The Southern Side of Portion of Eden Street, in the Borough of Newmarket, exempted from the Provisions of Section 128 of the Public Works Act, 1928

At the Government Buildings at Wellington, this 30th day of April, 1947
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Newmarket Borough Council on the ninth day of April, one thousand nine hundred and forty-seven, in so far as it affects the side and portion of street described in the Schedule hereto, viz. :-
"That the Newmarket Borough Council, being the local authority having control of the streets in the Borough of Newmarket, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Eden Street fronting the subdivision of Lots 21 and 22, Deposited Plan 272, being portion of Allotment 17 of Section 6 of the Suburbs of Auckland."
SCHEDULE
The southern side of all that portion of street situated in the North Auckland Land District, Borough of Newmarket, known as Eden Street, fronting Lots 21 and 22, D.P. 272, being part of Allotment 17 of Section 6, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 124729, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Chatham Islands Dues Regulations 1947

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
Pursuant to the Chatham Islands County Council Empowering Act, 1936, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.
REGULATIONS

  1. These regulations may be cited as the Chatham Islands Dues Regulations 1947.
  2. These regulations shall come into force on the seventh day following the date of publication thereof in the Gazette.
  3. In these regulations, unless the context otherwise requires,-
    "The said Act" means the Chatham Islands County Council Empowering Act, 1936 :
    "The Council" means the Chatham Islands County Council : "The County" means the Chatham Islands County :
    "The wharf" means the Chatham Islands County Council Wharf at Waitangi :
    "Wharfinger" means the person appointed by the Council to the charge of the wharf, and includes any person acting by or under the authority of the wharfinger.
  4. (1) The dues set out under their respective headings in the First Schedule hereto shall be payable on goods imported into or exported from the County by any means whatsoever.
    (2) Wherever in the said First Schedule dues are made payable by the ton the tonnage shall be computed upon the ton by measurement (being forty cubic feet) or upon the ton by weight according to which mode of computation produces the larger sum.
  5. (1) The master, owner, or agent of every vessel shall give to the wharfinger or other person deputed by the Council one or more copies, as the wharfinger or such other person may reasonably require, of the bills of lading, freight-lists, or manifest of the goods, or other proper account of all goods intended to be landed from the vessel, and the name or names of the consignees to whom such goods are intended to be delivered. Such bills of lading, freight-lists, manifests, or other accounts shall contain full particulars of the number of items, weights, or measurements of such goods, according as freight is payable thereon by number, weight, or measurement.
    (2) Every person exporting goods from the County shall, before shipping such goods, deliver to the wharfinger, or other person deputed by the Council, a full and true account of all such goods, containing full particulars of the number of items, weights or measurements of such goods, according as freight is payable thereon by number, weight, or measurement.
  6. All dues on inward goods must be paid on the delivery from wharf of goods landed on the wharf and on goods not so landed at the time they are landed on shore, and on outward goods before they are shipped.
  7. The respective regulations made under the said Act and referred to in the Second Schedule hereto are revoked.
