section 255, Town of Napier, after deducting that part now forming part of Dickens Street which was dedicated by Conveyance 40269, and being all the land comprised in certificate of title, H.B. Vol. 58, folio 18 (Hawke’s Bay Registry).

RESOLUTION

THE following regulations were laid before the members of the Castlepoint Racing Club at a meeting held on the 12th day of December, 1946, at Tinui, with a recommendation by the Chairman of such club, Mr. L. D. Cameron, Farmer, Tinui, that the same be passed at once with a view to their approval by His Excellency the Governor-General in pursuance of the Gaming Act, 1908, section 33.

Mr. L. D. Cameron, the Chairman of such club and the meeting, moved, and Mr. A. A. Schofield seconded, and it was resolved, that such regulations should be adopted and that the Chairman and Secretary be authorized to sign the same in authentication thereof.

The following are the regulations referred to :—

THE CASTLEPOINT RACING CLUB

REGULATIONS

(Under the Gaming Act, 1908)

In pursuance and exercise of the powers in that behalf contained in section 33 of the Gaming Act, 1908, and of all other powers and authorities it enabling in that behalf the Castlepoint Racing Club, a racing club within the meaning of the said Act (hereinafter referred to as the said club), doth hereby make the following regulations controlling the admission of persons to that part of the racecourse, situated in the district of Castlepoint and known as the Castlepoint Beach Racecourse, while the said racecourse is used or occupied by the said club for race meetings.

  1. These regulations shall come into force on the date of the same being published in the New Zealand Gazette.

  2. In these regulations the words “bookmaker,” “racing club,” and “race meeting” shall have the meanings ascribed to those terms respectively by section 2 of the Gaming Act, 1908.

  3. The following persons shall be and are hereby excluded from the racecourse above described while the same is used or occupied by the said club for a race meeting, namely :—

(a) Bookmakers :

(b) Bookmakers’ clerks, bookmakers’ assistants, and bookmakers’ agents :

(c) All persons under disqualification inflicted by any racing or trotting club in the Dominion of New Zealand, the Commonwealth of Australia, or elsewhere if affiliated to the New Zealand Racing Conference, or the New Zealand Trotting Conference, or the New Zealand Trotting Association :

(d) Common prostitutes and persons who habitually consort with thieves or persons who have no lawful visible means of support :

(e) Professional tipsters, persons convicted of house-breaking or pocket-picking, forgery, uttering or possessing counterfeit coin, theft, false pretences, receiving stolen goods, mischief, assault, or any offence or crime of any kind under the Crimes Act, 1908, and also idle and disorderly persons, rogues, and vagabonds, and incorrigible rogues convicted under the Police Offences Act, 1908, and persons convicted of an offence under the Gaming Act, 1908 :

Provided always that the Executive Committee appointed by the New Zealand Racing Conference, upon being satisfied by evidence as to character and otherwise that any person who, by reason of any conviction, comes within the scope of this regulation, should have relief from the effect thereof, may grant exemption to any such person, and may at any time revoke any such exemption without notice to such person, and without assigning any reason for such revocation.

The foregoing regulations of the Castlepoint Racing Club were made and passed by such club on the 12th day of December, 1946, and signed by the Chairman and Secretary.
